Notice of the National Development and Reform Commission on Issuing the Interim Measures for the Administration of Voluntary Greenhouse Gas Emission Reduction Transactions (No. 1668 [2012] of the National Development and Reform Commission) All ministries and commissions of the State Council and all institutions directly under the State Council; and the development and reform commissions of all provinces, autonomous regions and municipalities directly under the Central Government; In order to realize the objective of reducing carbon dioxide emissions per unit of GDP in China by 2020, it is put forward in the Outline of the 12th Five-Year Plan for National Economic and Social Development that the carbon emission trading market shall be gradually established so as to bring into play the important role of the market mechanism in promoting the transformation of the economic development mode and adjustments of the economic structure. At present, certain voluntary emission reduction transactions based on projects have been carried out in China, which plays a positive role in nurturing the market awareness of carbon emission reductions, and exploring and putting into trial implementation carbon emission trading procedures and standards. In order to guarantee the orderly implementation of voluntary emission reduction transactions, mobilize the enthusiasm of the whole society on voluntarily participating in carbon emission reduction activities, and cumulate experience and lay the foundation of technologies and rules for gradually establishing the carbon emissions trading market with total amount control, this Commission organized the formulation of the Interim Measures for the Administration of Voluntary Greenhouse Gas Emission Reduction Transactions (hereinafter referred to as the “Interim Measures”), which are hereby issued for implementation. Since voluntary greenhouse gas emission reduction transactions are an item of brand new exploratory work, and involves multiple aspects, many operational links and complicated procedures, such transactions shall be subject to diligent organization and strict management, and be conducted under the good faith principle and the procedures and rules of the Interim Measures, and emission reductions in transactions shall be true and reliable. Please give feedbacks on the problems encountered during the implementation of these Interim Measures and opinions to this Commission in a timely manner. Chapter I General Provisions
| | 第一章 总则

Article 1 These Interim Measures are formulated in order to encourage voluntary greenhouse gas emission reduction transactions based on projects and guarantee the orderly implementation of relevant transactions.

Article 2 These Interim Measures shall apply to the voluntary emission reduction transactions regarding six types of greenhouse gases including carbon dioxide (CO2), methane (CH4), nitrous oxide (N2O), hydrofluorocarbon (HFCs), perfluocarbon (PFCs) and sulfur hexafluoride (SF6).
| | 第二条 本暂行办法适用于二氧化碳( C02)、甲烷(CH4)、氧化亚氮( N2 0)、氢氟碳化物(HFCs)、全氟化碳(PFCs)和六氟化硫( SF6)等六种温室气体的自愿减排量的交易活动。

Article 3 Voluntary greenhouse gas emission reduction transactions shall be conducted under the principles of openness, fairness, impartiality and good faith, and emission reductions in transactions shall be based on specific projects, and be truthful, measurable and additional.
| | 第三条 温室气体自愿减排交易应遵循公开、公平、公正和诚信的原则,所交易减排量应基于具体项目,并具备真实性、可测量性和额外性。

Article 4 The National Development and Reform Commission (“NDRC”) shall take charge of voluntary greenhouse gas emission reduction transactions, and administer voluntary greenhouse gas emission reduction transactions within the territory of the People's Republic of China in accordance with these Interim Measures.
| | 第四条 国家发展改革委作为温室气体自愿减排交易的国家主管部门,依据本暂行办法对中华人民共和国境内的温室气体自愿减排交易活动进行管理。

Article 5 Domestic and foreign institutions, enterprises, organizations and individuals are entitled to participate in voluntary greenhouse gas emission reduction transactions.
| | 第五条 国内外机构、企业、团体和个人均可参与温室气体自愿减排量交易。

Article 6 The state exercises filing administration regarding voluntary greenhouse gas emission reduction transactions. Voluntary emission reduction transaction projects shall be filed and registered at the competent department of the state, and the emission reductions of projects shall be filed and registered at the competent department of the state, and transactions shall be conducted in the trading institutions filed at the competent department of the state. Enterprise legal persons registered within the territory of the People's Republic of China may, in accordance with these Interim Measures, apply for filing voluntary greenhouse gas emission reduction projects and emission reductions.

Article 7 The competent department of the state shall establish and manage the register of voluntary emission reduction transactions of the state (hereinafter referred to as the “national register”) to register filed voluntary emission reduction projects and emission reductions, and keep detailed records of the basic information on projects and the relevant information on the filing, trading and cancellation of emission reductions.
| | 第七条 国家主管部门建立并管理国家自愿减排交易登记簿(以下简称“国家登记簿”),用于登记经备案的自愿减排项目和减排量,详细记录项目基本信息及减排量备案、交易、注销等有关情况。

Article 8 The competent department of the state shall, through releasing the relevant information and providing the national register for reference within ten working days after the completion of filing, direct all parties to voluntary emission reduction transactions so that they may trade in the credible voluntary emission reductions.
| | 第八条 在每个备案完成后的10个工作日内,国家主管部门通过公布相关信息和提供国家登记簿查询,引导参与自愿减排交易的相关各方,对具有公信力的自愿减排量进行交易。

Chapter II Management of Voluntary Emission Reduction Projects

Article 9 Voluntary greenhouse gas emission reduction transaction projects shall be validated by the validation institution filed at the competent department of the state with the methodologies filed at the competent department of the state.
| | 第九条 参与温室气体自愿减排交易的项目应采用经国家主管部门备案的方法学并由经国家主管部门备案的审定机构审定。

Article 10 Methodology means the methods and guidelines for determining the project baseline, authenticating additionality, calculating emission reductions and preparing monitoring plans. The competent department of the state shall authorize experts to appraise clean development mechanism (“CDM”) project methodologies that have been approved by the CDM Executive Board, and file the methodologies appropriate for voluntary emission reduction transaction projects.
| | 第十条 方法学是指用于确定项目基准线、论证额外性、计算减排量、制定监测计划等的方法指南。 对已经联合国清洁发展机制执行理事会批准的清洁发展机制项目方法学,由国家主管部门委托专家进行评估,对其中适合于自愿减排交易项目的方法学予以备案。

Article 11 The developers of newly developed methodologies may apply to the competent department of the state for filing such methodologies, and submit the design documents on such methodologies and relevant projects. The competent department of the state shall, after receiving the applications for filing new methodologies, authorize experts to conduct technical appraisal on the new methodologies for a period of not more than 60 working days. The competent department of the state shall examine the applications for filing newly developed methodologies based on expert appraisal opinions, and within 30 working days of the receipt of filing applications (excluding the time for expert appraisal), file reasonable and operable newly developed methodologies with complete design documents on the relevant projects as well as scientific and reasonable technical descriptions.
| | 第十一条 对新开发的方法学,其开发者可向国家主管部门申请备案,并提交该方法学及所依托项目的设计文件。国家主管部门接到新方法学备案申请后,委托专家进行技术评估,评估时间不超过60个工作日。 国家主管部门依据专家评估意见对新开发方法学备案申请进行审查,并于接到备案申请之日起30个工作日内(不含专家评估时间)对具有合理性和可操作性、所依托项目设计文件内容完备、技术描述科学合理的新开发方法学予以备案。

Article 12 Before an application for filing a voluntary emission reduction project is submitted, the project shall be validated by the validation institution filed at the competent department of the state, and the validation institution shall issue the project validation report. The project validation report shall cover:
