| These Opinions are developed for purposes of implementing in depth the spirit of the 18th National Congress of the Communist Party of China ("CPC") and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee and the resolutions of the Fifth Session of the 12th National People's Congress, comprehensively carrying out the overall requirements for the construction of smart courts in the Outline of the National Informatization Development Strategy and the Outline of the 13th Five-Year Plan for the National Informatization , ensuring the accomplishment of the construction tasks of general completion in 2017 and deepening and improvement of information-based people's courts version 3.0 in 2020 proposed in the Five-year Development Plan for Informatization Construction of People's Courts (2016-2020), promoting the modernization of the trial system and capability with informatization, and making efforts to allow the people to feel fairness and justice in each judicial case. | | 为深入贯彻党的十八大和十八届三中、四中、五中、六中全会精神、十二届全国人大五次会议决议，全面落实《国家信息化发展战略纲要》和《“十三五”国家信息化规划》对智慧法院建设的总体要求，确保完成《人民法院信息化建设五年发展规划（2016-2020）》提出的2017年总体建成、2020年深化完善人民法院信息化3.0版的建设任务，以信息化促进审判体系和审判能力现代化，努力让人民群众在每一个司法案件中感受到公平正义，制定本意见。 |
| I. Fully recognizing the significance, objectives and requirements as to accelerating the construction of smart courts | | 一、充分认识加快建设智慧法院的意义、目标和要求 |
| (1) Having a deep understanding of the significance of the construction of smart courts. Smart courts are a form of organization, construction and operation in which people's courts make full use of advanced informatization system to support online handling of all businesses, lawful opennesss of whole process and all-around intelligent services and to realize impartial justice and justice for the people. Accelerating the construction of smart courts is an inevitable requirement of the implementation of the Four-Pronged Comprehensive Strategy and five development concepts, the major content of the national informatization development strategy, and an important measure for people's courts to adapt to the new trend of the information age and come up to people's new expectations. The people's courts at all levels shall, from the perspective of advancing the building of the rule of law of the country and promoting the modernization of the trial system and capability, recognize and promote the construction of smart courts and effectively give play to the important role of advanced science and technology in ensuring the services for the people, adjudication and enforcement, and judicial administration. | | （一）深刻领会建设智慧法院的重大意义。智慧法院是人民法院充分利用先进信息化系统，支持全业务网上办理、全流程依法公开、全方位智能服务，实现公正司法、司法为民的组织、建设和运行形态。加快建设智慧法院是落实“四个全面”战略布局和五大发展理念的必然要求，是国家信息化发展战略的重要内容，是人民法院适应信息化时代新趋势、满足人民群众新期待的重要举措。各级人民法院要从推进国家法治建设、促进审判体系和审判能力现代化的高度，认识和推动智慧法院建设，切实发挥先进科学技术对服务人民群众、服务审判执行、服务司法管理的重要保障作用。 |
| (2) Correctly understanding the work objectives of the construction of smart courts. Construction of smart courts is to develop a networked, transparent and intelligent people's court informatization system, support online handling of all businesses, lawfully and publicly disclose whole-process adjudication and enforcement factors, provide judges, litigation participants, the general public and government departments with all-around intelligent services, make informatization effectively serve adjudication and enforcement, better relate justice to the people, and use advanced informatization to constantly improve the scientific administration of people's courts at all levels. | | （二）正确理解建设智慧法院的工作目标。建设智慧法院，就是要构建网络化、阳光化、智能化的人民法院信息化体系，支持全业务网上办理，全流程审判执行要素依法公开，面向法官、诉讼参与人、社会公众和政务部门提供全方位智能服务，使信息化切实服务审判执行，让司法更加贴近人民群众，用先进信息技术不断提高各级人民法院的科学管理水平。 |
| (3) Accurately grasping the overall requirements for the construction of smart courts. Unified planning and vigorous advancement shall be adhered to, and guided by the five-year development plans for informatization construction issued by the Supreme People's Court and all higher people's courts, based on the informatization standards of people's courts, given the actual circumstances of the informatization construction and development of all regions, all people's courts shall take active actions and practically advance the construction in an orderly manner; integration, sharing, efficiency and smartness shall be adhered to, the capability of online services of various business application programs shall be fully expanded, an effective online-offline connection mechanism shall be established, the integration and connection among court business application programs, courts at all levels, and parties in and from outside courts and the effectiveness of interactive services shall be improved, and various smart service application programs shall be provided as needed; and innovation-driven and safe development shall be adhered to, the research of cutting-edge and key technology shall be strengthened, closely based on the actual circumstances of adjudication and enforcement, the transfer, transformation and application of technology shall be advanced, and the awareness of information security risks and protection in all parts such as planning, building, management and maintenance shall be enhanced in addition, in order to ensure information security while the construction and application of informatization constantly move forward. | | （三）准确把握建设智慧法院的总体要求。坚持统一规划、积极推进，以最高人民法院和各高级人民法院信息化建设五年发展规划为指导，依据人民法院信息化标准，结合各地信息化建设发展实际，各级人民法院主动作为，务实有序推进建设；坚持融合共享、高效智能，充分拓展各类业务应用线上服务能力，建立线上线下有效对接机制，提升法院业务应用、各级法院和法院内外之间的融合贯通、互动服务效能，按需提供各类智能服务应用；坚持创新驱动、安全发展，加强前沿技术和关键技术研究，紧密结合审判执行工作实际，推进技术转移和转化应用，同时提高规划、建设、管理、维护等各环节信息安全风险意识和防护水平，在信息化建设和应用不断发展的同时确保信息安全。 |
| II. Advancing the development of systems and providing a strong basic support of informatization | | 二、推进系统建设，提供坚强的信息化基础支撑 |
| (4) Establishing a whole-factor, intensive information network system. Based on the court private network, mobile private network, external private network, the Internet and secret-related intranet, private, public and secret-related clouding shall be set up, the level of allocation of various infrastructures shall be raised, and information sharing among the networks shall be realized through security-isolated switching techniques. The Internet of Things technology shall be used to further improve the informatization of litigation service halls, enforcement command centers, science and technology courts, long-distance interrogation, long-distance reception of visitors, digital judicial committees, digital meeting rooms, information management centers and other law enforcement and case-handling venues. | | （四）构建全要素集约化信息网络体系。基于法院专网、移动专网、外部专网、互联网和涉密内网，构建专有云、开放云和涉密云，提升各类基础设施配置水平，通过安全隔离交换技术实现网间信息共享。利用物联网技术，进一步提升诉讼服务大厅、执行指挥中心、科技法庭、远程提讯、远程接访、数字审委会、数字化会议室、信息管理中心等执法办案场所的信息化水平。 |
| (5) Establishing an all-business, whole-process integrated application system. Based on various existing application systems, data interfaces shall be opened up, application interfaces shall be integrated, business functions shall be expanded and improved, an internal integration platform integrating adjudication, enforcement, personnel, justice management and other various application systems and an external service platform integrating judicial disclosure, litigation services, communication and publicity and other various application systems shall be set up, the internal integration platform and the external service platform shall be connected, so as to form a "one-stop" comprehensive service system, promote the integration of platform resources, business coordination and use bymultiple parties, and realize seamless connection between the online and offline business handling. | | （五）构建全业务全流程融合应用体系。以现有各类应用系统为基础，打通数据接口、集成应用界面、拓展和完善业务功能，构建融合审判、执行、人事、司法管理等各类应用系统的内部融合平台，集成司法公开、诉讼服务、沟通宣传等各类应用系统的外部服务平台，贯通内部融合平台和外部服务平台，形成“一站式”综合服务体系，推动平台资源整合、业务协同和多方利用，实现线上线下业务办理无缝对接。 |
| (6) Developing an all-around information resource and service system. The national judicial adjudication information resource bank shall be improved to realize the full coverage of adjudication and enforcement, judicial personnel, judicial affairs, judicial research, informatization management and needed external data; a data centralized management and quality assurance mechanism shall be established to effectively ensure data sources, attach importance to data quality and realize quick collection, complete necessary elements and high quality; a data sharing and exchange platform shall be established to realize sharing and exchange of data and business coordination among courts and between courts and the outside world; a big data analysis system shall be developed to research and develop intelligent services in such aspects as judicial disclosure, litigation services, decision making support, monitoring and early warning, judicial research and work assessment; and a knowledge map orienting to case docketing, trial, judgment, enforcement and other court businesses shall be explored and made, and an artificial intelligence perceived interaction system orienting to various users and an artificial intelligence assisted decision making system centering on knowledge shall be established. | | （六）构建全方位信息资源及服务体系。完善国家司法审判信息资源库，实现审判执行、司法人事、司法政务、司法研究、信息化管理和所需外部数据的全面覆盖；建立数据集中管理和质量保障机制，狠抓数据源头，重视数据质量，做到汇聚快、要素全、质量高；建设数据共享交换平台，实现法院之间和法院与外部之间的数据共享交换和业务协同；建立大数据分析系统，研发面向司法公开、诉讼服务、决策支持、监控预警、司法研究和工作评估等方面的智能服务；探索建立面向立案、审理、裁判、执行等法院业务的知识图谱，构建面向各类用户的人工智能感知交互体系和以知识为中心的人工智能辅助决策体系。 |
