Recently, the Legislative Affairs Office of the State Council issued the Interim Regulation on Procedures for Major Administrative Decision-Making (Consultation Paper). With a total of 44 articles in ten chapters, in addition to general provisions, decision-making motions, execution of decisions, legal liability and supplemental provisions, the Consultation Paper provides for public participation, expert discussion, risk assessment, legal review and collective discussion and decision in separate chapters. According to the Consultation Paper, except for those which should be kept confidential according to the law, to make decisions concerning the public interest or having a material effect on the rights and obligations of the public, public comments should be comprehensively requested. Collective discussion and decision is a necessary decision-making process, and the accountability system of administrative heads should be adhered to. If decisions of a strong professional or technical nature need expert discussion, expert discussion should be organized to prove such decisions to be necessary, feasible and rational. If the implementation of major administrative decisions is likely to exert an adverse effect on the environment and social stability, among others, risk assessment should be carried out. Legal review is also a necessary decision-making process. If a decision has not gone through the legal review or fails the review, it should not be presented to the decision-making body for discussion.
