| In March 2017, [REDACTED] No. 5 Construction Engineering Group Co., Ltd. (hereinafter referred to as "No. 5 Construction Company") and Jian[REDACTED] Concrete Co., Ltd. (hereinafter referred to as "Concrete Company") signed a Commercial Concrete Purchase and Sales Contract, in which the unit price of commercial concrete supplied by Concrete Company to No. 5 Construction Company was agreed. In September 2018, both parties signed a supplementary agreement, under which the unit price of commercial concrete shall be increased by 90 yuan per cubic meter on the basis of the price as stipulated in the purchase and sales contract. From the date on which the supplementary agreement was signed to April 2020, Concrete Company supplied to No. 5 Construction Company 5,192.5 cubic meters of commercial concrete in total. In June 2021, the [REDACTED] Administration for Market Regulation made an administrative penalty decision, determining that Concrete Company and Jiang[REDACTED] Building Materials Co., Ltd. (hereinafter referred to as "Jiang[REDACTED] Company") reached and implemented a horizontal monopolistic agreement on fixing the sales price of commercial concrete and dividing the sales market of commercial concrete from April 2014 to March 2019, and during this period, there were only two local enterprises actually manufacturing and selling commercial concrete. In April 2023, No. 5 Construction Company filed a lawsuit on the ground that Concrete Company's implementation of the horizontal monopolistic agreement caused losses to it, requesting the court to order Concrete Company to compensate for its losses. The Court of first instance ordered Concrete Company to compensate No. 5 Construction Company for its losses in an amount of 467,325 yuan. Concrete Company refused to accept the judgment of first instance and appealed. | | 2017年3月，某地第五建筑工程集团有限公司（简称五建公司）与建某混凝土有限公司（简称混凝土公司）签订商砼购销合同，约定了混凝土公司向五建公司供应商砼的单价。2018年9月，双方签订补充协议，以购销合同价格为基础，商砼单价上涨90元/立方米。补充协议签订后，至2020年4月，混凝土公司向五建公司累计供应商砼5192.5立方米。2021年6月，某地市场监督管理局作出行政处罚决定，认定混凝土公司与江某建材有限公司（简称江某公司）在2014年4月至2019年3月期间达成并实施了固定商砼销售价格、分割商砼销售市场的横向垄断协议，且在此期间当地只有该两家企业实际生产、销售商砼。2023年4月，五建公司以混凝土公司实施横向垄断协议给其造成损失为由提起诉讼，请求判令混凝土公司赔偿损失。一审法院判决混凝土公司赔偿五建公司损失467325元。混凝土公司不服，提起上诉。 |
