| In order to implement the open trial principle, guarantee the public's right to know and right of supervision, regulate the issuance of judicial documents on the Internet by the people's courts, and promote judicial justice, these Provisions are formulated in accordance with the actual circumstances of the people's courts. | | 为贯彻落实审判公开原则，保障公众知情权和监督权，规范人民法院在互联网公布裁判文书，促进司法公正，根据人民法院工作实际，制定本规定。 |
| Article 1 The people's courts shall issue judicial documents on the Internet under the principles of legality, timeliness and standardization. | | 第一条 人民法院在互联网公布裁判文书，应当遵循依法、及时、规范的原则。 |
| Article 2 An effective judicial document of the people's court may be issued on the Internet, except under any of the following circumstances: | | 第二条 人民法院的生效裁判文书可以在互联网公布，但有下列情形之一的除外： |
| (1) It involves any national secret, individual privacy or juvenile delinquency; | | （一）涉及国家秘密、个人隐私和未成年人犯罪的； |
| (2) The case is concluded by mediation; | | （二）以调解方式结案的； |
| (3) The party clearly requests the non-issuance of the judicial document on the Internet for justifiable reasons, and public interests are not involved; or | | （三）当事人明确请求不在互联网公布并有正当理由，且不涉及公共利益的； |
| (4) any other circumstance under which it is inappropriate to issue the judicial document on the Internet. | | （四）其他不宜在互联网公布的。 |
| The effective judicial documents rendered by the Supreme People's Court and higher people's courts which have significance for guiding the application of laws shall be issued on the Internet. | | 最高人民法院和高级人民法院具有法律适用指导意义的生效裁判文书应当在互联网公布。 |
| Article 3 Where the judicial document issued by the people's court on the Internet involves the home address, contact information, ID card number, bank account number or any other personal information of the party concerned, or the personal information of the witness or any other participant in the proceedings or the close relative of the party concerned, the judicial document shall be subject to corresponding technical treatment. The contents involving any trade secret or are inappropriate to be released on the Internet shall be subject to corresponding technical treatment. | | 第三条 人民法院在互联网公布裁判文书，对涉及当事人的家庭住址、通讯方式、身份证号码、银行帐号等个人信息，以及证人等诉讼参与人或者当事人近亲属的个人信息的，应当进行相应的技术处理。对涉及商业秘密及其他不宜在互联网公开的内容，应当进行相应的技术处理。 |
| Article 4 The people's court shall indicate in the instructions for the lawsuit the issuance of relevant contents of the judicial document on the Internet, and notify the parties of the matters on the issuance of the judicial document on the Internet when serving upon the judicial document. If the party clearly requests the non-issuance of the judicial document on the Internet, it shall put forward opinions in writing. If the people's court deems upon examination that the reasons are justifiable, it shall not issue the judicial document on the Internet. | | 第四条 人民法院应当在诉讼须知中写明关于在互联网公布裁判文书的相关内容，并在送达裁判文书时告知当事人在互联网公布裁判文书的事宜。当事人明确请求不在互联网公布的，应当书面提出意见。人民法院经审核认为理由正当的，不应在互联网公布。 |
| Article 5 The people's court shall issue a judicial document on the Internet within 30 days after the judicial document becomes effective. | | 第五条 人民法院在互联网公布裁判文书，应当自裁判文书生效之日起三十日内完成。 |
| Article 6 The people's court shall appropriately classify the judicial documents issued on the Internet, and indicate on the catalogue the case type, case number, cause of action, name or title of the parties and other basic information. | | 第六条 人民法院应当对在互联网公布的裁判文书适当分类，并在公布目录上载明案件类型、案号、案由、当事人姓名或名称等基本信息。 |
