BASIC FACTS
Plaintiff: Wu Shaohui, male, 32, villager of Luxia Village, Luxia Country, Pingnan Couty, Fujian Province, dwelling in No. 48, Xinxing West Road, Luxia Village.
Wu filed an action for his dissatisfaction with the treatment as given by the Villagers' Electoral Committee (hereinafter referred to as the Committee) on his appeal regarding the voter's qualification. The People's Court of Pingnan County has, according to the special procedures for cases on the voter's qualification as prescribed in Section 2, Chapter 15 of the Civil Litigation Law of the People's Republic of China, formed a collegiate bench and heard this case. The Committee was notified to appear in court.
Wu alleged that: His permanent residency is located in Luxia and he, as a villager, resides in Luxia all the time. His right to elect has been exercised in Luxia from the very beginning. In each election of the Committee, Wu was a voter. In particular, in the Committee's 2000 election, the plaintiff was once nominated as a formal candidate for director of the Committee. However, in the Committee's 2003 election, the Committee ignored all these objective facts and refused to register Wu as a voter. After Wu filed an appeal, the Committee made a decision on not registering Wu as a voter on June 29, 2003, which seriously injured Wu's right to elect and to be elected. Wu pleaded the court to revoke the decision according to law and order the Committee to register him as a voter and pleaded, at the same time, the court to invalidate the nomination of candidates as conducted by the Committee in 2003.

吳少暉不服選民資格處理決定案

起訴人:吳少暉。
起訴人吳少暉因不服路下村村民選舉委員會對其選民資格申訴所作的處理決定,提起訴訟。福建省屏南縣人民法院依照《中華人民共和國民事訴訟法》第十五章第二節規定的選民資格案件特別程序,組成合議庭對本案進行了審理,審理時通知路下村村民選舉委員會到庭參加。
起訴人吳少暉訴稱:起訴人的戶籍在路下村,是路下村村民,並且一直在該村居住。起訴人的選舉權一直在路下村行使,該村曆屆村民委員會的換屆選舉,起訴人都是選民。特別是2000年的村民委員會換屆選舉時,起訴人還被村民提名為村民委員會主任的正式候選人。然而今年的換屆選舉,村選舉委員會卻無視這些客觀事實,不登記起訴人為選民。起訴人提出申訴後,該選舉委員會仍于2003年6月29日作出對起訴人的選民資格不予登記的處理決定,嚴重侵犯了起訴人的選舉權和被選舉權。請求人民法院依法撤銷這個決定,責令村選舉委員會登記起訴人為選民,同時請求確認路下村此次的村民委員會候選人提名無效。
屏南縣人民法院經審理查明:
起訴人吳少暉雖在路下村新興西路48號居住,但其戶籍一直落在屏南縣路下鄉中心小學。路下村曆屆村民委員會換屆選舉時,都將吳少暉登記為選民。2003年6月12日,吳少暉將戶籍從路下鄉中心小學遷入路下村,成為該村非農業戶籍的村民。
2003年,路下村村民委員會因任期屆滿,依法需進行換屆選舉,選舉日定為2003年7月12日,從6月7日起進行選民登記,起訴人吳少暉未被登記為該村選民。吳少暉向路下村村民選舉委員會提出申訴後,該委員會認為:吳少暉雖然在本村居住,但其戶籍是在選民登記日(6月7日)以後才遷入本村的,而且是本村非農業戶籍村民,在本村沒有承包土地,也不履行“三提留、五統籌”等村民應盡的義務,按照福建省民政廳下發的《村民委員會選舉規程》中關于“戶籍在本村管理的其他非農業戶籍性質人員不作選民資格登記”的規定,吳少暉不能在本村登記。此前曆屆村民委員會選舉時,雖然都將吳少暉登記為本村選民,但這都是錯誤的,應當糾正。據此,該委員會于2003年6月29日作出處理決定:對吳少暉的選民資格不予登記。吳少暉不服處理決定,遂于6月30日起訴。

屏南縣人民法院認為:
選舉權與被選舉權,是憲法規定公民享有的一項基本政治權利。1998年11月4日第九屆全國人民代表大會常務委員會第五次會議修訂通過的《中華人民共和國村民委員會組織法》第十二條規定:“年滿十八周歲的村民,不分民族、種族、性別、職業、家庭出身、宗教信仰、教育程度、財產狀況、居住期限,都有選舉權和被選舉權;但是,依照法律被剝奪政治權利的人除外。”起訴人吳少暉現年33歲,依照法律規定,其具有選民資格。
