PROVISIONS FOR THE ISSUANCE OF THE CERTIFICATE OF ORIGIN FOR EXPORT GOODS OF THE PEOPLE'S REPUBLIC OF CHINA (TRIAL IMPLEMENTATION)
(Promulgated by the Ministry of Foreign Trade and Economic Cooperation on November 21, 1995)
The provisions are formulated in compliance with the "Rules of the Place of Origin on Export Goods of the People's Republic of China" and the "Provisions for the Implementation of the Rules of the Place of Origin on Export Goods of the People's Republic of China", in order to strengthen administration of the issuance of Certificates of Origin.

贸促会，各省、自治区、直辖市及计划单列市外经贸厅（委、局），国家商检局，各地商检局，各贸促分会：
自１９９２年国务院颁布的《中华人民共和国出口货物原产地规则》和外经贸部颁布的《中华人民共和国出口货物原产地规则实施办法》以来，我国的原产地证书签证和管理工作取得了很大进展。为了进一步做好这项工作，规范出口货物原产地证明书的签发和管理工作，外经贸部、国家商检局和贸促会根据今年全国原产地工作会议讨论意见，对《关于签发中华人民共和国出口货物原产地证明书的规定（试行）》（以下简称《规定》）印发给你们，请遵照执行。
本《规定》所列附件的表格、内容均为标准格式，请签证单位按统一标准格式制作。各地外经贸委（厅、局）要协调本地区的商检和贸促会签证单位，做好对原产地证明书申领单位的宣传、培训工作，并将本《规定》转发各外贸企业。
本《规定》自１９９６年１月１日起执行。原有关签发原产地证书的规定与本《规定》不符的，以本《规定》为准。在执行过程中有何问题或建议，请及时报外经贸部（贸管司）。
有关《中华人民共和国出口货物原产地证明书》的规定，将另行通知。

附件
关于签发中华人民共和国出口货物原产地证明书的规定（试行）
为了加强对中华人民共和国出口货物原产地证明书（以下简称原产地证）签发工作的管理，根据《中华人民共和国出口货物原产地规则》及《中华人民共和国出口货物原产地规则实施办法》，特制定本规定。

CHAPTER I REGISTRATION AND VERIFICATION
| | 第一章 注册登记与审核
|
Article 1 Any enterprises, which meet the stipulations in the Article 4 of the "Provisions for the Implementation of the Rules of the Place of Origin on Export Goods of the People's Republic of China", may apply for registration with the certificate issuing organizations in the respective regions.
| | 第一条 凡符合《中华人民共和国出口货物原产地规则实施办法》第四条规定的企业，均可向所在地原产地证签发机构申请注册登记。

Article 2 At the time of application for registration with the certificate issuing organizations, enterprises shall submit and fill in the following documents:
| | 第二条 企业向原产地证签发机构申请注册登记的同时，须提供并填制下列材料：
|
1. documents certifying the rights of handling import and export approved by the governmental competent departments;
| | （一）政府主管部门授予企业进出口经营权的文件；
|
2. copies of business licenses;
| | （二）企业营业执照副本；
|
3. written application for registration for Certificate of Origin;
| | （三）原产地证注册登记书面申请；
|
4. "Registration Form for the Application for Certificate of Origin for Export Goods of the People's Republic of China" (see Annex 1);
| | （四）《申请中华人民共和国出口货物原产地证明书注册登记表》（见附件一）；
|
5. "Detailed List of Processing Procedures and Costs for Goods Containing Imported Elements" (see Annex 2);
| | （五）《含进口成份产品加工工序成本明细单》（见附件二）；
|
6. "Applicant Credential for Certificates of Origin" (see Annex 3); there can be three authorized applicants in each applicant enterprise.
| | （六）《原产地证明书申领员授权书》（见附件三）；每一申请企业允许授权三名申领员。

Article 3 At the time of application for registration, foreign trade enterprises shall submit the relevant information about the enterprises with the products resources of supply and their products in accordance with the requirements of the certificate issuing organizations. If the export goods are supplied from another place, foreign trade enterprises shall, in accordance with the requirements of the certificate issuing organizations, submit the "Investigation Result List of the Origin on Goods Supplied from Another Place" (see Annex 8) issued by the certificate issuing organizations in respective regions.
| | 第三条 外贸企业申请注册登记时，还应按签证机构要求，提供货源企业及其产品的有关材料。出口货物为异地货源的，还应根据签证机构的要求，提供货源所在地签证机构提供的《异地货源原产地调查结果单》（见附件八）。

Article 4 Registered enterprises shall set up records of materials purchase, manufacture and delivery for export goods in accordance with the requirements of the certificate issuing organizations.
| | 第四条 经注册登记的企业，须按签证机构的要求，建立出口货物进料、生产、出货记录。

Article 5 In case there are any changes to processing procedures, raw materials, and products, registered enterprises shall notify the alteration to the certificate issuing organizations in time.
| | 第五条 经注册登记的企业及其出口货物发生加工工序、原料、产品变化，须及时向签证机构申报更改。
|
Article 6 After receiving application for registration, the certificate issuing organizations shall examine and verify the documents submitted by the relevant enterprises, and send special personnel to make on-site investigation of the manufacturing equipments, processing procedures, origin of the raw materials, components and parts, finished products and their descriptions, inner and/or outer packing and so on, and fill in "Investigation Record of Origin of Export Goods of the People's Republic of China" (see Annex 4).
| | 第六条 签证机构受理申请后，必须严格审查核实企业所提供的材料，并派专人到企业实地调查核实生产设备、加工工序、原料及零部件的产地来源、制成品及其说明书和内外包装等，填写《中华人民共和国出口货物原产地调查记录》（见附件四）。

Article 7 The certificate issuing organizations shall give registration to the qualified enterprises and their products. The period of validity lasts one year from the registration date, and at its expiration, can be extended one year after being verified again.
| | 第七条 签证机构对经审核合格的企业及其产品应予以注册。注册有效期为一年，以注册日年度为限。期满经审核合格的，续展一年。

Article 8 The certificate issuing organizations have the right to make random investigation on export goods (see Annex 5 "Random Investigation Record on Issuance of Origin for Export Goods of the People's Republic of China").
| | 第八条 签证机构有权对出口货物实行随机抽查（见附件五《中华人民共和国出口货物原产地证明书签证抽查纪录》）。

CHAPTER II APPLICATION FOR CERTIFICATES OF ORIGIN AND ISSUANCE
| | 第二章 原产地证的申领与签发
|
Article 9 After registration, enterprises shall designate signers and applicants for Certificates of Origin, who shall go through training organized by the certificate issuing organizations. Applicants shall apply for Certificates of Origin with the Certificates of Applicant (see Annex 6 "Certificate of Applicant for Certificate of Origin for Export Goods of the People's Republic of China") issued by the certificate issuing organizations. The Certificates of Applicant may not be borrowed, erased/altered, or used by other personnel to apply for Certificates of Origin. In case of the loss of the Certificates of Applicant, the enterprises shall make declaration to the certificate issuing organizations in time. The signers and applicants for Certificates of Origin may not be altered freely. If there is any alternation, the enterprise shall notify the certificate issuing organizations in time and return the Certificates of Applicants.
| | 第九条 企业经注册登记后，须指定原产地证手签人员和申领员，企业手签人员和申领员应接受签证机构的业务培训。申领员凭签证机构颁发的申领员证（见附件六《中华人民共和国出口货物原产地证明书申领员证》）申办原产地证。此证不得转借、涂改，也不得用此证代替他人领取证书。若有遗失，立即向发证单位申明。原产地证手签人员和申领员不应随意变更，如有变更，应及时报告签证机构，并交回申领员证。

Article 10 Enterprises shall file application for Certificates of Origin with the certificate issuing organizations at least three days before the goods to go through Customs declaration and be shipped, the relevant enterprises shall strictly follow the requirements of the certificate issuing organizations and complete the following documents accurately, integrally, and correctly:
| | 第十条 企业最迟于货物报关出运前三天向签证机构申请办理原产地证，并严格按签证机构要求，真实、完整、正确地填写以下材料：
|
1. An "Application for Certificate of Origin for Export Goods of the People's Republic of China/Certificate of Processing and Assembling" (see Annex 7);
| | （一）《中华人民共和国出口货物原产地证明书／加工装配证明书申请书》（见附件七）；
|
2. Four copies of "Certificates of Origin for Export Goods of the People's Republic of China";
| | （二）《中华人民共和国出口货物原产地证明书》一式四份；
|
3. A commercial invoice for export goods;
| | （三）出口货物商业发票；
|
4. Other documents considered necessary by the certificate issuing organizations.
| | （四）签证机构认为必要的其他证明文件。
|
Article 11 Export goods, for which enterprises apply for Certificates of Origin but are not within the scope of registration, shall be declared to the certificate issuing organizations for registration according to respective stipulations. The Certificates of Origin may be issued only after verification and registration.
| | 第十一条 企业申办原产地证的产品超出注册范围的，须按注册要求申报，经审核登记后，方可办理原产地证。

Article 12 If export goods for which enterprises apply for Certificates of Origin contain imported elements, the enterprises shall submit the "Detailed List of Processing Procedures and Costs for Goods Containing Imported Elements". If export goods are produced with supplied materials or imported materials, the enterprises shall submit import documents and certificates, purchase contract and/or processing contract. If goods supplied from another place contain imported elements, the enterprises shall, in accordance with the requirements of the certificate issuing organizations, submit "Investigation Result List of Origin of Goods Supplied from Another Place" issued by the certificate issuing organizations in the place of products resources of supply. Under such case, the certificate issuing organizations in the place of products resources of supply shall render their coordination in this respect.
| | 第十二条 企业申办原产地证的出口货物，如含有进口成份，须提供《含进口成份产品加工工序成本明细单》。如属来料加工、进料加工方式生产的出口货物，须提供进口凭证、购货合同或加工合同。含有进口成份的异地货物，还应按签证机构要求，提供货源地签证机构出具的《异地货源原产地调查结果单》，货源地签证机构须予以配合。

Article 13 The certificate issuing organizations shall conscientiously verify documents submitted by enterprises in accordance with the "Rules of the Place of Origin of Export Goods of the People's Republic of China", the "Provisions for the Implementation of the Rules of the Place of Origin of Export Goods of the People's Republic of China" and these provisions. Only after the submitted documents are correct through examination, the certificate issuing organizations may issue Certificates of Origin.
| | 第十三条 签证机构应严格按照《中华人民共和国出口货物原产地规则》及其《实施办法》及本规定，认真审核企业提交的材料，经审核无误后，方可予以签证。

Article 14 The certificate issuing organizations only issue one original and three copies of Certificates of Origin, of which one original and two copies are kept by the applicants, and one copy is kept in file by the certificate issuing organizations for two years.
| | 第十四条 签证机构只签发原产地证正本一份、副本三份，其中一正二副交申请企业。另一副本由签证机构存档，并保存两年。

Article 15 In case Certificates of Origin issued are lost or damaged, enterprises may make application for reissuance of Certificates of Origin, in accordance with the stipulations in the Article 18 of the "Provisions for the Implementation of the Rules of the Place of Origin on Export Goods of the People's Republic of China", and fill in "Application for Alteration/Reissuance of Certificate of Origin for Export Goods of the People's Republic of China" (see Annex 9) the certificate issuing organizations may issue duplicate certificates, and mark "THIS CERTIFICATE IS IN REPLACEMENT OF CERTIFICATE OF ORIGIN NO- DATED-WHICH IS CANCELLED" in English in box 5 of the certificate. The date in box 11 and 22 shall be actual application date and reissuance date for the duplicate certificates.
| | 第十五条 如果已签发的证书遗失或毁损，可按《中华人民共和国出口货物原产地规则实施办法》第十八条规定办理重发证书，填写《中华人民共和国出口货物原产地证明书更改／重发申请书》（见附件九），并在证书第五栏加注英文“ＴＨＩＳ ＣＥＲＴＩＦＩＣＡＴＳ ＩＳ ＩＮ ＲＥＰＬＡＣＥＭＥＮＴＯＦ ＣＥＲＴＩＦＩＣＡＴＥ ＯＦ ＯＲＩＧＩＮ ＮＯ－ＤＡＴＥＤ－ＷＨＩＣＨ ＩＳ ＣＡＮＣＥＬＬＥＤ”。证书第十一栏和第十二栏的日期应为重发证书的实际申请日期和签发日期。

Article 16 In case enterprises apply for Certificates of Origin after the goods were shipped, the certificate issuing organizations may issue certificate retrospectively according to the stipulations in the Article 19 of the "Provisions for the Implementation of the Rules of the Place of Origin on Export Goods of the People's Republic of China", and put "ISSUED RETROSPECTIVELY" English stamp on box 5 of the certificate. The date in box 11 and box 12 shall be actual application date and issuance date.
| | 第十六条 货物出运后申请签证，应按《中华人民共和国出口货物原产地规则实施办法》第十九条规定签发“后发证书”，并在证书第五栏加注英文“ＩＳＳ－ＵＥＤ ＲＥＴＲＯＳＰＥＣＴＩＶＥＬＹ”印章。证书第十一栏和第十二栏应为实际申请日期和签发日期。

Article 17 In case enterprises require alternation to issued certificates, they shall fill in the "Application for Alternation/Reissuance of Certificate of Origin for Export Goods of the People's Republic of China" according to the relevant stipulations, and return the original certificates. After verification of the situation and acceptation of the original certificate of origin, the certificate issuing organizations may issue new Certificates of Origin.
| | 第十七条 企业要求更改已签发的证书内容时，必须按规定填写《中华人民共和国出口货物原产地证明书更改／重发申请书》，并退回原证书。签证机构经核实并收回原证书后，方可签发新证书。

Article 18 Enterprises may entrust forwarding agent with the applying for Certificates of Origin. At the time of application, the entrusted Agent shall submit the letters of entrustment, Certificates of Origin duly filled and signed by themselves, and other relevant documents which are provided by the entrusting enterprises, to the certificate issuing organizations.
| | 第十八条 企业可委托货运代理公司代理申领原产地证。代理公司申领原产地证时，必须向签证机构提交被代理企业的委托书和由其填妥并签署的原产地证及有关单证。

Article 19 If unqualified enterprises apply for Certificates of Origin for use in overseas exhibitions, they may apply for Certificates of Origin by themselves against instruments of ratification for overseas exhibitions, or may apply for Certificates of Origin through entrusting qualified enterprises.
| | 第十九条 不具备申请资格的企业参加国外展览，若需申领原产地证，可凭参展批件自行申领或委托有申请资格的企业代理申请。

CHAPTER III ADMINISTRATION OF ISSUANCE OF CERTIFICATES OF ORIGIN
| | 第三章 签证管理
|
Article 20 The certificate issuing organizations shall carry out strict administration of issuance of Certificates of Origin, and establish regulations and procedures.
| | 第二十条 签证机构应实行严密的签证管理，制定管理规章程序。
|
Article 21 For issuance stamps and blank Certificates of Origin, a system of special-personnel-supervision shall be implemented strictly.
Certificate issuing organizations may not give applying enterprises the blank Certificates of Origin which have been signed and sealed.
| | 第二十一条 空白证书和签证印章要实行严格的专人专管制度。签证机构不得将已签字盖章的空白证书交给申领企业。

Article 22 The certificate issuing organizations shall strengthen the training to the certificate issuing personnel. The certificate issuing personnel shall familiarize themselves with the "Rules of the Place of Origin of Export Goods of the People's Republic of China", the "Provisions for the Implementation of the Rules of the Place of Origin on Export Goods of the People's Republic of China" and the relevant provisions, master the State foreign economic and trade policies, international trade and knowledge of classification of commodity, grasp the elemental structure and production situation of goods under the certificates in their own regions, and be required corresponding English level as well.
