Notice of the General Office of the State Council on the Work of Clearing Off Administrative Regulations and Rules
(No.12 [2007] of the General Office of the State Council)
The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government, all ministries and commissions of and departments directly under the State Council:
In order to better adapt to the requirements of accelerating the construction of a government under the rule of law and comprehensively promote the administration according to law, the State Council has decided to conduct a comprehensive clearing of the current administrative regulations and rules. Upon the consent of the State Council, we hereby notify the relevant issues as follows:

各省、自治区、直辖市人民政府，国务院各部委、各直属机构：
为了更好地适应加快建设法治政府、全面推进依法行政的要求，国务院决定对现行行政法规、规章进行一次全面清理。经国务院同意，现就有关事项通知如下：

1. Clearing scope
| | 一、清理范围
|
(1) Current administrative regulations;
| | （一）现行行政法规；
|
(2) Current rules formulated by the departments of the State Council;
| | （二）国务院各部门制定的现行规章；
|
(3) Current rules formulated by the people's governments of the provinces, autonomous regions, municipalities directly under the Central Government and the relatively large cities.
| | （三）省、自治区、直辖市和较大的市的人民政府制定的现行规章。

2. Clearing principles
The people's government of a province, autonomous region, municipality directly under the Central Government, relatively large city or a department of the State Council shall be responsible for clearing off the rules it has formulated, and handle them in accordance with the following principles:

各省、自治区、直辖市和较大的市的人民政府，国务院各部门分别负责清理本级人民政府、本部门制定的规章，并按照以下原则处理：

(1) Where the main content of the rules conflicts with any law or administrative regulation or the rules have been replaced by a new law or administrative regulation, these rules shall be abolished.
