Notice of the General Office of the People's Government of Shandong Province on Further Regulating the Delegation of the Power to Approve Foreign-Funded Enterprises to Lower Levels

The people's governments of all cities, all provincial government departments, all institutions directly under the provincial government, all large enterprises, and all higher education institutions:
In accordance with the relevant provisions of the state, and with the consent of the provincial government, we hereby give our notice on the relevant matters concerning further regulating the delegation of the power to approve foreign-funded enterprises to lower levels as follows:

各市人民政府，省政府各部门、各直属机构，各大企业，各高等院校：
根据国家有关规定，经省政府同意，现就进一步规范下放外商投资企业设立审批权的有关事项通知如下：

I.For the establishment of any foreign-funded enterprise whose investment amount is less than 30 million USD, which belongs to the encouraged or permitted projects provided for in the Provisions on Guiding the Orientation of Foreign Investment of the state and the Catalogue for the Guidance of Foreign Investment Industries, and which does not need to be comprehensively balanced by the state or province, and whose export of products involves neither quota nor licensing administration (with the exception of those under particular approval provisions of the state and the province), the people's government of the city concerned shall be authorized to examine and approve the project and to issue the approval certificate of foreign-funded enterprise. The specific affairs shall be handled by the competent department for foreign trade and economic cooperation. The foreign-funded enterprises established upon the approval by all cities shall be reported to the provincial department of foreign trade and economic cooperation for record.
．．．．．． | | 一、凡设立投资总额3000万美元以下(不含3000万美元，下同)、属于国家《指导外商投资方向规定》和《外商投资产业指导目录》中规定的鼓励类和允许类项目，且不需要国家和省综合平衡，产品出口不涉及配额、许可证管理的外商投资企业(国家和省有特殊审批规定的除外)，授权各市人民政府审批并颁发外商投资企业批准证书，具体业务由外经贸主管部门负责办理。各市批准设立的外商投资企业应报省外经贸厅备案。
