Notice of the Ministry of Housing and Urban-Rural Development and the State Administration of Foreign Exchange on Further Regulating the Administration on House Purchase by Overseas Institutions and Individuals

The housing and urban-rural development departments of all provinces and autonomous regions, the construction commissions (housing and land resources bureaus) of all municipalities directly under the Central Government; the branches and foreign exchange administrative departments of the State Administration of Foreign Exchange in all provinces, autonomous regions and municipalities directly under the Central Government, the branches of the State Administration of Foreign Exchange in Shenzhen, Dalian, Qingdao, Xiamen and Ningbo; and the head offices of all designated Chinese-funded foreign exchange banks:
In order to implement the Notice of the State Council on Resolutely Curbing the Soaring of Housing Prices in Some Cities (No.10 [2010] of the State Council), we hereby notify you on strengthening the supervision of the implementation of the Opinions on Regulating the Access to and Administration of Foreign Investment in the Real Estate Market (No.171 [2006] of the former Ministry of Construction) and further regulating the administration on house purchase by overseas institutions and individuals as follows:

各省、自治區住房和城鄉建設廳、直轄市建委(房地局);國家外彙管理局各省、自治區、直轄市分局,外彙管理部,深圳、大連、青島、廈門、甯波市分局;各中資外彙指定銀行總行:
為落實國務院《關于堅決遏制部分城市房價過快上漲的通知》(國發〔2010〕10號),現就加強《關于規範房地產市場外資准入和管理的意見》(建住房〔2006〕171號)的實施監管,進一步規範境外機構和個人購房管理通知如下:
I. An overseas individual can only purchase one unit for his own living. An overseas institution which establishes a branch or representative office within the territory of China can only purchase non-residential properties for office work in the city where it registers, unless it is otherwise provided by any law or regulation.
   一、境外個人在境內只能購買一套用于自住的住房。在境內設立分支、代表機構的境外機構只能在注冊城市購買辦公所需的非住宅房屋。法律法規另有規定的除外。
II. When handling the archival filing of the advance sale contract of commercial properties and the registration of property title for an overseas individual, the local competent department of real estate shall, besides examining the materials as prescribed in the Measures for the Management of Advance Sale of Urban Commercial Properties and the Measures for Building Registration and checking the information of the purchaser's holding of housing property, also examine:

   二、各地房地產主管部門在辦理境外個人的商品房預售合同備案和房屋產權登記時,除應當查驗《城市商品房預售管理辦法》、《房屋登記辦法》規定的材料及驗證購房人持有房屋情況外,還應當查驗:
