The Interim Regulation on Residence Permits, as adopted at the 109th executive meeting of the State Council on October 21, 2015, is hereby issued, and shall come into force on January 1, 2016. 《居住证暂行条例》已经2015年10月21日国务院第109次常务会议通过,现予公布,自2016年1月1日起施行。

Interim Regulation on Residence Permits 居住证暂行条例
Article 1 For the purposes of promoting the sound development of new-type urbanization, enhancing the availability of urban basic public services and conveniences to all permanent residents, protecting the lawful rights and interests of citizens, and promoting social fairness and justice, this Regulation is developed.   第一条 为了促进新型城镇化的健康发展,推进城镇基本公共服务和便利常住人口全覆盖,保障公民合法权益,促进社会公平正义,制定本条例。
Article 2 A citizen who leaves his or her place of permanent residence, resides in another city for more than half a year, and satisfies one of the conditions of having a legal and stable job, having a legal and stable residence, continuously attending school may, under this Regulation, apply for a residence permit.   第二条 公民离开常住户口所在地,到其他城市居住半年以上,符合有合法稳定就业、合法稳定住所、连续就读条件之一的,可以依照本条例的规定申领居住证。
Article 3 A residence permit is a certificate proving that the holder resides in his or her place of residence, enjoys basic public services and conveniences, and applies for permanent residence registration.   第三条 居住证是持证人在居住地居住、作为常住人口享受基本公共服务和便利、申请登记常住户口的证明。
Article 4 A residence permit shall contain the holder's name, gender, nationality, date of birth, citizen identification number, photo, address of registered permanent residence, residence address, issuing authority, and date of issuance.   第四条 居住证登载的内容包括:姓名、性别、民族、出生日期、公民身份号码、本人相片、常住户口所在地住址、居住地住址、证件的签发机关和签发日期。
Article 5 People's governments at and above the county level shall establish and improve mechanisms providing basic public services and conveniences to residence permit holders. The development and reform, education, public security, civil affairs, judicial administration, human resources and social security, housing and urban-rural development, health and family planning, and other relevant departments of the people's governments at and above the county level shall, according to their respective functions and duties, effectively conduct the rights and interests protection, service, and management of residence permit holders.   第五条 县级以上人民政府应当建立健全为居住证持有人提供基本公共服务和便利的机制。县级以上人民政府发展改革、教育、公安、民政、司法行政、人力资源社会保障、住房城乡建设、卫生计生等有关部门应当根据各自职责,做好居住证持有人的权益保障、服务和管理工作。
Article 6 People's governments at and above the county level shall include the work of providing basic public services and conveniences to residence permit holders in national economic and social development planning, improve the financial transfer payment system, and incorporate the funding for basic public services and convenience into their fiscal budgets.   第六条 县级以上人民政府应当将为居住证持有人提供基本公共服务和便利的工作纳入国民经济和社会发展规划,完善财政转移支付制度,将提供基本公共服务和便利所需费用纳入财政预算。
Article 7 Relevant departments of the people's governments at and above the county level shall establish and improve population information databases, classify and improve the labor and employment, education, social security, housing property, credit, health and family planning, marriage, and other information systems, as well as the collection and registration of information on residence permit holders, strengthen the sharing of information on residence permit holders among departments and regions, and provide information support for promoting the transfer and continuation systems for social insurance, housing provident funds, and other aspects and achieving the availability of basic public services to all permanent residents, so as to facilitate residence permit holders' residence in their places of residence.   第七条 县级以上人民政府有关部门应当建立和完善人口信息库,分类完善劳动就业、教育、社会保障、房产、信用、卫生计生、婚姻等信息系统以及居住证持有人信息的采集、登记工作,加强部门之间、地区之间居住证持有人信息的共享,为推进社会保险、住房公积金等转移接续制度,实现基本公共服务常住人口全覆盖提供信息支持,为居住证持有人在居住地居住提供便利。
Article 8 The public security organs shall be responsible for the application acceptance, making, issuance, endorsement, and other certificate management work of residence permits.   第八条 公安机关负责居住证的申领受理、制作、发放、签注等证件管理工作。
Residents' committees, villagers' committees, employers, schools, and housing lessors shall assist in effectively completing the application acceptance, issuance, and other work of residence permits. 居民委员会、村民委员会、用人单位、就读学校以及房屋出租人应当协助做好居住证的申领受理、发放等工作。
Article 9 To apply for a residence permit, a resident shall submit his or her resident identity card, photographs, and evidentiary materials on his or her residence address, employment, and school attendance, among others, to the public security station at his or her place of residence or the community service institution authorized by the public security organ.   第九条 申领居住证,应当向居住地公安派出所或者受公安机关委托的社区服务机构提交本人居民身份证、本人相片以及居住地住址、就业、就读等证明材料。
...... 居住地住址证明包括房屋租赁合同、房屋产权证明文件、购房合同或者房屋出租人、用人单位、就读学校出具的住宿证明等;就业证明包括工商营业执照、劳动合同、用人单位出具的劳动关系证明或者其他能够证明有合法稳定就业的材料等;就读证明包括学生证、就读学校出具的其他能够证明连续就读的材料等。
