Chapter I General Provisions
| | 第一章 总则
|
Article 1 This Regulation is formulated for the purpose of making use of social human resources to serve the army construction, regulating the employment and administration of the civilian staff, building a team of high-quality civilian staff, and adapting to the requirements of the army's revolutionization, modernization and normalization construction.
| | 第一条 为了利用社会人才资源为军队建设服务,规范文职人员的聘用和管理,建设高素质的文职人员队伍,适应军队革命化、现代化、正规化建设的需要,制定本条例。

Article 2 The term "civilian staff" as mentioned in this Regulation refers to those not-in-service personnel that are employed to work for the army pursuant to the prescribed staff and are performing corresponding duties of in-service officers (civilian cadres) at the same kind of posts.
| | 第二条 本条例所称文职人员,是指按照规定的编制聘用到军队工作,履行现役军官(文职干部)同类岗位相应职责的非现役人员。

Article 3 The civilian staff shall be subject to an employment system, in which they shall enjoy the rights and fulfill the obligations as prescribed in this Regulation.
| | 第三条 文职人员实行聘用制度,享有本条例规定的权利,履行本条例规定的义务。

Article 4 The guidelines of respecting work, knowledge, talents and innovation and the principles of making appointment on merits, having both political integrity and professional competence, being fair and selecting the best shall be implemented in the employment and administration of the civilian staff.
| | 第四条 文职人员的聘用和管理,应当贯彻尊重劳动、尊重知识、尊重人才、尊重创造的方针,坚持任人唯贤、德才兼备、公平择优的原则。

Article 5 The General Political Department of the Chinese People's Liberation Army shall take charge of the work of the whole army relating to civilian staff; and the political department of each entity at or above the regimental level shall be responsible for the work relating to the civilian staff of its own entity.
| | 第五条 中国人民解放军总政治部主管全军的文职人员工作;团级以上单位的政治机关负责本单位的文职人员工作。

Chapter II Rights and Obligations
| | 第二章 权利和义务
|
Article 6 The civilian staff shall enjoy the following rights:
| | 第六条 文职人员享有下列权利:
|
(1)Participating in the political life, and obtaining political honor as well as mental and physical rewards;
| | (一)参加政治生活,获得政治荣誉和精神、物质奖励;
|
(2)Obtaining remunerations for work, and enjoying corresponding welfare treatments and social securities;
| | (二)取得工作报酬,享受相应的福利待遇和社会保障;
|
(3)Having necessary working conditions for fulfilling the duties attached to their respective posts;
| | (三)获得履行岗位职责必需的工作条件;
|
(4)No employment contract may be dissolved and no punishment may be imposed without any statutory cause or through the prescribed procedures;
| | (四)非因规定事由、未经规定程序不被解除聘用合同或者惩处;
|
(5)Dissolving an employment contract with an employing entity pursuant to the prescribed conditions and procedures; and
| | (五)按照规定的条件和程序与聘用单位解除聘用合同;
|
(6)Applying for settling a personnel dispute pursuant to the provisions.
| | (六)按照规定申请人事争议处理。
|
Article 7 The civilian staff shall enjoy the following obligations:
| | 第七条 文职人员应当履行下列义务:
|
(1)Being loyal to the motherland and the Chinese Communist Party, and exerting themselves to serve the army construction;
| | (一)忠于祖国,忠于中国共产党,努力为军队建设服务;
|
(2)Abiding by the Constitution, laws and regulations and the relevant rules and systems as set down by the army;
| | (二)遵守宪法、法律、法规和军队的有关规章制度;
|
(3)Obeying orders and commands, observing disciplines, and keeping secrets;
| | (三)服从命令,听从指挥,遵守纪律,保守秘密;
|
(4)Performing employment contracts, taking part in battles, military exercises, military drills and emergency handling;
| | (四)履行聘用合同,根据军队需要参加作战、军事演习、军事训练和处置突发事件;
|
(5)Being solidary, cooperative, industrious and dedicated, and scrupulously abiding by the professional ethics; and
| | (五)团结协作,勤奋敬业,恪守职业道德;
|
(6)Learning and commanding scientific, cultural and professional knowledge necessary for fulfilling duties required by their respective posts, and improving their actual working abilities.
| | (六)学习和掌握履行岗位职责所需要的科学文化和专业知识,提高实际工作能力。

Chapter III Scope of Employment and Establishment of Posts
| | 第三章 聘用范围和岗位设置
|
Article 8 The civilian staff may be employed at such professional technical posts as teaching, scientific research, engineering, health, recreational and sports, books and archives, etc. and the non-professional technical posts as some of the management affairs and service guarantee posts in the organs at or above the army level and the non-combat armed forces located at places other than those remote and tough regions (hereinafter referred to as employing entities). In terms of the posts to be taken, the civilian staff may be divided into professional technical civilian staff and non-professional technical civilian staff.
| | 第八条 军级以上机关和驻边远艰苦地区以外的非作战部队(以下统称聘用单位)的教学、科研、工程、卫生、文体、图书、档案等专业技术岗位以及部分管理事务和服务保障等非专业技术岗位,可以聘用文职人员。 文职人员按照聘用的岗位,分为专业技术文职人员和非专业技术文职人员。

Article 9 The staffing size of civilian staff of the entire army shall be determined by the Central Military Commission. The size of civilian staff of an employing entity and the alteration thereof shall be determined by the organizational and staffing organ of an army pursuant to the organizational and staffing power.
| | 第九条 全军文职人员的编制员额,由中央军事委员会确定。聘用单位文职人员的编制及其调整,由军队组织编制主管机关按照组织编制管理权限确定。

Article 10 The post grades for civilian staff shall be:
| | 第十条 文职人员的岗位等级设置:
|
(1)elementary professional technical posts, intermediate professional technical posts and higher professional technical posts in the case of grades of professional technical posts;
| | (一)专业技术岗位等级分为:初级专业技术岗位、中级专业技术岗位和高级专业技术岗位;
|
(2)sixth-degree posts, fifth-degree posts, fourth-degree posts, third-degree posts and second-degree posts from low to high levels in the case of grades of non-professional technical posts. Each grade of non-professional technical posts respectively corresponds to the parallel grade of staff members at the same kind of posts in public institutions as prescribed by the State.
| | (二)非专业技术岗位等级由低到高分为:六级职员岗位、五级职员岗位、四级职员岗位、三级职员岗位和二级职员岗位。 非专业技术岗位各等级,分别与国家规定的事业单位同类岗位人员的相应职务等级相对应。

Article 11 Names, numbers and grades of the posts for civilian staff shall be determined pursuant to the prescribed staff.
| | 第十一条 文职人员岗位的名称、数量和等级,按照规定的编制执行。
|
Chapter IV Employment Requirements
| | 第四章 聘用条件
|
Article 12 A civilian shall meet the following fundamental requirements:
| | 第十二条 文职人员应当具备下列基本条件:
|
(1)complying with the political requirements for recruiting citizens to serve in the army;
| | (一)符合征集公民服现役的政治条件;
|
(2)complying with the duty requirements required by the post to be taken and the corresponding qualification requirements;
| | (二)符合聘用岗位的职责要求和相应的资格条件;
|
(3)having an educational background of bachelor's degree or higher, however, the requirements may be relaxed for professional technical posts of nursing, art and sports; and
| | (三)具有大学本科以上学历,但是,对从事护理、艺术、体育等专业技术岗位工作的,学历要求可以适当放宽;
|
(4)being in good health. The qualification requirements for the posts of civilian staff shall be determined by reference to the professional technical qualifications or employment qualification requirements for serving officers (civilian cadres) at the same kinds of posts. The health requirements for civilian staff shall be determined by reference to the physical check-up standards for citizens to be recruited.
| | (四)身体健康。 文职人员岗位的资格条件,参照同类岗位现役军官(文职干部)的专业技术资格或者任职资格条件执行。 文职人员的身体条件,参照应征公民体格检查标准执行。

Article 13 The maximum age for a civilian to be employed for the first time shall be:
| | 第十三条 文职人员首次聘用的最高年龄分别为:
|
(1)35 years old for an elementary professional technical post or a sixth-grade or fifth-grade post;
| | (一)聘用到初级专业技术岗位或者六级职员、五级职员岗位的,35岁;
|
(2)40 years old for a secondary professional technical post or a fourth-grade or third-grade post; and
| | (二)聘用到中级专业技术岗位或者四级职员、三级职员岗位的,40岁;
|
(3)45 years old for a senior professional technical post or a second-grade post.
| | (三)聘用到高级专业技术岗位或者二级职员岗位的,45岁。

Article 14 The maximum age for a civilian shall be:
| | 第十四条 文职人员的最高工作年龄分别为:
|
(1)40 years old for an elementary professional technical post or a sixth-grade or fifth-grade post;
| | (一)初级专业技术岗位或者六级职员、五级职员岗位的,40岁;
|
(2)45 years old for a secondary professional technical post or a fourth-grade or third-grade post; and
| | (二)中级专业技术岗位或者四级职员、三级职员岗位的,45岁;
|
(3)60 years old for a male senior professional technical post or second-grade post and 55 years old for a female senior professional technical post or second-grade post; the maximum age for working at a senior professional technical post may be properly extended due to the requirements of the work after obtaining the approval of an entity at the level of military area command.
| | (三)高级专业技术岗位或者二级职员岗位的,男60岁,女55岁;其中在高级专业技术岗位工作的,因工作需要,经军区级单位批准,可以适当延长最高工作年龄。

Chapter V Establishment of the Employment Relationship
| | 第五章 聘用关系的建立
|
Article 15 Where there is any vacancy in the posts of civilian staff, a public employment shall be conducted therefor unless it is a post involved in any confidential work.
| | 第十五条 文职人员岗位出现缺额时,除涉密岗位以外,应当实行公开招聘。
|
Article 16 An employing entity shall form a working committee for employment of civilian staff composed by the principal of its political department, functionaries of pertinent departments and experts, which shall be responsible for examination, assessment and appraisal of job hunters.
| | 第十六条 聘用单位应当成立由聘用单位的政治机关负责人、有关部门工作人员和专家组成的文职人员招聘工作委员会,负责组织应聘人员的审查、考核和评审等工作。
|
Article 17 The employment of civilian staff shall be conducted pursuant to the following procedures:
| | 第十七条 招聘文职人员按照下列程序进行:
|
(1)publishing recruitment posts and the requirements and benefits of each post;
| | (一)公布招聘岗位、岗位资格条件和待遇;
|
(2)conducting a preliminary examination of job hunters pursuant to this Regulation;
| | (二)依照本条例规定的条件对应聘人员进行初审;
|
(3)conducting an examination and check of those persons that are found to be qualified upon preliminary examination in terms of their professional theories, skills and relevant scientific and cultural knowledge, and organizing a thesis defense or assessment of any person to be employed at a senior professional technical post or a second-grade post; ...... | | (三)对初审合格的,进行专业理论、技能和相关科学文化知识的考试、考查,对拟聘用到高级专业技术岗位或者二级职员岗位的,还应当组织答辩和评审; ...... |
