Notice by the Ministry of Human Resources and Social Security of Issuing the Interim Measures for the Administration of the “Blacklist” of Defaulters on the Wages of Rural Migrant Workers 

人力资源社会保障部关于印发《拖欠农民工工资“黑名单”管理暂行办法》的通知

The human resources and social security departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government, and the Xinjiang Production and Construction Corps: 各省、自治区、直辖市及新疆生产建设兵团人力资源社会保障厅(局):
The Interim Measures for the Administration of the “Blacklist” of Defaulters on the Wages of Rural Migrant Workers, as deliberated and adopted at the 134th executive meeting, are hereby issued for your compliance and implementation. 《拖欠农民工工资“黑名单”管理暂行办法》已经第134次部务会审议通过,现印发给你们,请遵照执行。

Interim Measures for the Administration of the “Blacklist” of Defaulters on the Wages of Rural Migrant Workers 拖欠农民工工资“黑名单”管理暂行办法
Article 1 For purposes of regulating the administration of the “blacklist” of defaulters on the wages of rural migrant workers, strengthening the punishment of illegal and dishonest employers defaulting on wages, and protecting the lawful rights and interests of workers, these Measures are developed according to the Interim Regulation on Enterprise Information Disclosure, the Guiding Opinions of the State Council on Establishing and Improving the System of Joint Incentive for Keeping Faith and Joint Punishment for Losing Faith and Accelerating the Advancement of the Development of Social Honesty (No. 33 [2016], State Council), and the Opinions of the General Office of the State Council on Comprehensively Governing the Issues of Migrant Workers' Wage Arrears (No. 1 [2016], General Office of the State Council).   第一条 为规范拖欠农民工工资“黑名单”管理工作,加强对拖欠工资违法失信用人单位的惩戒,维护劳动者合法权益,根据《企业信息公示暂行条例》、《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见》(国发〔2016〕33号)、《国务院办公厅关于全面治理拖欠农民工工资问题的意见》(国办发〔2016〕1号),制定本办法。
Article 2 For the purpose of these Measures, “blacklist” of defaulters on the wages of rural migrant workers (hereinafter referred to as “blacklist” of defaulters on wages) means employers and their legal representatives, and other responsible persons that fall under the circumstances of defaulting on wages as prescribed in Article 5 of these Measures in violation of the laws, regulations and rules of the state on payment of wages.   第二条 本办法所称拖欠农民工工资“黑名单”(以下简称拖欠工资“黑名单”),是指违反国家工资支付法律法规规章规定,存在本办法第五条所列拖欠工资情形的用人单位及其法定代表人、其他责任人。
Article 3 The Ministry of Human Resources and Social Security shall be responsible for directing and supervising the administration of the “blacklist” of defaulters on wages across the country.   第三条 人力资源社会保障部负责指导监督全国拖欠工资“黑名单”管理工作。
...... 省、自治区、直辖市人力资源社会保障行政部门负责指导监督本行政区域拖欠工资“黑名单”管理工作,每半年向人力资源社会保障部报送本行政区域的拖欠工资“黑名单”。
