CAC: Operators with Information of over a Million Users Should File an Application before Listing Abroad

On July 10, 2021, the Cyberspace Administration of China (CAC) issued the Measures for Cybersecurity Review (Revision Draft for Comments) to solicit public opinions, and comments may be submitted until July 25, 2021. According to Article 6 of the Measures, operators who possess personal information of over a million users must apply to the Cybersecurity Review Office for cybersecurity reviews before listing abroad. Besides, where any activities affect or may endanger national security during the purchase of network products and services by key information infrastructure operators or the data processing by data workers, cybersecurity reviews should be conducted in accordance with these Measures. The priority of cybersecurity reviews is to assess national security risks likely to be brought about by procurement activities, data processing activities and companies listing abroad. Seven factors should be taken into consideration, mainly including the risks of key information infrastructures illegally controlled and undergoing interference or damage after the use of certain products and services, and the detriment to the continuity of key information infrastructure operations caused by discontinuance of products and services supply, among others.
