| Article 1 This Law is developed for purposes of promoting the development of the public library cause, fully maximizing the functions of public libraries, protecting the basic cultural rights and interests of citizens, raising the scientific and cultural qualifications of citizens and the degree of social civilization, carrying forward human civilization, and building stronger cultural confidence. | | 第一條 為了促進公共圖書館事業發展，發揮公共圖書館功能，保障公民基本文化權益，提高公民科學文化素質和社會文明程度，傳承人類文明，堅定文化自信，制定本法。 |
| Article 2 For the purpose of this Law, “public libraries” means the public cultural facilities that are open to the public free of charge, that collect, review and preserve literature information, that provide searching, lending and relevant services, and that conduct social education. | | 第二條 本法所稱公共圖書館，是指向社會公眾免費開放，收集、整理、保存文獻信息並提供查詢、借閱及相關服務，開展社會教育的公共文化設施。 |
| For the purpose of the preceding paragraph, literature information includes books, newspapers, periodicals, audio and video recordings, miniature products and digital resources, among others. | | 前款規定的文獻信息包括圖書報刊、音像制品、縮微制品、數字資源等。 |
| Article 3 As an important part of the socialist public cultural service system, public libraries shall regard promoting, directing and serving nationwide reading as an important task. | | 第三條 公共圖書館是社會主義公共文化服務體系的重要組成部分，應當將推動、引導、服務全民閱讀作為重要任務。 |
| Public libraries shall stick to the advancement direction of advanced socialist culture, the people-centered approach, and the guidance of the socialist core values, inherit and develop the excellent traditional Chinese culture, inherit the revolutionary culture and develop the advanced socialist culture. | | 公共圖書館應當堅持社會主義先進文化前進方向，堅持以人民為中心，堅持以社會主義核心價值觀為引領，傳承發展中華優秀傳統文化，繼承革命文化，發展社會主義先進文化。 |
| Article 4 The people's governments at or above the county level shall incorporate public library cause into the national economic and social development plans at the same level, incorporate the construction of public libraries into the overall plan for urban and rural planning and land utilization, increase investment in the public libraries formed by the governments, include the expenses required in the government budgets at the same level, and make timely payment in full. | | 第四條 縣級以上人民政府應當將公共圖書館事業納入本級國民經濟和社會發展規劃，將公共圖書館建設納入城鄉規劃和土地利用總體規劃，加大對政府設立的公共圖書館的投入，將所需經費列入本級政府預算，並及時、足額撥付。 |
| The state shall encourage citizens, legal persons and other organizations to form public libraries with self-raised funds. The people's governments at or above the county level shall actively mobilize social forces to participate in the construction of public libraries and grant them policy support in accordance with the relevant provisions issued by the state. | | 國家鼓勵公民、法人和其他組織自籌資金設立公共圖書館。縣級以上人民政府應當積極調動社會力量參與公共圖書館建設，並按照國家有關規定給予政策扶持。 |
| Article 5 The culture administrative department of the State Council shall be responsible for the administration of the public libraries across the country. Other relevant departments of the State Council shall, within the scope of their respective functions, be responsible for the work related to the administration of public libraries. | | 第五條 國務院文化主管部門負責全國公共圖書館的管理工作。國務院其他有關部門在各自職責範圍內負責與公共圖書館管理有關的工作。 |
| The culture administrative departments of the local people's governments at and above the county level shall be responsible for the administration of the public libraries in their respective administrative areas. Other relevant departments of the local people's government at or above the county level shall be responsible for the work related to the administration of public libraries in their respective administrative areas within the scope of their respective functions. | | 縣級以上地方人民政府文化主管部門負責本行政區域內公共圖書館的管理工作。縣級以上地方人民政府其他有關部門在各自職責範圍內負責本行政區域內與公共圖書館管理有關的工作。 |
| Article 6 The state shall encourage citizens, legal persons and other organizations to grant donation to public libraries according to the law and grant tax preference thereto according to the law. | | 第六條 國家鼓勵公民、法人和其他組織依法向公共圖書館捐贈，並依法給予稅收優惠。 |
| Overseas natural persons, legal persons and other organizations may, according to the provisions of the relevant laws and administrative regulations, participate in the construction of public libraries within the territory of China through donations. | | 境外自然人、法人和其他組織可以依照有關法律、行政法規的規定，通過捐贈方式參與境內公共圖書館建設。 |
| Article 7 The state shall support the development of the public library course in the old revolutionary base areas, ethnic areas, border areas and poverty-stricken areas. | | 第七條 國家扶持革命老區、民族地區、邊疆地區和貧困地區公共圖書館事業的發展。 |
| Article 8 The state shall encourage and support maximizing of the role of science and technology in the construction, management and service of public libraries, promote the use of modern information and communication technologies, and improve the service performance of public libraries. | | 第八條 國家鼓勵和支持發揮科技在公共圖書館建設、管理和服務中的作用，推動運用現代信息技術和傳播技術，提高公共圖書館的服務效能。 |
| Article 9 The state shall encourage and support the international exchanges and cooperation in the field of public libraries. | | 第九條 國家鼓勵和支持在公共圖書館領域開展國際交流與合作。 |
| Article 10 Public libraries shall comply with the laws and administrative regulations on the protection of intellectual property rights, and protect and use the literature and information according to the law. | | 第十條 公共圖書館應當遵守有關知識產權保護的法律、行政法規規定，依法保護和使用文獻信息。 |
| For literature and information collected by libraries, which are cultural relics, archives or state secrets, public libraries shall comply with the laws and administrative regulations concerning the protection of relevant cultural relics, the management of archives or the keeping of state secrets. | | 館藏文獻信息屬于文物、檔案或者國家秘密的，公共圖書館應當遵守有關文物保護、檔案管理或者保守國家秘密的法律、行政法規規定。 |
| Article 11 The public library industry organizations shall develop the industry standards according to the law, strengthen industry self-regulation, protect the lawful rights and interests of members, and urge members to improve the service quality and offer guidance to them. | | 第十一條 公共圖書館行業組織應當依法制定行業規範，加強行業自律，維護會員合法權益，指導、督促會員提高服務質量。 |
| Article 12 Organizations and individuals that have made outstanding contributions in the development of public library course shall be commended and rewarded in accordance with the relevant provisions issued by the state. | | 第十二條 對在公共圖書館事業發展中作出突出貢獻的組織和個人，按照國家有關規定給予表彰和獎勵。 |

| Article 13 The state shall establish a convenient and practical public library service network covering urban and rural areas. Government domination shall be insisted on and the public shall be encouraged to participate in the construction of the public library service network. | | 第十三條 國家建立覆蓋城鄉、便捷實用的公共圖書館服務網絡。公共圖書館服務網絡建設堅持政府主導，鼓勵社會參與。 |
| Local people's governments at or above the county level shall determine the number, size, structure and layout of public libraries according to the population size, population distribution, environment and traffic conditions and other factors within their respective administrative regions, determine the quantity, scale, structure and layout of public libraries according to the local conditions, and strengthen the construction of fixed library premises, mobile service facilities and self-service facilities. | | 縣級以上地方人民政府應當根據本行政區域內人口數量、人口分布、環境和交通條件等因素，因地制宜確定公共圖書館的數量、規模、結構和分布，加強固定館舍和流動服務設施、自助服務設施建設。 |
| Article 14 The people's governments at or above the county level shall form public libraries. | | 第十四條 縣級以上人民政府應當設立公共圖書館。 |
| The local people's governments shall fully utilize the comprehensive service facilities of towns (streets) and villages (communities) to form libraries and serve urban and rural residents. | | 地方人民政府應當充分利用鄉鎮（街道）和村（社區）的綜合服務設施設立圖書室，服務城鄉居民。 |
| Article 15 To form a public library, an entity shall meet the following conditions: | | 第十五條 設立公共圖書館應當具備下列條件： |
| (1) It has the bylaws. | | （一）章程； |
| (2) It has a fixed site. | | （二）固定的館址； |
| (3) It has the site area, reading seats, literature and information, facilities and equipment that adapt to its functions. | | （三）與其功能相適應的館舍面積、閱覽座席、文獻信息和設施設備； |
| (4) It has the staff members that adapt to its functions, collection size, etc. | | （四）與其功能、館藏規模等相適應的工作人員； |
| (5) It has the necessary funds for running a library and stable source of operating funds. | | （五）必要的辦館資金和穩定的運行經費來源； |
| (6) It has the safety guarantee facilities, systems and contingency plans. | | （六）安全保障設施、制度及應急預案。 |
| Article 16 The bylaws of a public library shall include the name, site, purpose for running a library, business scope, management system, relevant rules, termination procedures, disposal plan for the remaining property and other matters. | | 第十六條 公共圖書館章程應當包括名稱、館址、辦館宗旨、業務範圍、管理制度及有關規則、終止程序和剩余財產的處理方案等事項。 |
| Article 17 Registration formalities shall be undergone for the formation, modification and termination of a public library in accordance with the relevant provisions issued by the state. | | 第十七條 公共圖書館的設立、變更、終止應當按照國家有關規定辦理登記手續。 |
| Article 18 The culture administrative departments under the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government shall announce the names, sites, contact information, profile of literature and information collected by libraries, main service contents and methods, and other information on the public libraries within their respective administrative regions at their websites in a timely manner. | | 第十八條 省、自治區、直轄市人民政府文化主管部門應當在其網站上及時公布本行政區域內公共圖書館的名稱、館址、聯系方式、館藏文獻信息概況、主要服務內容和方式等信息。 |
