财政部关于印发《中央补助地方博物馆纪念馆免费开放专项资金管理暂行办法》的通知

The public finance departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government, and cities under separate state planning; and the Financial Bureau of the Xinjiang Production and Construction Corps: 各省、自治区、直辖市、计划单列市财政厅(局),新疆生产建设兵团财务局:
For purposes of regulating and strengthening the administration of the special funds for free admission centrally subsidized to local museums and memorial halls and increasing the use efficiency of funds, the Interim Measures for the Administration of the Special Funds for Free Admission Centrally Subsidized to Local Museums and Memorial Halls are formulated, which are hereby issued to you for your compliance and implementation. 为规范和加强中央补助地方博物馆、纪念馆免费开放专项资金管理,提高资金使用效益,我们制定了《中央补助地方博物馆、纪念馆免费开放专项资金管理暂行办法》,现印发你们,请遵照执行。

Interim Measures for the Administration of the Special Funds for Free Admission Centrally Subsidized to Local Museums and Memorial Halls 中央补助地方博物馆、纪念馆免费开放专项资金管理暂行办法
Chapter I General Provisions 

第一章 总则

Article 1 For purposes of regulating and strengthening the administration of the special funds for free admission centrally subsidized to local museums and memorial halls (hereinafter referred to the “Special Funds”), these Measures are formulated in accordance with the relevant provisions of the state.   第一条 为规范和加强中央补助地方博物馆、纪念馆免费开放专项资金(以下简称专项资金)管理,根据国家有关规定,制定本办法。
Article 2 Special Funds shall be established by the Central Treasury for subsidizing the expenditures that are needed by museums and memorial halls for free admission, encouraging the improvement of exhibitions and displays, supporting key museums in their improvement of service capabilities, and giving rewards to provinces with outstanding performance in the work of free admission. Local public finance departments shall guarantee the operating funds for local museums and memorial halls with free admission and may not reduce the funds that should be arranged by local public finance departments because the Central Treasure has arranged the Special Funds.   第二条 专项资金由中央财政设立,用于补助博物馆、纪念馆免费开放所需经费支出,鼓励改善陈列布展,支持重点博物馆提升服务能力,对免费开放工作成绩突出的省份给予奖励。地方财政应当保障本地区免费开放博物馆、纪念馆日常运转经费,不得因中央财政安排专项资金而减少应由地方财政安排的资金。
Article 3 Special Funds shall be managed and used in line with the principles of “overall arrangement, hierarchical management, hierarchical responsibility, and earmarking.”   第三条 专项资金管理和使用坚持“统筹安排、分级管理、分级负责、专款专用”的原则。
Article 4 The management and use of Special Funds shall be subject to the supervision and inspection of the departments of public finance, auditing, publicity, culture and cultural relics, etc.   第四条 专项资金管理和使用应当接受财政、审计和宣传、文化、文物等部门的监督检查。
Chapter II Scope of Subsidies and Content of Expenditures 

第二章 补助范围与支出内容

Article 5 The scope of subsidies and the content of expenditures of the Special Funds include:   第五条 专项资金的补助范围和支出内容包括:
1. subsidies to operating funds, which are used for subsidizing the normal operation of museums, memorial halls in the list of free admission as determined by the Publicity Department of the Central Committee of the CPC, the Ministry of Finance, the Ministry of Culture and the State Administration of Cultural Heritage or for the normal operation of national patriotism education demonstration bases after they implement the free admission, and also for improving their public service capability; (一)运转经费补助。用于补助列入中宣部、财政部、文化部、国家文物局确定的免费开放名单的博物馆、纪念馆或全国爱国主义教育示范基地免费开放后正常运转和提升公共服务能力等支出。
2. subsidies to exhibitions and displays, which are used for subsidizing the expenses paid by museums and memorial halls, which are subject to the administration of the departments of culture and cultural relics, for improving their scheme and design of basic exhibitions, purchase of relevant materials and equipment, construction, supervision, and expert consultation; (二)陈列布展补助。用于补助文化文物主管部门归口管理的博物馆、纪念馆改善基本陈列的方案设计、相关材料及设备购置、施工、监理和专家咨询等支出。
3. subsides to state-level museums that are jointly constructed by the central and local governments, which are used for subsidizing the state-level museums that are jointly constructed by the central and local governments as determined by the State Administration of Cultural Heritage and the Ministry of Finance to improve the protection of collections, exhibitions and displays, academic research, talent training, exchange and cooperation, and social education. The proportion of academic research, exchange and cooperation shall not exceed 20% of the amount of such subsidies; (三)中央地方共建国家级博物馆补助。用于补助国家文物局、财政部确定的中央地方共建国家级博物馆提升藏品保护、陈列展览、学术研究、人才培养、交流合作、社会教育等支出。其中,学术研究和交流合作支出所占比例不超过该项补助金额的20%。
4. awards to museums and memorial halls that implement free admission voluntarily or collect a lower admission fee, which are used for encouraging the museums and memorial halls (including private museums) that implement free admission voluntarily or collect a lower admission fee to improve their public service capabilities; and (四)对自行免费或低票价开放的奖励。用于鼓励地方自行免费或低票价开放博物馆、纪念馆(含民办博物馆)提升公共服务能力。
5. awards to provinces with excellent performance in the work of free admission, which are used for encouraging provinces with outstanding performance in the work of free admission to further improve their public service capabilities. (五)对免费开放工作优秀省份的奖励。用于鼓励免费开放工作成绩突出的省份,进一步提升博物馆、纪念馆公共服务能力。
Article 6 Special Funds may not be used to pay for various kinds of fines, donations, sponsorship fees and investments, may not be used to pay for basic wages of in-service personnel and retirees who are included in the staffing quota, or for expenditures of basic construction, large-scale maintenance and transformation or collection of cultural relics, and may not be used to pay debts.   第六条 专项资金不得用于支付各种罚款、捐款、赞助、投资等支出,不得用于发放编制内在职人员和离退休人员基本工资、基本建设、大型维修改造、文物征集等支出,不得用于偿还债务。
Chapter III Application, Examination and Approval 

第三章 申报与审批

Article 7 The provincial public finance departments shall be responsible for the work relating to the application for Special Funds. All provincial public finance departments shall earnestly review and collect the information on the free admission to local museums and memorial halls of the previous year, the free admission to national patriotism education demonstration bases as well as the basic information about the state-level museums that are jointly constructed by the central and local governments, review the applications for subsidies to exhibitions and displays of the current year and the applications for the projects of state-level museums that are constructed jointly by the central and local governments, put forward proposals for giving awards to museums and memorial halls that implement free admission voluntarily or collect a lower admission fee, and submit the application reports for the Special Funds and the relevant annexes (Annexes 1-4) to the Ministry of Finance before April 30 each year.   第七条 省级财政部门负责专项资金申报工作。各省级财政部门应当按照规定做好本地区上年度博物馆、纪念馆免费开放情况、全国爱国主义教育示范基地免费开放情况和中央地方共建国家级博物馆基本情况审核汇总工作,审核当年陈列布展补助和中央地方共建国家级博物馆项目申请,提出自行免费或低票价开放奖励建议,于每年4月30日前将专项资金申请报告和有关附表(见附件1-4)报送财政部。
