The Supreme People's Court (SPC), the Supreme People's Procuratorate (SPP), and the Ministry of Public Security issued the Opinions on Issues concerning the Application of Law in the Handling of Telecom and Internet Fraud Cases.
With 36 articles in seven parts, the Opinions specify that the conviction and sentencing of telecom and Internet fraud crimes may be based on the money stolen by the offenders or the number of actual fraud calls and fraud messages sent. Sending more than 5,000 fraud messages or making more than 500 fraud calls should be determined as “other serious circumstances” and punished for the crime of attempted fraud.
