Chapter Ⅰ General Provisions
| | 第一章 總則
|
Article 1 These Measures are enacted in accordance with Law of the People's Republic of China on Licensed Doctors (hereinafter referred to as Law on Licensed Doctors).
| | 第一條 根據《中華人民共和國執業醫師法》（以下簡稱《執業醫師法》）第十一條的規定，制定本辦法。
|
Article 2 These Measures apply to those who wish to take part in doctor qualification examination, has learned traditional medicine in the way of apprenticeship, or through years of practice in the field, has mastered specialized knowledge of this field but does not graduate from faculty of medicine, except those who have obtained medical technical posts or medical technical title in accordance with relevant State regulations before the date the Law on Licensed Doctors is promulgated.
| | 第二條 以師承方式學習傳統醫學或者經多年實踐醫術確有專長、不具備醫學專業學曆的人員，除在《執業醫師法》頒布之日前按國家有關規定取得醫學專業技術職稱和醫學專業技術職務者外，參加醫師資格考試，適用本辦法。

Article 3 Traditional medicine stated in these Measures refers to traditional Chinese medicine and ethnic medicines.
| | 第三條 本辦法所稱“傳統醫學”是指中醫學和少數民族醫學。

Chapter Ⅱ Assessment
| | 第二章 考核
|
Article 4 Assessment is qualification assessment and accreditation, organized by the administrative department for traditional Chinese medicine at the provincial level and implemented by all assessment agencies, of apprentices and masters of traditional medicine who apply to take part in the doctor qualification examination.
| | 第四條 考核是對傳統醫學師承和確有專長人員申請參加醫師資格考試的資格評價和認定，由省級中醫（藥）主管部門組織，各考核機構具體實施。

Article 5 Assessment of apprentices and masters of traditional medicine consists of the assessments on their qualification in taking examinations in licensed doctor and licensed assistant doctor qualification.
| | 第五條 傳統醫學師承和確有專長人員的考核分執業醫師資格考試資格考核和執業助理醫師資格考試資格考核。

Article 6 Apprentices of traditional medicine who have obtained doctor's license approved by the administrative department of traditional Chinese medicine at or above the county level before the date the Law on Licensed Doctors is promulgated shall apply directly for qualification assessment for licensed doctor qualification examination and licensed assistant doctor qualification examination. The rest of apprentices of traditional medicine shall meet the following requirements at the same time in applying for qualification assessment.
| | 第六條 在《執業醫師法》頒布之日前已經縣級以上中醫（藥）主管部門批准取得有效行醫資格的師承人員，可直接申請執業醫師資格或執業助理醫師資格考試的資格考核。其余師承人員申請執業醫師資格考試資格考核的，應同時具備下列條件：

(1) having reached the level of a graduate from senior high school or equal education;
| | （一）高中以上文化程度或具有同等學曆。
|
(2) having obtained apprenticeship contract approved by the administrative department for traditional Chinese medicine at the provincial level and studied as an apprentice for three years. The tutor shall have obtained senior medical technical title and conducted clinical practice for at least twenty years; the tutor shall have rich and special academic experience and technical specialty, high professional ethics, good reputation among the public and be accredited by peers; the tutor shall be employed in medical institutions for clinical practice at the same of teaching; the tutor shall have only not more than two apprentices at the same time within the same period of time.
| | （二）具有經省級中醫（藥）主管部門批准的師承關系合同，連續跟師學習滿三年；指導老師具有醫學專業高級技術職務任職資格，並從事臨床工作二十年以上；有豐富、獨特的學術經驗的技術專長，醫德高尚，在群眾中享有盛譽，得到同行公認；應聘在醫療機構堅持臨床實踐，能夠完成繼承教學任務；同一指導老師在同一時期內帶教學生不得超過兩名。

(3) having obtained the certificate for completion of apprenticeship approved by the administrative department for traditional Chinese medicine at the provincial level. and
| | （三）取得省級中醫（藥）主管部門頒發的《出師合格證書》。
|
(4) having worked on probation, under the supervision of a licensed doctor, for at least two years in medical institutions.
Apprentices applying for qualification assessment for licensed assistant doctor qualification examination shall have worked on probation, under the supervision of a licensed doctor, for at least one year in medical institutions besides meeting the requirements in the above three items from item 1 to item 3.
| | （四）在執業醫師指導下，在醫療機構中試用期滿二年的。
申請執業助理醫師資格考試資格考核的，除具備上款（一）至（三）項條件外，還應當在執業醫師指導下，在醫療機構中試用期滿一年。

Article 7 Masters of traditional medicine applying for qualification assessment shall meet one of the following requirements:
| | 第七條 申請考核確有專長人員的，應具備下列條件之一：
|
(1) having been accredited as masters of traditional medicine by the administrative department of traditional Chinese medicine at the municipal level before the date the Law on Licensed Doctors is promulgated, and obtained doctor's license approved by the administrative department of traditional Chinese medicine at or above the county level; or
| | （一）《執業醫師法》頒布之日前經地級以上中醫（藥）主管部門審定為確有專長，並經縣級以上中醫（藥）主管部門批准取得有效行醫資格的；
|
(2) having practiced as rural doctors for more than ten years and been accredited as masters of traditional medicine by the administrative department of traditional Chinese medicine at the provincial level.
| | （二）從事鄉村醫生工作十年以上，並經省級中醫（藥）主管部門確認醫術有專長的。
|
Article 8 The assessment subjects for apprentices and masters of traditional medicine include professional ethics and proficiency, etc.
The key assessment subject of professional proficiency for apprentices is inheritance of academic experience and technical specialty and that for masters is their distinguished specialty that approves to be more effective than treatment methods of the same kind of diseases.
| | 第八條 傳統醫學師承和確有專長人員的考核內容包括職業道德、業務水平等。
業務水平考核中，師承人員的重點是學習學術經驗和技術專長情況；確有專長人員的重點是是否具備獨特專長，療效是否明顯優于同種或同類病症的其它治療方法。

Article 9 The assessment methods include self-introduction, oral examination, written examination, clinical practice and medical writing, etc.
The assessment criteria and detailed assessment methods shall be formulated in accordance with Article 9 and Article 8 of these Measures and with reference to Article 9 and 10 of Law on Licensed Doctors.
．．．．．． | | 第九條 考核的方式可以包括：個人述職、口試、筆試、實際操作、對其本人書寫醫學文書的檢查等。
考核標准及具體考核辦法由省級中醫（藥）主管部門參照《執業醫師法》第九條、第十條的有關規定，按照本辦法第八條及本條前款的要求統一制訂。
