The Regulation on the Administration of Recall of Defective Auto Products, as adopted at the 219th executive meeting of the State Council on October 10, 2012, is hereby issued and shall come into force on January 1, 2013.

Article 1 In order to regulate the recall of defective auto products, strengthen supervision and administration and protect personal and property safety, this Regulation is formulated.
| | 第一條 為了規範缺陷汽車產品召回，加強監督管理，保障人身、財產安全，制定本條例。
|
Article 2 This Regulation shall apply to the recall of autos and auto trailers (hereinafter collectively referred to as the “auto products”) which are manufactured and sold within the territory of China and the supervision and administration thereof.
| | 第二條 在中國境內生產、銷售的汽車和汽車掛車（以下統稱汽車產品）的召回及其監督管理，適用本條例。

Article 3 For the purposes of this Regulation, “defects” means non-compliances with state standards or industrial standards regarding protection of personal or property safety or any other unreasonable risks to personal or property safety which exist generally in the same lot, model or type of auto products for design, manufacturing, labeling and other reasons.
For the purposes of this Regulation, “recall” means that auto product manufacturers take measures to eliminate the defects in auto products already sold by them.
| | 第三條 本條例所稱缺陷，是指由于設計、制造、標識等原因導致的在同一批次、型號或者類別的汽車產品中普遍存在的不符合保障人身、財產安全的國家標准、行業標准的情形或者其他危及人身、財產安全的不合理的危險。
本條例所稱召回，是指汽車產品生產者對其已售出的汽車產品采取措施消除缺陷的活動。

Article 4 The product quality supervision department of the State Council shall be responsible for the national supervision and administration of the recall of defective auto products.
Relevant departments of the State Council shall be responsible for the relevant supervision and administration of the recall of defective auto products within their respective functions.
| | 第四條 國務院產品質量監督部門負責全國缺陷汽車產品召回的監督管理工作。
國務院有關部門在各自職責範圍內負責缺陷汽車產品召回的相關監督管理工作。

Article 5 The product quality supervision department of the State Council may, as needed for work, entrust part of the supervision and administration of recall of defective auto products to the quality supervision departments and import and export commodity inspection agencies of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
The defective products recall technical agency of the product quality supervision department of the State Council shall, in accordance with the provisions issued by the product quality supervision department of the State Council, assume the specific technical work on the recall of defective auto products.
| | 第五條 國務院產品質量監督部門根據工作需要，可以委托省、自治區、直轄市人民政府產品質量監督部門、進出口商品檢驗機構負責缺陷汽車產品召回監督管理的部分工作。
國務院產品質量監督部門缺陷產品召回技術機構按照國務院產品質量監督部門的規定，承擔缺陷汽車產品召回的具體技術工作。

Article 6 Any entity or individual shall have the right to file complaints on possible defects in auto products with product quality supervision departments, and the product quality supervision department of the State Council shall publish the telephone number, e-mail address and mailing address for receiving complaints in a manner facilitating public access.
The product quality supervision department of the State Council shall establish a recall information management system for defective auto products to collect, organize, analyze and process information on defective auto products.
Product quality supervision departments, competent auto product departments, competent commerce departments, customs, traffic administrative departments of public security authorities, competent transportation departments, administrative departments for industry and commerce and other relevant departments shall establish a mechanism for sharing information on the manufacture, sale, import, registration, inspection, maintenance, consumer complaints and recall, among others, of auto products.
| | 第六條 任何單位和個人有權向產品質量監督部門投訴汽車產品可能存在的缺陷，國務院產品質量監督部門應當以便于公眾知曉的方式向社會公布受理投訴的電話、電子郵箱和通信地址。
國務院產品質量監督部門應當建立缺陷汽車產品召回信息管理系統，收集彙總、分析處理有關缺陷汽車產品信息。
產品質量監督部門、汽車產品主管部門、商務主管部門、海關、公安機關交通管理部門、交通運輸主管部門、工商行政管理部門等有關部門應當建立汽車產品的生產、銷售、進口、登記檢驗、維修、消費者投訴、召回等信息的共享機制。

Article 7 Product quality supervision departments, relevant departments and agencies, and their staff members shall not divulge any trade secrets and personal information known by them in the performance of duties prescribed in this Regulation.
| | 第七條 產品質量監督部門和有關部門、機構及其工作人員對履行本條例規定職責所知悉的商業秘密和個人信息，不得泄露。

Article 8 A manufacturer shall recall all of its defective auto products in accordance with this Regulation; and if a manufacturer fails to implement a recall, the product quality supervision department of the State Council shall order the manufacturer to implement a recall in accordance with this Regulation.
For the purposes of this Regulation, “manufacturer” means an enterprise legally established within the territory of China, which manufactures auto products and in whose name a certificate of product inspection is issued.
An enterprise which imports auto products from outside the territory of China to sell within the territory of China shall be deemed a manufacturer as mentioned in the preceding paragraph.
| | 第八條 對缺陷汽車產品，生產者應當依照本條例全部召回；生產者未實施召回的，國務院產品質量監督部門應當依照本條例責令其召回。
本條例所稱生產者，是指在中國境內依法設立的生產汽車產品並以其名義頒發產品合格證的企業。
從中國境外進口汽車產品到境內銷售的企業，視為前款所稱的生產者。

Article 9 Manufacturers shall establish and preserve records of information on the design, manufacturing, labeling and inspection, among others, of auto products, as well as records on initial purchasers of auto products for a period of not less than 10 years.
| | 第九條 生產者應當建立並保存汽車產品設計、制造、標識、檢驗等方面的信息記錄以及汽車產品初次銷售的車主信息記錄，保存期不得少于10年。

Article 10 A manufacturer shall file the following information with the product quality supervision department of the State Council for recordation:
| | 第十條 生產者應當將下列信息報國務院產品質量監督部門備案：

(1) Basic information on the manufacturer.
| | （一）生產者基本信息；
|
(2) Information on the technical parameters of auto products and the initial purchasers of auto products.
| | （二）汽車產品技術參數和汽車產品初次銷售的車主信息；
|
(3) Information on repair, replacement or return of auto products for malfunctions of auto products which endanger personal or property safety.
