SPC Repeals a Group of Judicial Interpretations on Administrative Litigation

Recently, the Supreme People's Court (SPC) issued the Decision to Repeal Certain Judicial Interpretations and Documents with the Force of Judicial Interpretations (12th Group), repealing fifteen judicial interpretations and documents with the force of judicial interpretations on administrative litigation, including the Reply of the Supreme People's Court regarding Issues on the Jurisdiction over Drug Administrative Cases. According to the Decision, these judicial interpretations and documents with the force of judicial interpretations will no longer be applicable as of October 1, 2017, but judgments and rulings previously made according to or by referring to these judicial interpretations and documents will remain effective.Where, against an administrative action taken before the Decision is issued, a party brings an administrative lawsuit or a retrial is initiated, unless the relevant judicial interpretations and documents with the force of judicial interpretations are in conflict with the laws currently in force, the people's court may adjudicate the case according to the relevant judicial interpretations and documents with the force of judicial interpretations.
