Announcement of the Supreme People's Court
The Several Provisions of the Supreme People's on the Jurisdiction of Railway Transport Courts over Cases, as adopted at the 1551st session of the Judicial Committee of the Supreme People's Court on July 2, 2012, are hereby issued and shall come into force on August 1, 2012.

Several Provisions of the Supreme People's on the Jurisdiction of Railway Transport Courts over Cases
(Interpretation No. 10 [2012] of the Supreme People's Court)
For the purpose of determining the jurisdiction of railway transport courts over cases after the administrative mechanism reform, in accordance with the Criminal Procedure Law of the People's Republic of China and the Civil Procedure Law of the People's Republic of China, the relevant issues are hereby provided for as follows:

最高人民法院关于铁路运输法院案件管辖范围的若干规定
（法释〔2012〕10号）
为确定铁路运输法院管理体制改革后的案件管辖范围，根据《中华人民共和国刑事诉讼法》、《中华人民共和国民事诉讼法》，规定如下：

Article 1 A railway transport court shall accept the criminal cases against which the railway transport procuratorate at the same level institutes public prosecution according to law.
Any of the following criminal cases that are publicly prosecuted shall be under the jurisdiction of the railway transport court at the place where the crime was committed:
| | 第一条 铁路运输法院受理同级铁路运输检察院依法提起公诉的刑事案件。
下列刑事公诉案件，由犯罪地的铁路运输法院管辖：
|
(1) crimes committed within railway work areas such as stations, freight yards and transportation command institutions;
| | （一）车站、货场、运输指挥机构等铁路工作区域发生的犯罪；
|
(2) crimes aimed at railway lines, locomotives, communications, electricity and other railway equipment and facilities; and
| | （二）针对铁路线路、机车车辆、通讯、电力等铁路设备、设施的犯罪；
|
(3) crimes committed by employees of railway transport enterprises while carrying out their duties.
．．．．．． | | （三）铁路运输企业职工在执行职务中发生的犯罪。
在列车上的犯罪，由犯罪发生后该列车最初停靠的车站所在地或者目的地的铁路运输法院管辖；但在国际列车上的犯罪，按照我国与相关国家签订的有关管辖协定确定管辖，没有协定的，由犯罪发生后该列车最初停靠的中国车站所在地或者目的地的铁路运输法院管辖。
