The Procedures of Shanxi Province on Supervision over the Burden of Enterprises which was passed at the 94th executive meeting of the provincial government on January 17th, 2007, is hereby promulgated, and shall enter into force as of March 1st, 2007.

山西省企业负担监督办法
Article 1 These Procedures are formulated for the purpose of protecting the enterprises' lawful rights and interests, optimizing their environment of production and operation and promoting the harmonious development of the economy and society, in accordance with laws and regulations concerned and in light of actual situations of this Province.
   第一条 为了维护企业合法权益,优化企业生产经营环境,促进经济社会和谐发展,根据有关法律、法规,结合本省实际,制定本办法。
Article 2 The “burden of enterprises” as mentioned in these Measures refers to the behavior of administrative agency and other organizations which have been authorized by the laws and regulations to administer the public affairs and the organizations entrusted by the administrative agency (hereinafter referred to as “Administrative Agency”) and the staff of these agency or organizations that impose extra burden of manpower, finance or materials on the enterprises against the provisions of the laws , regulations and provisions.
“Enterprises” as mentioned in the Measures refer to all categories of enterprises legally registered in the Administration Bureau for Industry and Commerce.
These Measures are applicable to the supervision over the burden of enterprises in the administrative region of Shanxi Province.
   第二条 本办法所称企业负担,是指行政机关和法律、法规授权的具有管理公共事务职能的组织以及行政机关依法委托的组织(以下简称行政机关)及其工作人员违反法律、法规和规章规定,增加企业人力、财力和物力负担的行为。
本办法所称企业,是指依法在工商行政管理机关登记注册的各类企业。
本省行政区域内的企业负担监督适用本办法。
Article 3 The Economic Committee of the provincial government takes charge of the work in supervising the burden of enterprises in the province. The Economic and Trade Commissions (or Bureaus) of the municipalities with subordinate districts, the cities and counties, and prefectures take charge of the work in supervising the enterprises' burden in their administrative areas (hereinafter referred to as the “Competent Enterprises' Burden Supervision Authority”).
The Competent Enterprises' Burden Supervision Authority fulfills the duties as follows:
   第三条 省人民政府经济委员会主管全省企业负担监督工作,设区的市、县市、区经济经贸委员会局主管本行政区域内企业负担监督工作(以下简称企业负担监督主管部门)。
企业负担监督主管部门履行下列职责:
(1) To supervise and inspect the implementation of the laws, regulations and provisions, and other regulatory documents and report to People's Government at the same level;
 (一)监督检查涉及企业负担的法律、法规、规章以及其他规范性文件的执行,并就企业负担监督工作向本级人民政府报告;
(2) To accept and investigate the complaints and reports relating to the burden of enterprises, and handle the reported cases recognized as serious and complicated;
 (二)受理、调查涉及有关企业负担的举报、投诉,组织查处重大复杂的举报、投诉案件;
(3) To coordinate the departments under the government at the same level, the governments at inferior levels and their Competent Enterprises' Burden Supervision Authorities to deal with the cases of imposing extra burden on enterprises;
 (三)协调本级人民政府有关部门、下一级人民政府及其企业负担监督主管部门查处增加企业负担的案件;
(4) To investigate and examine the prominent problems as reported by enterprises and to propose measures against problems;
 (四)调查研究企业反映突出的问题并提出治理措施;
(5) To perform other works on the supervision over enterprises' burden.
 (五)承办企业负担监督的其他工作。
Article 4 People's government above county level shall strengthen the leadership in the work of supervising enterprises' burden, build and improve such supervising system on enterprises' burden, and organize, coordinate and promote the departments concerned to well perform their supervisions over enterprises' burden in accordance with laws.
The expenditures of such supervision work shall be incorporated into the financial budget.
   第四条 县级以上人民政府应当加强对企业负担监督工作的领导,建立和完善企业负担监督的规章制度,组织、协调和督促有关部门依法做好企业负担的监督工作。
企业负担监督工作所需经费应当列入财政预算。
Article 5 The departments of finance, price, supervision, auditing, and medium-and-small and the like under the governments above county level, shall strengthen the cooperation with the Competent Enterprises' Burden Supervision Authority and well perform the supervisory work pursuant to their own respective functions.
   第五条 县级以上人民政府财政、价格、监察、审计、中小企业等相关部门应当加强与企业负担监督主管部门的配合,并按照各自的职责,依法做好企业负担监督工作。
Article 6 People's governments above county-level and the affiliated departments shall formulate regulatory documents based on the laws, regulations and provisions; and no infringement to the lawful rights and interests of enterprises shall be allowed.
Where an enterprise recognizes that such regulatory documents contradict with the laws, regulations or provisions, or are improperly formulated, or are conflicting with each other, the enterprise may submit written petition to government's office of legislative affairs at the same administrative level for review. The office of legislative affairs, upon receiving the petition, shall execute the review process and send the result of review or administrative action in written to the enterprises which raised the request.
   第六条 县级以上人民政府及其所属部门制定规范性文件,应当以法律、法规、规章为依据,不得损害企业合法权益。
企业发现规范性文件与法律、法规、规章相抵触或者不适当以及规范性文件之间相互冲突的,可以向规范性文件制定机关的同级人民政府的法制机构提出书面审查建议。收到书面建议的法制机构应予审查,并将审查结果或者处理情况书面答复提出建议的企业。
Article 7 Administrative charges relating to enterprises should be set according to the laws, regulations, relevant provisions of the State Council, procedures jointly issued by the Ministry of Finance and Department of Development and Reform, and regulations or provisions promulgated by the provincial government and provisions jointly adopted by the provincial departments of finance and price. No other departments under provincial government and inferior municipality-level governments and their affiliated departments shall set these administrative charges.
Governmental funds that are levied from enterprises shall be collected according to the laws, administrative regulations and provisions of the State Council and Ministry of Finance. No local government and its affiliated departments shall set such funds.
Fund raising that involves enterprises shall be conducted basing on laws, administrative regulations and provisions of the State Council. No local government and its affiliated departments shall raise such fund.
   第七条 涉及企业的行政事业性收费,应当以法律、法规、国务院有关规定、国务院财政部门与发展改革部门共同发布的规章或者规定以及省人民政府发布的规章或者规定和省人民政府财政、价格部门共同发布的规定为依据,省人民政府的其他工作部门和市级以下人民政府及其所属工作部门无权自行设立。
涉及向企业收取的政府性基金,应当以法律、行政法规、国务院及其财政部门的规定为依据,地方各级人民政府及其所属工作部门无权自行设立。
涉及企业的集资,应当以法律、行政法规和国务院规定为依据,地方各级人民政府及其所属工作部门无权自行设立。
Article 8 The provincial government's department of finance and department in charge of price should clear the items and standards of administrative charges in accordance with the law, compile the directory of the provincial administrative charges items and publish it; if the items of administrative charges are canceled or the standards of charges change, publishing should be done timely.
The entity for collecting administrative service charges shall publicize the directory of the administrative service charges to enterprises. Where any charges not being listed in such directory is imposed, prior demonstration of proper laws and regulations shall be mandatory for justifiable purpose.
Enterprises shall be entitled to deny the payment of any administrative service charges beyond said directory or without legitimate or regulatory ground.
   第八条 省人民政府财政、价格主管部门应当依法对涉及企业的行政事业性收费项目和收费标准进行清理,编制全省行政事业性收费项目目录,并予以公布;行政事业性收费项目被取消或者收费标准变更的,应当及时公布。
行政事业性收费的执收单位应当向企业出示行政事业性收费项目目录,暂未列入目录的应当出示收费依据的法律、法规。
超出目录规定标准或者无法律、法规依据的行政事业性收费项目,企业有权拒绝缴纳。
Article 9 The entity or department for collecting administrative service charges shall follow the provisions as follows:
   第九条 行政事业性收费的执收部门和单位应当遵守下列规定:
(1) Having legally obtained the License of Charging;
 (一)依法取得《收费许可证》;
(2) Filling out the Registration Card of Charge Payment submitted by the enterprises;
 (二)填写企业提交的《企业交费登记卡》;
(3) Collecting charges according to the charging items and criteria publicized by the administrative departments of finance and price under provincial government;

 (三)按照省人民政府财政、价格主管部门公布的收费项目和收费标准收取费用;
