The “Organic Administration Regulation of Public Security Organs”, which was adopted at 154th executive meeting of the State Council on November 1, 2006, is hereby promulgated, and shall come into force on January 1, 2007.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 The present Regulation is formulated in accordance with the “Civil Servants Law of the People's Republic of China” and the “People's Police Law of the People's Republic of China” for the purpose of regulating the organic administration of public security organs, and guaranteeing public security organs and people's police to perform duties according to law.
| | 第一条 为了规范公安机关组织管理，保障公安机关及其人民警察依法履行职责，根据《中华人民共和国公务员法》、《中华人民共和国人民警察法》，制定本条例。

Article 2 Public security organs are an important instrument of the people's democratic dictatorship. The people's police are the public security administration force and criminal justice force of the state, which are of armed nature, assume the duties of preventing, stopping and punishing illegal and criminal activities according to law, protecting the people, serving economic and social development, maintaining national security, and maintaining the public security order.
| | 第二条 公安机关是人民民主专政的重要工具，人民警察是武装性质的国家治安行政力量和刑事司法力量，承担依法预防、制止和惩治违法犯罪活动，保护人民，服务经济社会发展，维护国家安全，维护社会治安秩序的职责。

Article 3 The Ministry of Public Security shall be in charge of the public security work nationwide under the leadership of the State Council, and is the organ leading and commanding the public security work nationwide.
The public security organ of a local people's government at the county level or above shall take charge of the public security work within its own jurisdiction under the leadership of the people's government at the same level, and is the organ leading and commanding the public security work within its own jurisdiction.
| | 第三条 公安部在国务院领导下，主管全国的公安工作，是全国公安工作的领导、指挥机关。
县级以上地方人民政府公安机关在本级人民政府领导下，负责本行政区域的公安工作，是本行政区域公安工作的领导、指挥机关。

Article 4 Public security organs shall be under the system whereby the administrative chief assumes full responsibility.

Chapter II Establishment of Public Security Organs
| | 第二章 公安机关的设置
|
Article 5 The public security organ of a people's government at the county level or above shall be established within the scope of powers and pursuant to the procedures under the laws and administrative regulations.
| | 第五条 县级以上人民政府公安机关依照法律、行政法规规定的权限和程序设置。
|
Article 6 The public security bureau of a districted municipality shall, when required by its work, establish branch bureaus of public security. The public security bureau of a municipality, county or autonomous county shall, when required by its work, establish dispatched offices of public security.
The establishment and revocation of a branch bureau of public security or a dispatched office of public security shall be subject to examination and approval within the prescribed scope of powers and pursuant to the prescribed procedures.
| | 第六条 设区的市公安局根据工作需要设置公安分局。市、县、自治县公安局根据工作需要设置公安派出所。
公安分局和公安派出所的设立、撤销，按照规定的权限和程序审批。

Article 7 The internal institutions of the public security organ of a local people's government at the county level or above or each of its branch bureaus of public security shall include the comprehensive management institution and the law enforcement service institution.
Law enforcement service institutions shall be of a brigade-based organizational mode, including general brigades, brigades, detachments, and lochuses.
| | 第七条 县级以上地方人民政府公安机关和公安分局内设机构分为综合管理机构和执法勤务机构。
执法勤务机构实行队建制，称为总队、支队、大队、中队。

Article 8 The establishment and revocation of the internal institution of the public security organ of a local people's government at the county level or above or the branch bureau of public security thereof shall be subject to examination and approval within the scope of powers and pursuant to the procedures prescribe by the state.
| | 第八条 县级以上地方人民政府公安机关和公安分局内设机构的设立、撤销，按照国家规定的权限和程序审批。

Article 9 Watch houses, detention houses, drug-relief reformatories, and collection and education houses shall be established in accordance with laws and administrative regulations.
| | 第九条 看守所、拘留所、戒毒所、收容教育所依照法律、行政法规的规定设置。

Chapter III Positions of the People's Police of Public Security Organs
| | 第三章 公安机关人民警察职务

Article 10 The positions of the people's police of public security organs shall be divided into police officer positions, constable positions and police technical positions.
| | 第十条 公安机关人民警察职务分为警官职务、警员职务和警务技术职务。

Article 11 The people's policemen of a public security organ who perform police command duties shall be in the class of police officer positions.
The positions of leaders of public security organs and those of police officers of the internal comprehensive management institutions shall, from high to low, be as follows: chiefs at the provincial or ministerial level, deputies at the provincial or ministerial level, chiefs at the departmental or bureau level, deputies at the departmental or bureau level, chiefs at the county or division level, deputies at the county or division level, chiefs at the township or section level, deputies at the township or section level.
The positions of the police officers of internal law enforcement service institutions of public security organs shall, from high to low, be as follows: chiefs of the general brigades, deputy chiefs of the general brigades, chiefs of the brigades, deputy chiefs of the brigades, chiefs of the detachments, deputy chiefs of the detachments, chiefs of the lochuses, deputy chiefs of the lochuses.
The dispatched offices and internal law enforcement service institutions of the public security organ of a local people's government at the county level or above, or the public security bureau of a municipality not divided into districts, that of a county or an autonomous county may, when required by its work, establish the police officer positions such as political commissars in charge of political affairs, teachers, and political instructors, etc.
| | 第十一条 公安机关履行警务指挥职责的人民警察实行警官职务序列。
公安机关领导成员和内设综合管理机构警官职务由高至低为：省部级正职、省部级副职、厅局级正职、厅局级副职、县处级正职、县处级副职、乡科级正职、乡科级副职。
公安机关内设执法勤务机构警官职务由高至低为：总队长、副总队长、支队长、副支队长、大队长、副大队长、中队长、副中队长。
县级以上地方人民政府公安机关派出机构、内设执法勤务机构和不设区的市、县、自治县公安局根据工作需要，可以设置主管政治工作的政治委员、教导员、指导员等警官职务。

Article 12 The people's policemen of a public security organ who perform police duties shall be in the class of constable positions.
The constable positions of a public security organ and its internal comprehensive management institution shall, from high to low, be as follows: inspectors, deputy inspectors, researchers, deputy researchers, division directors, deputy division director, division personnel and clerks.
The constable positions of the internal law enforcement service institution of a public security organ shall, from high to low, be as follows: first-grade sergeant, second-grade sergeant, third-grade sergeant, fourth-grade sergeant, first-grade constable, second-grade constable, third-grade constable.
| | 第十二条 公安机关履行警务执行职责的人民警察实行警员职务序列。
公安机关及其内设综合管理机构警员职务由高至低为：巡视员、副巡视员、调研员、副调研员、主任科员、副主任科员、科员、办事员。
公安机关内设执法勤务机构警员职务由高至低为：一级警长、二级警长、三级警长、四级警长、一级警员、二级警员、三级警员。

Article 13 The people's policemen of a public security organ who engage in police technical work shall be in the class of police technical positions.
The establishment of police technical positions shall comply with the provisions of the state.
| | 第十三条 公安机关从事警务技术工作的人民警察实行警务技术职务序列。
警务技术职务的设置，按照国家规定执行。

Article 14 The rank of a people's policeman of a public security organ shall be determined on the basis of the position he holds, his behaviors on virtue and capability, his work performance and his seniority.
