According to the arrangements and requirements of the Opinions of the CPC Central Committee and the State Council on Supporting Shenzhen in Building a Pioneering Demonstration Zone for Socialism with Chinese Characteristics, the Implementation Plan for the Comprehensive Pilot Reform of Making Shenzhen a Pioneering Demonstration Zone for Socialism with Chinese Characteristics (2020-2025), and the Action Plan for Building a High-standard Market System, for the purposes of further supporting Shenzhen in building a pioneering demonstration zone for socialism with Chinese characteristics, accelerating the promotion of the pilot program of comprehensive reform, continuously promoting the relaxing of market access, creating a market-oriented and legalized international business environment, and leading and driving the Guangdong-Hong Kong-Macao Greater Bay Area to advance reform and opening up from a higher starting point, at a higher level and towards higher goals, the following opinions are hereby put forward with the consent of the CPC Central Committee and the State Council. 按照《中共中央、國務院關于支持深圳建設中國特色社會主義先行示範區的意見》《深圳建設中國特色社會主義先行示範區綜合改革試點實施方案(2020-2025年)》和《建設高標准市場體系行動方案》部署要求,為進一步支持深圳建設中國特色社會主義先行示範區,加快推進綜合改革試點,持續推動放寬市場准入,打造市場化法治化國際化營商環境,牽引帶動粵港澳大灣區在更高起點、更高層次、更高目標上推進改革開放,經黨中央、國務院同意,現提出意見如下。
I. Relaxing and optimizing market access in the fields of application of advanced technologies and industrial development 一、放寬和優化先進技術應用和產業發展領域市場准入
1. Innovating on the market access methods and establishing a trading platform for electronic components and integrated circuits. Shenzhen shall be supported in optimizing the layout of similar trading venues, building a market-oriented international electronic components and integrated circuits exchange, creating a new platform for enterprises of electronic components and integrated circuits and product market access, and promoting the concentrated integration and cluster development of upstream and downstream supply chains and industrial chains. Enterprises of electronic components and integrated circuits shall be supported in settling in the exchange, domestic and foreign users shall be encouraged to purchase electronic components and various specialized chips on the exchange, and integrated circuit design companies and user entities shall be supported in conducting cooperation through the exchange. World-renowned basic electronic components and chip companies and upstream and downstream enterprises (including brand owners, distributors or manufacturers) shall be actively encouraged and guided to rely on the center to carry out sale, procurement, brand display, research and development of software solutions, application design, after-sales services, and personnel training, among others. The design, research and development, manufacturing, testing and other business of electronic components shall be supported, the total costs of the supply chain shall be reduced, and the free circulation and overall management of production factors in the industry chain of electronic components shall be realized; the customs supervision and customs clearance environment shall be optimized, and under the premise of controllable risks, the coordination and utilization of customs, finance, taxation and other data shall be promoted, cross-border business shall be carried out in conjunction with customs, taxation, banks and other institutions, the exchange shall provide import and export customs declaration, and logistics and warehousing services for enterprises settled, and financial institutions shall be encouraged to cooperate with the exchange to provide financial services in the supply chain for enterprises. Market entities shall be encouraged to rely on the center to carry out procurement, a trade alliance shall be established and financial support for international trade shall be provided by the market-oriented operation method, enterprises' procurement needs for key components shall be gathered, and the overall negotiation advantages of the supply chain shall be improved through centralized procurement. The establishment of basic electronic components testing, certification and experimental platforms shall be supported, the improvement of relevant standard systems shall be accelerated for key markets such as smart terminals, 5G, smart cars, and high-end equipment, the improvement of quality and efficiency shall be strengthened, and the relevant testing and certification costs shall be reduced. (The Ministry of Industry and Information Technology, the National Development and Reform Commission, the Ministry of Civil Affairs, the General Administration of Customs, the Ministry of Commerce, the People's Bank of China, the State Administration of Taxation, the State Administration for Market Regulation, the China Banking and Insurance Regulatory Commission, the State Administration of Foreign Exchange and other entities shall organize the implementation in conjunction with the Shenzhen Municipality according to the division of functions)   (一)創新市場准入方式建立電子元器件和集成電路交易平台。支持深圳優化同類交易場所布局,組建市場化運作的電子元器件和集成電路國際交易中心,打造電子元器件、集成電路企業和產品市場准入新平台,促進上下游供應鏈和產業鏈的集聚融合、集群發展。支持電子元器件和集成電路企業入駐交易中心,鼓勵國內外用戶通過交易中心采購電子元器件和各類專業化芯片,支持集成電路設計公司與用戶單位通過交易中心開展合作。積極鼓勵、引導全球知名基礎電子元器件和芯片公司及上下游企業(含各品牌商、分銷商或生產商)依托中心開展銷售、采購、品牌展示、軟體方案研發、應用設計、售後服務、人員培訓等。支持開展電子元器件的設計、研發、制造、檢測等業務,降低供應鏈總成本,實現電子元器件產業鏈生產要素自由流通、整體管理;優化海關監管與通關環境,在風險可控前提下,推動海關、金融、稅務等數據協同與利用,聯合海關、稅務、銀行等機構開展跨境業務,交易中心為入駐企業提供進出口報關、物流倉儲服務,鼓勵金融機構與交易中心合作,為企業提供供應鏈金融服務。鼓勵市場主體依托中心開展采購,設立貿易聯盟並按市場化運作方式提供國際貿易資金支持,彙聚企業對關鍵元器件的采購需求,以集中采購方式提高供應鏈整體談判優勢。支持設立基礎電子元器件檢測認證及實驗平台,面向智能終端、5G、智能汽車、高端裝備等重點市場,加快完善相關標准體系,加強提質增效,降低相關測試認證成本。(工業和信息化部、國家發展改革委、民政部、海關總署、商務部、人民銀行、稅務總局、市場監管總局、銀保監會、外彙管理局等單位按職責分工會同深圳市組織實施)
2. Relaxing market access in relevant fields such as data element transactions and cross-border data business. Under the premise of strict quality control and a viable business model, the establishment of data element trading venues shall be prudently studied, the aggregation and circulation of data elements in the Guangdong-Hong Kong-Macao Greater Bay Area shall be accelerated, and Shenzhen shall be encouraged to carry out local policy research and exploration under the framework of national laws and regulations, and basic systems and technical standards such as data resource property rights, transaction circulation, cross-border transmission, information rights and data security protection shall be established. Exploration shall be made for mechanisms for the protection, sharing and utilization of personal information, and the Shenzhen Municipality shall be encouraged to explore legislation, set conditions and procedures for information processing, specify the obligations of processors or the rights of subjects to participate, handle personal information in accordance with the law, and protect the lawful interests of data processors. The promotion of opening of public data shall be accelerated, a public data sharing catalogue shall be prepared, the types of public data sharing shall be distinguished, sharing rules shall be developed by category, social institutions shall be guided to disclose their own data in accordance with the law, and data cooperation between central and local departments in specific fields shall be supported. Connection of international rules shall be effectively conducted mainly in such fields as finance, transportation, health, and medical care, the development of international rules for cross-border data flow shall be actively participated in, the pilot program of cross-border data transmission (exit) security management shall be implemented under the framework of national and industrial cross-border data transmission security systems, and data security management mechanisms such as data security protection capability assessment and certification, data circulation and backup review, cross-border data circulation and transaction risk assessment shall be established. By focusing on RMB settlement, research shall be conducted for introducing a number of data asset transaction products with clear needs, high transaction frequency and high degree of data standardization, advanced technologies such as blockchain and quantum information shall be utilized to realize data tradability, flow traceability, and security, and exploration shall be made for establishing the relevant standard systems in the field of data element transaction. Exploration shall be made for establishing an offshore data transaction platform, driving the development of digital trade, offshore data service outsourcing, Internet innovation incubation and other affiliated business types with international Internet transfer as the core business types, gathering international data resources, and improving the relevant management mechanism. (The Office of the Central Leading Group for Cyberspace Affairs, the National Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Commerce, the China Securities Regulatory Commission, the State Administration of Foreign Exchange and other entities shall organize the implementation in conjunction with the Shenzhen Municipality according to the division of functions)   (二)放寬數據要素交易和跨境數據業務等相關領域市場准入。在嚴控質量、具備可行業務模式前提下,審慎研究設立數據要素交易場所,加快數據要素在粵港澳大灣區的集聚與流通,鼓勵深圳在國家法律法規框架下,開展地方性政策研究探索,建立數據資源產權、交易流通、跨境傳輸、信息權益和數據安全保護等基礎制度和技術標准。探索個人信息保護與分享利用機制,鼓勵深圳市探索立法,對信息處理行為設定條件、程序,明確處理者義務或主體參與權利,依法處理個人信息,保護數據處理者合法利益。加快推動公共數據開放,編制公共數據共享目錄,區分公共數據共享類型,分類制定共享規則,引導社會機構依法開放自有數據,支持在特定領域開展央地數據合作。重點圍繞金融、交通、健康、醫療等領域做好國際規則銜接,積極參與跨境數據流動國際規則制定,在國家及行業數據跨境傳輸安全管理制度框架下,開展數據跨境傳輸(出境)安全管理試點,建立數據安全保護能力評估認證、數據流通備份審查、跨境數據流通和交易風險評估等數據安全管理機制。以人民幣結算為主,研究推出一批需求明確、交易高頻和數據標准化程度高的數據資產交易產品,利用區塊鏈、量子信息等先進技術實現數據可交易、流向可追溯、安全有保障,探索建立數據要素交易領域相關標准體系。探索建設離岸數據交易平台,以國際互聯網轉接等核心業態,帶動發展數字貿易、離岸數據服務外包、互聯網創新孵化等關聯業態,彙聚國際數據資源,完善相關管理機制。(中央網信辦、國家發展改革委、工業和信息化部、商務部、證監會、外彙管理局等單位按職責分工會同深圳市組織實施)
3. Optimizing the market access environment for application of advanced technologies. The in-depth integration of Shenzhen's industrial chain and innovation chain shall be utilized, by focusing on the application and promotion of advanced technology, a center for promoting the application of international advanced technologies shall be established, by the enterprise-oriented and market-oriented manner and according to the standards for the international first-class think tank, a world-class platform for the promotion of the application of advanced technologies shall be established, the contact mechanisms for important scientific research institutes, important universities, important state-owned enterprises, important innovative leading enterprises and innovation consortiums shall be established, advanced technological innovation resources from Hong Kong and Macao shall be directly contacted, branch centers shall be established at the locations of comprehensive national science centers and science and technology innovation centers step by step, cutting-edge technological innovation achievements and high-end innovation elements at home and abroad shall be gathered in an accelerated manner, the first-line needs of “improving advantages” and “making shortcomings” in the industrial chain and the supply chain shall be fully met, the information barriers and market access restrictions that restrict industrial development and the flow of innovative elements shall be removed, the direct application and transformation of advanced innovation achievements shall be promoted. A communication mechanism for key application projects shall be established with the China Securities Regulatory Commission, the Shanghai Stock Exchange and the Shenzhen Stock Exchange, the role of business start-up and industrial investment in promoting the application of advanced technologies shall be intensified, channels for communication between innovation resources and investment institutions shall be built, and investment platforms shall be formed to provide financial support for application of advanced technologies and transformation of achievements. Major needs shall be served, traditional project implementation methods shall be broken, market access barriers shall be removed, system concepts shall be highlighted, cooperation and transformation mechanisms for advanced technologies shall be established, demand and innovation resource information shall be shared, advanced technology-related demand application transformation processes and evaluation standards shall be developed, technological innovation capability shall be integrated and gathered, and the direct application of strategic cutting-edge disruptive advanced technologies such as artificial intelligence, new materials, quantum information, big data, network security, high-end chips, high-end instruments, industrial software, basic software, and emerging platform software in related fields shall be accelerated. Through government procurement policies such as first purchase and subscription, the industrialized and large-scale application of new technologies shall be supported, and the effect of transfer and transformation of scientific and technological achievements shall be significantly improved. (The National Development and Reform Commission and the Shenzhen Municipality shall organize implementation according to the devision of functions in conjunction with the State Security Bureau, the Ministry of Science and Technology, the Ministry of Education, the Ministry of Finance, the China Securities Regulatory Commission, the Chinese Academy of Sciences and other entities)   (三)優化先進技術應用市場准入環境。利用深圳產業鏈、創新鏈深度融合優勢,圍繞先進技術應用推廣,設立國際先進技術應用推進中心,以企業化市場化方式運作,對標國際一流智庫,搭建世界級先進技術應用推廣平台,建立與重要科研院所、重要高校、重要國有企業、重要創新型領軍企業和創新聯合體的聯系機制,直接聯接港澳先進技術創新資源,分步在綜合性國家科學中心和科創中心所在地設立分中心,加快彙聚國內外前沿技術創新成果和高端創新要素,全面對接產業鏈供應鏈“鍛長板”和“補短板”一線需求,打破制約產業發展和創新要素流動的信息壁壘和市場准入限制,推動先進創新成果直接應用轉化。與證監會和上交所、深交所建立重點應用項目溝通機制,加大創業和產業投資對先進技術應用推動作用,搭建創新資源與投資機構交流渠道,組建投資平台對先進技術應用和成果轉化提供資金支持。服務重大需求,打破傳統項目實施方式,破除市場准入門檻,突出系統觀念,建立先進技術合作轉化機制,共享需求和創新資源信息,構建先進技術相關需求應用轉化流程和評價標准,整合彙聚科技創新能力,加速人工智能、新材料、量子信息、大數據、網絡安全、高端芯片、高端儀器、工業軟件、基礎軟件、新興平台軟件等戰略性前沿性顛覆性先進技術在相關領域直接應用。通過首購、訂購等政府采購政策,支持新技術產業化規模化應用,大幅提高科技成果轉移轉化成效。(國家發展改革委、深圳市會同國家保密局、科技部、教育部、財政部、證監會、中國科學院等單位按職責分工組織實施)
4. Optimizing the application of new-generation information technologies such as 5G and the Internet of Things. By relying on Pengcheng Laboratory and other high-quality resources in Shenzhen, distributed experimental platforms for a new generation of information technologies such as 5G and the Internet of Things shall be built, relevant experimental resources and capabilities of domestic scientific research institutes, universities, and enterprises shall be connected, service network communications, cyberspace, networks intelligence, 5G, the Internet of Things and other various tasks shall be directly connected, cooperation with the center for promoting the application of international advanced technologies and other entities shall be intensified, the needs of relevant scientific research institutes such as the Chinese Academy of Sciences shall be actively met, relevant entities shall be cooperated in developing relevant experimental standards and assessments process for market access, the entry barriers for a new generation of information technologies and new infrastructure such as 5G and the Internet of Things in related fields shall be lowered, and the demonstration of related inclusive application shall be promoted. (The National Development and Reform Commission, the Ministry of Industry and Information Technology, the Ministry of Science and Technology, the Chinese Academy of Sciences and other entities shall organize implementation in conjunction with the Shenzhen Municipality according to the division of functions)   (四)優化5G、物聯網等新一代信息技術應用方式。依托鵬城實驗室等深圳優質資源搭建5G、物聯網等新一代信息技術分布式實驗平台,聯接國內科研院所、高校、企業的相關實驗資源和能力,直接對接服務網絡通信、網絡空間、網絡智能、5G、物聯網等各類相關任務,加大與國際先進技術應用推進中心等單位協同力度,積極對接中國科學院等有關科研院所需求,配合有關單位確立相關市場准入的實驗標准和評估流程,降低5G、物聯網等新一代信息技術和新型基礎設施在相關領域准入門檻,推動相關融合應用示範。(國家發展改革委、工業和信息化部、科技部、中國科學院等單位按職責分工會同深圳市組織實施)
5. Supporting the establishment of an international industry and standards organization. The formation of several international industry and standards organizations that are urgently needed in science and technology shall be accelerated, the establishment registration channels shall be built for international industry and standards organizations, and a report shall be submitted for approval under the principles of “reporting upon maturity.” No efforts shall be spared to promote the formation of international organizations that have met the conditions. The Shenzhen Municipality shall be supported in studying and developing the policies and measures for cultivating and developing international industry and standards organizations, further relaxing approval of members' nationality, number and activities shall be allowed, entry and exit convenience shall be provided for international members to participate in scientific research exchanges, the amount of membership fees and the standards for remunerations of employees shall be determined with reference to international standards, and certification and testing systems that are compatible with international standards shall be established. (The Shenzhen Municipality shall, in conjunction with the Ministry of Industry and Information Technology, the Ministry of Science and Technology, the Ministry of Foreign Affairs, the Ministry of Civil Affairs, the National Development and Reform Commission, the Ministry of Public Security, the State Administration for Market Regulation, the National Immigration Administration and other entities, organize the implementation)   (五)支持設立國際性產業與標准組織。加快設立若幹科技類急需的國際性產業與標准組織,建立國際性產業與標准組織設立登記通道,按照“成熟一家、上報一家”原則報批。抓緊推動設立條件已具備的國際組織。支持深圳會同相關部門研究制定培育發展國際性產業與標准組織的政策措施,允許進一步放寬會員國籍、人數和活動審批,為國際會員參與科研交流提供入出境便利,參照國際通行標准確定會費收繳額度和雇員薪酬標准,建立與國際標准相適配的認證和測試體系。(深圳市會同工業和信息化部、科技部、外交部、民政部、國家發展改革委、公安部、市場監管總局、國家移民管理局等單位組織實施)
II. Improving the access method in the field of financial investment 二、完善金融投資領域准入方式
6. Improving the financial support capability of the supply chain of agricultural products. Financial institutions shall be encouraged to provide financial services in the supply chain such as inventory, warehouse receipts, and order pledge financing based on the real transaction background, under the premise of controllable risks, under the principle of marketization and the rule of law, and by relying on core enterprises in the supply chain and the industry chain of agricultural products (hereinafter referred to as “core enterprises”), and the financing costs of downstream distributors shall be reduced. Core enterprises' inventory supervision capabilities and underlying goods distribution and disposal capabilities shall be mainly maximized, the transaction information such as acceptance and delivery, and inventory monitoring shall be collected, and a big data platform for intelligent supervision of movable properties shall be created; smoothing the information interface among banks, core enterprises, warehouse supervision enterprises and other systems by innovative methods of “direct connection between information systems of banks and enterprises + Internet of Things + blockchain technology” shall be encouraged, business credit investigation, credit rating and other various market-oriented institutions shall be introduced, business data shall be dynamically updated and electronic standard warehouse receipts and risk assessment reports shall be formed; and unified standards for inventory pledge supervision technologies shall be encouraged to be formed based on blockchain and Internet of Things equipment, and a new generation of information technology shall be utilized, to ensure the validity of information such as goods ownership transfer records. The securitization of financial assets in the supply chain shall be carried out in a stable and standardized manner. Exploration shall be made for conducting settlement of transactions with digital RMB. (The China Banking and Insurance Regulatory Commission, the People's Bank of China, the Ministry of Commerce, the China Securities Regulatory Commission, the National Development and Reform Commission, the Ministry of Agriculture and Rural Affairs and other entities shall organize the implementation in conjunction with the Shenzhen Municipality according to the division of functions)   (六)提升農產品供應鏈金融支持能力。鼓勵金融機構基于真實交易背景和風險可控前提,按照市場化法治化原則,依托農產品供應鏈產業鏈核心企業(以下簡稱核心企業),開展存貨、倉單、訂單質押融資等供應鏈金融業務,降低下游經銷商融資成本。注重發揮核心企業存貨監管能力、底層貨物分銷處置能力,彙集驗收交割、在庫監控等交易信息,打造動產智能監管大數據平台;鼓勵以“銀企信息系統直聯+物聯網+區塊鏈技術”創新方式,打通銀行、核心企業、倉儲監管企業等系統間信息接口,引入企業征信、信用評級等各類市場化機構,動態更新業務數據並形成電子化標准倉單和風險評估報告;鼓勵以區塊鏈和物聯網設備為基礎,形成存貨質押監管技術統一標准,利用新一代信息技術,確保貨物權屬轉移記錄等信息有效性。穩妥規範開展供應鏈金融資產證券化。探索運用數字人民幣進行交易結算。(銀保監會、人民銀行、商務部、證監會、國家發展改革委、農業農村部等單位按職責分工會同深圳市組織實施)
7. Promoting the interconnection of insurance markets in Shenzhen, Hong Kong and Macau regions. The relevant work of the Insurance Service Center shall be actively promoted, services such as convenient preservation and claims settlement shall be provided for clients that have purchased Hong Kong and Macao insurance products in compliance with the national foreign exchange management policies, the establishment of a mechanism for exchange of funds with and interconnection with markets of Hong Kong and Macao shall be promoted, and direct settlement services for persons with Hong Kong and Macao insurance shall be provided in public hospitals in Shenzhen on a pilot basis, and the reimbursement and use of overseas drugs shall be allowed. (The China Banking and Insurance Regulatory Commission, the People's Bank of China, the National Health Commission, the Hong Kong and Macao Affairs Office of the State Council, the National Medical Products Administration and other entities shall organize the implementation in conjunction with the Shenzhen Municipality according to the division of functions)   (七)推動深港澳地區保險市場互聯互通。積極推進保險服務中心有關工作,在符合現有的法律法規前提下,為已購買符合國家外彙管理政策的港澳保險產品的客戶提供便利化保全、理賠等服務,推動深圳與港澳地區建立有關資金互通、市場互聯機制,試點在深圳公立醫院開通港澳保險直接結算服務並允許報銷使用境外藥品。(銀保監會、人民銀行、國家衛生健康委、國務院港澳辦、國家藥監局等單位按職責分工會同深圳市組織實施)
8. Improving the convenience of cross-border trade settlement. Domestic banks shall be supported in developing a whitelist of high-quality enterprises in the supply chain on the basis of the “three principles for business development,” optimizing the external payment and settlement process of core enterprises in the supply chain, and directly handling cross-border RMB settlement of trade in goods and services for high-quality enterprises upon strength of the Description of Receipts/Payments in Cross-border RMB Settlement or instructions for collection and payment filed by excellent enterprises. Research shall be conducted for supporting high-quality enterprises in the upstream and downstream of the supply chain in carrying out centralized collection and payment of cross-border RMB funds under the current account. Shenzhen Municipality shall be encouraged to develop supportive policies for high-quality enterprises in the Qianhai Shekou Area of China (Guangdong) Pilot Free Trade Zone. (The Shenzhen Municipality shall, in conjunction with the People's Bank of China, the State Administration of Foreign Exchange, the China Banking and Insurance Regulatory Commission, the Ministry of Commerce, the National Development and Reform Commission and other entities, organize implementation according to the division of functions)   (八)提升貿易跨境結算便利度。支持境內銀行在“展業三原則”基礎上,制定供應鏈優質企業白名單,優化供應鏈核心企業對外付款結算流程,憑優質企業提交的《跨境人民幣結算收/付款說明》或收付款指令,直接為優質企業辦理貨物貿易、服務貿易跨境人民幣結算。研究支持供應鏈上下游優質企業開展經常項目下跨境人民幣資金集中收付。鼓勵深圳針對中國(廣東)自由貿易試驗區前海蛇口片區內優質企業制定支持政策。(深圳市會同人民銀行、外彙管理局、銀保監會、商務部、國家發展改革委等單位按職責分工組織實施)
