Notice of the Ministry of Culture on Regulating the Operations of Online Games and Strengthening Interim and Ex Post Regulation 

文化部關于規範網絡游戲運營加強事中事後監管工作的通知

The departments (bureaus) of culture of all provinces, autonomous regions and municipalities directly under the Central Government, the Bureau of Culture, Radio and Television of the Xinjiang Production and Construction Corps, and the general brigades of cultural market (comprehensive) administrative law enforcement of the Tibet Autonomous Region, and the Beijing, Tianjin, Shanghai and Chongqing municipalities directly under the Central Government, 各省、自治區、直轄市文化廳(局),新疆生產建設兵團文化廣播電視局,西藏自治區、北京市、天津市、上海市、重慶市文化市場(綜合)行政執法總隊:
In recent years, China's online game industry has witnessed rapid development, playing a positive role in promoting the development of the online cultural market, enriching people's cultural and recreational activities, expanding and guiding cultural consumption. However, a number of problems found in business operators of online games have become increasingly obvious, such as unclear division of operational responsibilities, using covert means to induce consumption, ineffective protection of user rights and interests, among others. For the purpose of further regulating the order of the online game market, protecting the legitimate rights and interests of consumers and enterprises, and promoting the healthy and orderly development of the online game industry, according to the Administrative Measures for Internet Information Services, the Interim Provisions on the Administration of Internet Culture, the Interim Measures for the Administration of Online Games and other relevant laws and regulations, the relevant issues are hereby notified as follows: 近年來,我國網絡游戲行業發展迅速,在促進網絡文化市場發展,豐富人民群眾文化娛樂活動,擴大和引導文化消費等方面發揮了積極作用。但是,網絡游戲經營單位運營責任不清、變相誘導消費、用戶權益保護不力等問題也日益突出。為進一步規範網絡游戲市場秩序,保護消費者和企業合法權益,促進網絡游戲行業健康有序發展,根據《互聯網信息服務管理辦法》、《互聯網文化管理暫行規定》、《網絡游戲管理暫行辦法》等法律法規,現就有關事項通知如下:
1. The scope of operations of online games shall be clarified.   一、明確網絡游戲運營範圍
(1) The operations of online games shall mean that an enterprise engaging in online games operations provides the public with online gaming products and services by making online games available for user registration, making online games available for download, among others, and obtains profits by charging fees from online game users or by means of e-commerce, advertising, sponsorship, among others. (一)網絡游戲運營是指網絡游戲運營企業以開放網絡游戲用戶注冊或者提供網絡游戲下載等方式向公眾提供網絡游戲產品和服務,並通過向網絡游戲用戶收費或者以電子商務、廣告、贊助等方式獲取利益的行為。
(2) Technical testing of online games conducted by an enterprise engaging in online games operations by means such as making the online games available for user registration, opening the fee-charging system of the online games, providing client-end software with direct server registration and login functions, among others, shall belong to the operations of online games. (二)網絡游戲運營企業通過開放用戶注冊、開放網絡游戲收費系統、提供可直接注冊登陸服務器的客戶端軟件等方式開展的網絡游戲技術測試,屬于網絡游戲運營。
(3) Where an enterprise engaging in online games operations provides user systems, fee-charging systems, program downloading, publicity and promotion and other services for the online game products of another operating enterprise and participates in sharing the revenue from the operations of online games, the first-mentioned enterprise shall be deemed as engaging in joint operations, and shall bear corresponding responsibilities. (三)網絡游戲運營企業為其他運營企業的網絡游戲產品提供用戶系統、收費系統、程序下載及宣傳推廣等服務,並參與網絡游戲運營收益分成,屬于聯合運營行為,應當承擔相應責任。
2. Services for distributing the virtual props of online games shall be standardized.   二、規範網絡游戲虛擬道具發行服務
(4) Virtual props distributed by enterprises engaging in online games operations that fall under the following circumstances shall be managed according to the provisions on virtual currencies of online games: props are purchased by users directly with legal tender, by using the virtual currencies of online games or by exchanging the virtual currencies of online games according to a certain percentage; and, props enable users to directly exchange for other virtual props or value-added service functions in online games. (四)網絡游戲運營企業發行的,用戶以法定貨幣直接購買、使用網絡游戲虛擬貨幣購買或者按一定兌換比例獲得,且具備直接兌換游戲內其他虛擬道具或者增值服務功能的虛擬道具,按照網絡游戲虛擬貨幣有關規定進行管理。
(5) An enterprise engaging in online games operations that intends to change the version of an online game, increase the types of virtual props, adjust the functions and use period of virtual props or hold temporary activities shall, through the official homepage of the online game or in eye-catching locations within the online game, promptly make public the name, functions, price, exchange rate and expiration date of each virtual prop involved, the corresponding ways for gifting, transferring or trading the virtual props and other relevant information. (五)網絡游戲運營企業變更網絡游戲版本、增加虛擬道具種類、調整虛擬道具功能和使用期限,以及舉辦臨時性活動時,應當及時在該游戲的官方主頁或者游戲內顯著位置公示所涉及虛擬道具的名稱、功能、定價、兌換比例、有效期限以及相應的贈予、轉讓或者交易方式等信息。
(6) An enterprise engaging in online games operations that provides virtual props and value-added services of an online game by random selection shall not require users to participate by way of directly investing legal tender or the virtual currency of the online game. The said enterprise shall promptly announce the name, performance, contents, quantity and probability of random selection or combination of each of the virtual props and value-added services that may be selected at random or combined on the official website of the online game or its web page for random selection. The relevant information on random selection as publicly announced shall be true and valid. (六)網絡游戲運營企業采取隨機抽取方式提供虛擬道具和增值服務的,不得要求用戶以直接投入法定貨幣或者網絡游戲虛擬貨幣的方式參與。網絡游戲運營企業應當及時在該游戲的官方網站或者隨機抽取頁面公示可能抽取或者合成的所有虛擬道具和增值服務的名稱、性能、內容、數量及抽取或者合成概率。公示的隨機抽取相關信息應當真實有效。
(7) An enterprise engaging in online games operations shall publish the random selection results of participating users on the official website of an online game or in eye-catching locations within the online game, and keep relevant records for at least 90 days for future inquiries by relevant departments. When publishing the results of random selection, the said enterprise shall take certain measures to protect user privacy. (七)網絡游戲運營企業應當在游戲的官方網站或者游戲內顯著位置公布參與用戶的隨機抽取結果,並保存相關記錄以備相關部門查詢,記錄保存時間不得少于90日。公布隨機抽取結果時,應當采取一定措施保護用戶隱私。
(8) When providing the virtual props and value-added services of an online game by way of random selection, an enterprise engaging in online games operations shall, at the same time, provide users with other means to obtain virtual props and value-added services of the same performance, such as by exchanging other virtual props, using the virtual currency of the online game to directly purchase virtual props, etc. (八)網絡游戲運營企業以隨機抽取方式提供虛擬道具和增值服務時,應當同時為用戶提供其他虛擬道具兌換、使用網絡游戲虛擬貨幣直接購買等其他獲得相同性能虛擬道具和增值服務的方式。
