The court has constituted a collegial bench to hear the case and now concluded it. It was found out in the first instance trial that on Jan.16th, 1998, Local and Livestock Product Company signed a contract of trade with Anderley (Singapore) Private Co. Ltd. (Hereinafter referred to as Anderley Company), in which Anderley Company supplied to Local and Livestock Product Company 50,000 tons of US soybean meal in bulk, with 10% fluctuation and 44.0% protein, at the price of C&F to Chinese port, $265 per ton. On March 23rd, 1998, the two parties modified the terms of the contract, and reached a complementary agreement, in which the price condition was CIF to Chinese port, $255.50 per ton. If the content of protein is below 44% but over 43%, as demonstrated by FGIS certificate, the seller shall compensate 5 dollars per ton to the buyer as to all of the goods. On March 30th, 1998, Anderley Company issued an invoice to Local and Livestock Product Company, on which the following was recorded: the 51,064.887 tons of US soybean meal in bulk, CIF to Huangpu, China, $255.50 per ton, and the total price of $13,047,078.63, over 44.05% of protein content. On Jan.28th, 1998, Mondo Company, as the owner of Patmos Ship, signed a charter party with Bermude Glango Cereal Co. Ltd., as the charterer, in which the discharging rate was agreed on at 3,000 tons per day, counted as 24 hours every sunny workday. On March 21st, 1998, Fillette Green Shipping Services Inc, as captain of Patmos Ship, issued a memorandum B/L. It was noted that the 51,064.887 tons of US soybean meal in bulk were loaded on Patmos Ship clean, the port of loading was Destrehen Port, Louisana, US, and the notifying party was Local and Livestock Product Company. After Patmos Ship arrived at Huangpu Port, the goods began to be unloaded at the anchorage of Dayushan on April 29th, 1998, and then continued to be discharged at Huangpu New Port of Guangzhou on April 30th. On April 29th, 1998, authorized by Local and Livestock Product Company, Guangdong Commodity Inspection Company began to examine the 34,899.887 tons of goods (according to the shipping bill) discharged from the No.1, 2, 3, 5, 6, 8 cargo holds of Patmos Ship. And it issued on June 11th the result of the commodity inspection in GD98/108A report as followed. The appearance of the commodity was abnormal. There were black slices, gray and black particles, white round particles and powders. The condition of the goods in No.4 and 7 holds were even worse. The protein content of the mixed goods in No.3, 4, 5, 6, 7, 8 holds is 43.61%. On the same day, the result in the GD98/108C inspection report was as followed. During the discharge, the inspector found that there were white and pale round contaminants, black chip contaminants, or dust color and brown column-like ones. These contaminants were especially evident with the goods in No.4 and 7 holds. In view of the bad condition, the consignee unilaterally stopped the discharge from 01:30 of May 6th, 1998 to 16:40 of May 7th, 1998. By then, 13,997 tons of goods had been discharged from the ship, among which 2,737 tons from No.4 hold and 1,817 tons from No.7 hold. The cargos in No.4 hold were discharged in the same line with that in No.3 and 5 holds; and the cargos in No.7 hold with that in No. 6 and 8 holds. According to the load chart provided by the owner of the ship, there were 8,452 tons of goods in No. 4 hold and 7,713 tons in No.7 hold. At 16:40 of May 7th, 1998, the consignee agreed on the resumption of discharge. In the process of discharge, contaminants were still found in the cargos, especially in the No. 4 and 7 holds. And a 10-cm thick layer of white powders were discovered at the bottom of the No.7 hold. Therefore, at 15:30 of May 12th, 1998, the consignee asked immediately to stop discharging cargos from No. 4 and 7 holds. By then, 6,252 tons of goods had been discharged from No.4 hold and 6,853 tons from No.7 hold, altogether 2,600 tons remained in the two holds. By 15:30 of May 14th, 1998, the discharge of goods in all other compartments had finished. According to statistics, about 4,635 tons of goods in No.4 hold were discharged separately, that is, not mixed with that in No.3 and 5 holds. And about 6,954 tons of goods were mixed. In the meanwhile, about 2,173 tons of goods in No.7 hold were discharged separately, and about 11,276 tons were mixed with that in No.6 and 8 holds. Then one sample (Sample No.1) was taken from the funnel filled with mixture of cargos in No.4 and 7 hold, and another sample (Sample No.2) was taken from the holds. In accordance with the result of inspection, Sample No. 1 contained 42.80% of protein, 3.23% of white and grey round corns, 0.94% of black slice bean navels, 0.78% of dust color and brown column-like or block of bean skins, and Sample No.2 contained 41.95% of protein, 5.19% of white and grey round corns, and 0.94% of black slice bean navels. Then Sample No.2 was sifted out through 20-mesh sifter and the screenings were inspected. The result was as followed. The screenings occupied 14.52% of the total sample, containing 39.505 of protein. Sample B contained 18.83% of contaminants and 38.46% of protein. The result of the inspection was as followed. The goods on the ship were abnormal, because they contained white, dust color and black contaminants, which could be seen easily by eyes. Particularly in No.4 and 7 holds, the proportion of the contaminants was even higher, with some location the highest. And there were a layer of white powders in No.7 hold. The above contaminants were discovered in all the cargos of the ship, the main ingredients of which were plant materials. And the contaminants had been mixed with the goods before loading. As required by Local and Livestock Product Company, Guangdong Commodity Inspection Company conducted examinations on the weight of the goods loaded in Patmos Ship from April 30th, 1998. On June 11th, it issued an inspection report of GD98/108B, with the result as followed. During discharge, the goods were packed in plastic bags, and the net weight of every bag was 50 kg. Each bag was weighed by the officially calibrated platform balances. All the goods were packed in 1,011,611 bags. After sample bags were randomly taken and weighed, it was found that the error of weight was within the permitted range. After measuring and calculation, the total weight of the goods were only 50,580.550 tons. Compared with the weight noted in the B/L, it was 484.337 tons lighter. As required by Mondo Company, Guangdong Import and Export Commodity Inspection Bureau of the People's Republic of China conducted another examination on the goods Patmos Ship from May 25th, 1998 to June 1st. On June 10th, it issued an inspection report of 440000/GD98/58018, with the result as followed. During the inspection, it was found that the smell of the goods was good, and the goods were dry in the color of pale yellow. But in the meanwhile, the goods were found to contain the following abnormal substances: lots of powders and black slices, some brown or black blocks, some white globular or block substances. The goods in No.4 and 7 holds contained more abnormal substances than others. And the abnormal substances were almost the same. The black slices were bean navels, the accompaniment of these goods.
