The Administrative Measures for the Registration of Individual Industrial and Commercial Households were adopted at the executive meeting of the the State Administration for Industry and Commerce, are hereby promulgated and shall come into force on November 1, 2011.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 These Measures are formulated pursuant to the Regulation on Individual Industrial and Commercial Households to protect the legal rights and interests of individual industrial and commercial households, encourage, support and guide their healthy development, and regulate the administration of the registration of individual industrial and commercial households.
| | 第一条 为保护个体工商户合法权益，鼓励、支持和引导个体工商户健康发展，规范个体工商户登记管理行为，依据《个体工商户条例》，制定本办法。

Article 2 Citizens with operation capacity may legally conduct business operations after being registered at the administrative departments of industry and commerce and obtaining the business licenses for individual industrial and commercial households.
| | 第二条 有经营能力的公民经工商行政管理部门登记，领取个体工商户营业执照，依法开展经营活动。

Article 3 The business-opening registration, modification registration and deregistration of individual industrial and commercial households shall be governed by the Regulation on Individual Industrial and Commercial Households and these Measures.
Applicants for registration as individual industrial and commercial households shall undertake the authenticity of the application materials.
| | 第三条 个体工商户的开业、变更和注销登记应当依照《个体工商户条例》和本办法办理。
申请办理个体工商户登记，申请人应当对申请材料的真实性负责。

Article 4 The administrative departments of industry and commerce are competent authorities in charge of the registration of individual industrial and commercial households.
The State Administration for Industry and Commerce (“SAIC”) is in charge of the administration of the nationwide registration of individual industrial and commercial households.
The administrative departments of industry and commerce of provinces, autonomous regions and municipalities directly under the Central Government, as well as cities divided into districts (prefectures), are in charge of the administration of the registration of individual industrial and commercial households within their respective jurisdictions.
The administrative departments of industry and commerce of counties, autonomous counties and cities not divided into districts, as well as the branches thereof in municipal districts, are the registration organs of individual industrial and commercial households (hereinafter referred to as “registration organs”) in charge of the registration of individual industrial and commercial households within their respective jurisdictions.
| | 第四条 工商行政管理部门是个体工商户的登记管理机关。
国家工商行政管理总局主管全国的个体工商户登记管理工作。
省、自治区、直辖市工商行政管理局和设区的市（地区）工商行政管理局负责本辖区的个体工商户登记管理工作。
县、自治县、不设区的市工商行政管理局以及市辖区工商行政管理分局为个体工商户的登记机关（以下简称登记机关），负责本辖区内的个体工商户登记。

Article 5 Registration organs may authorize their subordinate administrative offices of industry and commerce to handle the registration of individual industrial and commercial households.
| | 第五条 登记机关可以委托其下属工商行政管理所（以下简称工商所）办理个体工商户登记。

Chapter II Registered Matters

Article 6 Matters to be registered in relation to an individual industrial and commercial household include:
| | 第六条 个体工商户的登记事项包括：

1. Name and domicile of the business operator;
| | （一）经营者姓名和住所；
|
2. Form of organization;
| | （二）组成形式；
|
3. Scope of business; and
| | （三）经营范围；
|
4. Place of business.
The name of the individual industrial and commercial household, if any, shall also be registered.
| | （四）经营场所。
个体工商户使用名称的，名称作为登记事项。

Article 7 Name and domicile of a business operator means the name of the citizen applying for registration as an individual industrial and commercial household and the detailed address of the place of his/her registered permanent residence.
| | 第七条 经营者姓名和住所，是指申请登记为个体工商户的公民姓名及其户籍所在地的详细住址。

Article 8 Forms of organization includes individual operation and household operation.
For household operation, the name of family members involved in operation shall also be registered.
| | 第八条 组成形式，包括个人经营和家庭经营。
家庭经营的，参加经营的家庭成员姓名应当同时备案。

Article 9 Scope of business means the sector to which the business operations of an individual industrial and commercial household belong.
Registration organs shall, based on applicants' applications, register the scope of business of individual industrial and commercial households under the guidance of the Industry Classification for National Economic Activities.
| | 第九条 经营范围，是指个体工商户开展经营活动所属的行业类别。
登记机关根据申请人申请，参照《国民经济行业分类》中的类别标准，登记个体工商户的经营范围。

Article 10 Place of business means the detailed address of the place of business of an individual industrial and commercial household.
Each individual industrial and commercial household can only have one place of business registered at the registration organ.
| | 第十条 经营场所，是指个体工商户营业所在地的详细地址。
个体工商户经登记机关登记的经营场所只能为一处。

Article 11 To apply for the use of a name, an individual industrial and commercial household shall follow the Administrative Measures for the Name Registration of Individual Industrial and Commercial Households.
| | 第十一条 个体工商户申请使用名称的，应当按照《个体工商户名称登记管理办法》办理。
|
Chapter III Application for Registration
| | 第三章 登记申请
|
Article 12 For individual operation, the applicant shall be the business operator; for household operation, the applicant shall be the presiding business operator of all family members.
To apply for business-opening registration, modification registration or deregistration by agency, an agent is required to submit a power of attorney issued by the applicant and the identity certificate or eligibility certificate of the agent.
| | 第十二条 个人经营的，以经营者本人为申请人；家庭经营的，以家庭成员中主持经营者为申请人。
委托代理人申请开业、变更、注销登记的，应当提交申请人的委托书和代理人的身份证明或者资格证明。

Article 13 An applicant or the agent thereof may directly apply for registration as an individual industrial and commercial household at the registration organ at the place of business, or at the administrative office of industry and commerce at the place of business if the registration organ has authorized the administrative office of industry and commerce to handle the registration of individual industrial and commercial households.
An applicant or the agent thereof may apply to the registration organ at the place of business by mail, fax, electronic data interchange or e-mail. In the case of fax, electronic data interchange or e-mail, the contact information and mail address of the applicant or the agent thereof shall be provided. After the application is accepted by the registration organ, the applicant shall submit original materials bearing the same contents as those in the fax, electronic data interchange or e-mail within 5 days after receiving the notice of acceptance.
| | 第十三条 申请个体工商户登记，申请人或者其委托的代理人可以直接到经营场所所在地登记机关登记；登记机关委托其下属工商所办理个体工商户登记的，到经营场所所在地工商所登记。
申请人或者其委托的代理人可以通过邮寄、传真、电子数据交换、电子邮件等方式向经营场所所在地登记机关提交申请。通过传真、电子数据交换、电子邮件等方式提交申请的，应当提供申请人或者其代理人的联络方式及通讯地址。对登记机关予以受理的申请，申请人应当自收到受理通知书之日起5日内，提交与传真、电子数据交换、电子邮件内容一致的申请材料原件。

Article 14 To apply for business-opening registration of an individual industrial and commercial household, the applicant is required to submit:
| | 第十四条 申请个体工商户开业登记，应当提交下列文件：

1. An application for business-opening registration of an individual industrial and commercial household as signed by the applicant;
| | （一）申请人签署的个体工商户开业登记申请书；
|
2. The identity certificate of the applicant;
| | （二）申请人身份证明；
|
3. A certificate on the place of business; and
| | （三）经营场所证明；
|
4. Other documents as set forth by the SAIC.
