国家保密局关于修改《国家秘密载体印制资质管理办法》、《涉密信息系统集成资质管理办法》的通知

The state secrets protection administrations of all provinces, autonomous regions, and municipalities directly under the Central Government; the Administration of State Secrets Protection of Xinjiang Production and Construction Corps; offices of secrets protection committees of the CPC Central Committee and all ministries and commissions of the State Council; Office of Secrets Protection Committee of the Central Military Commission; and offices of secrets protection committees of all people's organizations: 各省、自治区、直辖市保密局,新疆生产建设兵团保密局,中央和国家机关各部委保密委员会办公室,中央军委保密委员会办公室,各人民团体保密委员会办公室:
The amended content in the Measures for the Administration of Qualifications for the Printing and Production of State Secret Carriers (No. 7 [2012], National Administration of State Secrets Protection) and the Measures for the Administration of Qualifications for the Integration of Secret-Related Information Systems (No. 7 [2013], National Administration of State Secrets Protection) and the amended documents are hereby issued to you and shall come into force on the date of issuance. 现将《国家秘密载体印制资质管理办法》(国保发〔2012〕7号)、《涉密信息系统集成资质管理办法》(国保发〔2013〕7号)修改内容和修改后的文件印发你们,自印发之日起施行。

Amended Content in the Measures for the Administration of Qualifications for the Printing and Production of State Secret Carriers 国家秘密载体印制资质管理办法》修改内容
I. Article 1 of the Administration Measures is amended to read: “......, these Measures are developed in accordance with the Law of the People's Republic of China on Guarding State Secrets, the Administrative License Law of the People's Republic of China, the Law of the People's Republic Of China on Administrative Penalty, the Regulation on the Implementation of the Law of the People's Republic of China on Guarding State Secrets and other relevant laws and regulations.”   一、将《管理办法》第一条修改为:“......,根据《中华人民共和国保守国家秘密法》、《中华人民共和国行政许可法》、《中华人民共和国行政处罚法》、《中华人民共和国保守国家秘密法实施条例》等有关法律法规,制定本办法。”
II. Article 5 of the Administration Measures is amended to read: “Qualifications for the printing and production of state secret carriers shall include the digital processing of confidential documents, national unified examination papers, classified security paper certificates, secret-related optical and electromagnetic media and confidential archives, and other businesses licensed by the secrecy administrative department of the state.”   二、将《管理办法》第五条修改为:“国家秘密载体印制资质包括涉密文件资料、国家统一考试试卷、涉密防伪票据证书、涉密光电磁介质、涉密档案数字化加工,以及国家保密行政管理部门许可的其他业务。”
III. Article 7 of the Administration Measures is amended to read: “The administration of qualifications for the printing and production of state secret carriers shall follow the principles of legal administration, security and secrecy, scientific development, and fairness and impartiality.”   三、将《管理办法》第七条修改为:“国家秘密载体印制资质管理应当遵循依法管理、安全保密、科学发展、公平公正的原则。”
IV. Subparagraph (4) of Article 9 of the Administration Measures is amended to read: “It has engaged in the corresponding printing and production business for three years or more, and has not been punished for violating secrecy laws or regulations within the past year.”   四、将《管理办法》第九条第四项修改为:“从事相应印制业务三年以上,一年内未因违反保密法律法规受到处罚。”
V. Paragraph 2 of Article 16 of the Administration Measures is amended to read: “A secrecy administrative department of a province, autonomous region, or municipality directly under the Central Government or a secrecy administrative department of a districted city or autonomous prefecture shall, after receiving an application, complete the preliminary examination thereof within five days, and submit it to the relevant secrecy administrative department according to its functions if the application materials are complete or are in the required forms; and, if the application materials are incomplete or are not in the required forms, it shall return the application materials and notify the applicant entity of all the required supplements and corrections at one time.”   五、将《管理办法》第十六条第二款修改为:“省、自治区、直辖市保密行政管理部门和设区的市、自治州保密行政管理部门收到申请材料后,应当在五日内完成材料初审,申请材料齐全且符合法定形式的,按照权限报送有关保密行政管理部门;申请材料不齐全或者不符合法定形式的,退回申请材料,一次告知申请单位补正。”
VI. Article 17 of the Administration Measures is amended to read: “A secrecy administrative department shall, after receiving an application, accept the application and issue a notice of acceptance if the applicant entity meets the requirements; and if the application fails to meet the requirements, the secrecy administrative department shall make a decision not to accept the application, and notify the applicant entity in writing and give the reasons therefor.”   六、将《管理办法》第十七条修改为:“保密行政管理部门收到申请材料后,申请单位符合条件的,应当受理并发出受理通知书;不符合条件的,保密行政管理部门应当作出不予受理的决定,书面告知申请单位并说明理由。”
VII. Article 18 of the Administration Measures is amended to read: “Where the application of an applicant entity is accepted, the secrecy administrative department shall assign two or more staff members and one or more reviewing experts to inspect the secrecy rules, secrecy office, secrecy supervision and administration, secrecy technology protection, and professional competency in the business involving state secrets, among others, and issue an on-site examination opinion.” Paragraph 2 is added: “The full score of on-site examination is 100 points. If the score is 80 points or more, it shall be deemed that the applicant entity has passed the on-site examination; and if the score is less than 80 points, it shall deemed that it has failed to pass the on-site examination. If the applicant entity has passed the on-site examination, it shall make rectifications according to the on-site examination opinion; otherwise, the secrecy administrative department shall make a decision not to approve its application.”   七、将《管理办法》第十八条修改为:“对受理的申请单位,保密行政管理部门应当指派两名以上工作人员和一名以上审查专家对其保密制度、保密工作机构、保密监督管理、保密技术防护以及从事涉密业务的专业能力等情况进行检查,出具现场审查意见。”增加第二款:“现场审查满分为100分,达到80分(含)以上为现场审查通过,80分(不含)以下为现场审查不通过。通过现场审查的,申请单位应当按照现场审查意见整改;未通过现场审查的,保密行政管理部门应当作出不予许可的决定。”
VIII. Subparagraph (1) of Article 19 of the Administration Measures is amended to read: “Notifying the applicant entity of time when the on-site examination is to be conducted five days in advance.”   八、将《管理办法》第十九条第一项修改为:“提前五日通知申请单位现场审查时间;”
IX. One article is added as Article 20 of the Administration Measures: “Where is found during the on-site examination any clue to a case showing the applicant entity is suspected of divulging any state secrets, the personnel qualified for law enforcement shall take registration and preservation measures for relevant facilities, equipment and carriers, among others, according to the jurisdiction and where it is necessary.”   九、增加一条,作为《管理办法》第二十条:“现场审查中发现申请单位存在涉嫌泄露国家秘密的案件线索,应当按照管辖权限,根据工作需要,由具备执法资格的人员对有关设施、设备、载体等采取登记保存措施。”
X. One article is added as Article 21 of the Administration Measures: “Where the applicant entity falls under any of the following circumstances, the secrecy administrative department shall terminate the examination: (1) It refuses to accept the on-site examination as required. (2) It is found during the on-site examination that its secrecy organization, site, facility, or equipment used for the printing and production of state secret carriers or any other circumstance is inconsistent with the application materials. (3) It fails to complete the rectifications according to the on-site examination opinion. (4) It affects the fair and impartial implementation of the examination by offering bribes, requesting for help or other illicit means. (5) It conceals the relevant circumstances or providing false materials. (6) It commits any violation of secrecy laws or regulations. For an applicant entity the examination of which is terminated, the secrecy administrative department shall make a decision not to approve its application.”   十、增加一条,作为《管理办法》第二十一条:“申请单位具有下列情形之一的,保密行政管理部门应当终止审查:(一)拒绝按要求接受现场审查的;(二)现场审查中发现保密组织机构、用于国家秘密印制业务的场所、设施、设备等情况与申请材料不符的;(三)未按现场审查意见完成整改的;(四)采取贿赂、请托等不正当手段,影响审查工作公平公正进行的;(五)隐瞒有关情况或者提供虚假材料的;(六)存在违反保密法律法规行为的。对终止审查的申请单位,保密行政管理部门应当作出不予许可的决定。”
XI. One article is added as Article 22 of the Administration Measures: “A secrecy administrative department may, where it is necessary, organize a special organization to assist in application acceptance and on-site examination.”   十一、增加一条,作为《管理办法》第二十二条:“保密行政管理部门根据工作需要,可以组织专门机构,协助开展申请受理、现场审查等工作。”
XII. Article 20 of the Administration Measures is renumbered as Article 23 and amended to read: “A secrecy administrative department shall, based on the examination result, decide whether to approve an application or not.” Paragraph 2 is added: “Where a secrecy administrative department makes a written decision on refusing to approve an application, it shall give the reasons therefor and inform the applicant entity of the relevant rights.”   十二、将《管理办法》第二十条改为第二十三条,修改为:“保密行政管理部门应当根据审查情况,作出是否准予许可的决定。”增加第二款:“保密行政管理部门作出不予许可的书面决定的,应当说明理由并告知申请单位相关权利。”
XIII. One article is added as Article 24 of the Administration Measures: “A secrecy administrative department shall, within 20 days of acceptance of an application, make a decision on whether to approve the application of the applicant entity or not. If a decision cannot be made within 20 days, the period may be extended for ten days with the approval of the person in charge of this administrative organ, and the applicant entity shall be informed of the reason for the extension. The time needed by a secrecy administrative department for organizing expert review and appraisal shall not be included in the time limit for administrative licensing.”   十三、增加一条,作为《管理办法》第二十四条:“保密行政管理部门应当自受理申请之日起二十日内,对申请单位作出准予许可或者不予许可的决定。二十日内不能作出决定的,经本行政机关负责人批准,可以延长十日,并应当将延长期限的理由告知申请单位。保密行政管理部门组织专家评审、鉴定所需时间不计入行政许可时限。”
XIV. Article 22 of the Administration Measures is renumbered as Article 26 and amended to read: “Where a secrecy administrative department makes a decision to approve the application of an applicant entity, it shall, within ten days from the date when the decision is made, issue a Certificate of Qualifications for the Printing and Production of State Secret Carriers (hereinafter referred to as the “Qualification Certificate”).” Paragraph 2 is deleted, and paragraph 3 is amended to read: “The format of a Qualification Certificate shall be developed by the secrecy administrative department of the state in a uniform manner.”   十四、将《管理办法》第二十二条改为第二十六条,修改为:“保密行政管理部门对申请单位作出准予许可的决定的,自作出决定之日起十日内向申请单位颁发《国家秘密载体印制资质证书》(以下简称《资质证书》)。”删除第二款,并将第三款修改为:“《资质证书》样式由国家保密行政管理部门统一制作。”
XV. Article 23 of the Administration Measures is renumbered as Article 27 and amended to read: “A Qualification Certificate shall be valid for three years, unless it is otherwise provided for by the secrecy administrative department.” Paragraph 2 is added: “Whoever needs to continue to engage in the printing and production of state secret carriers after the expiration of the Qualification Certificate shall file a qualification application with the secrecy administrative department within 30 days before the expiration, and shall conclude no new contract on the printing and production of state secret carriers before the application is approved by the secrecy administrative department after the expiration of the Qualification Certificate.”   十五、将《管理办法》第二十三条改为第二十七条,修改为:“《资质证书》有效期为三年,保密行政管理部门另有规定的,依照其规定。”增加第二款:“《资质证书》有效期满,需要继续从事国家秘密载体印制业务的,应当在有效期届满三十日前向保密行政管理部门提出资质申请,有效期满且申请未经保密行政管理部门准予许可前,不得签订新的国家秘密载体印制业务合同。”
XVI. Article 24 of the Administration Measures is renumbered as Article 28 and amended to read: “A decision to approve, cancel, revoke, withdraw or suspend a qualification shall be issued by a secrecy administrative department within a certain scope.”   十六、将《管理办法》第二十四条改为第二十八条,修改为:“作出准予许可、注销、吊销、撤销和暂停资质的决定,由保密行政管理部门在一定范围内予以发布。”
XVII. Article 31 of the Administration Measures is renumbered as Article 35 and amended to read: “Where any of the following matters of a qualified entity changes, it shall be reported to the secrecy administrative department before the change is effected: (1) Registered capital or equity structure; (2) Controlling shareholder or actual controller; (3) Entity nature or affiliation; (4) Place for the printing and producing of state secret carriers.” Paragraph 2 is added: “A secrecy administrative department shall examine the matters to be changed by a qualified entity, and the matters that have passed the examination shall be changed by the qualified entity as matters examined and approved, and the situation report shall be submitted within ten days after the completion of the change.” Paragraph 3 is added: “In case of change of the controlling shareholder or actual controller, entity nature or affiliation of a qualified entity, the place used for the printing and production of state secret carriers or any other matter, the secrecy administrative department shall organize on-site examination.”   十七、将《管理办法》第三十一条修改第三十五条,修改为:“资质单位发生下列事项变更的,应当在变更前向保密行政管理部门报告:(一)注册资本或者股权结构;(二)控股股东或者实际控制人;(三)单位性质或者隶属关系;(四)用于国家秘密载体印制业务的场所。”增加第二款:“保密行政管理部门应当对资质单位变更事项进行审查,通过审查的,资质单位应当按照审定事项实施变更,并在变更完成后十日内提交情况报告。”增加第三款:“资质单位发生控股股东或者实际控制人、单位性质或者隶属关系、用于国家秘密载体印制业务的场所等事项变更的,保密行政管理部门应当组织现场审查。”
XVIII. One article is added as Article 36 of the Administration Measures: “Where any of the following matters of a qualified enterprise changes, it shall be reported to the secrecy administrative department within 10 days after the change: (1) Entity name; (2) Registered address or business address; (3) Business scope; (4) Legal representative, any member of the board of directors (supervisory board) or any senior executive. If the qualified entity needs to have the Qualification Certificate replaced after completing the change, the secrecy administrative department shall issue a new one.”   十八、增加一条,作为《管理办法》第三十六条:“资质单位发生下列事项变更的,应当在变更后十日内向保密行政管理部门报告:(一)单位名称;(二)注册地址或者经营地址;(三)经营范围;(四)法定代表人、董(监)事会人员或者高级管理人员。资质单位变更完成后需换发《资质证书》的,由保密行政管理部门重新颁发。”
XIX. Article 32 of the Administration Measures is renumbered as Article 37 and amended to read: “Where a qualified entity falls under any of the following circumstances, the secrecy administrative department shall order it to make rectifications within 20 days, and impose a punishment of suspending its qualification for not less than six months but not more than 12 months if the entity fails to make rectifications during the specified period or to meet the requirements after making rectifications: (1) It conducts secret-related business in cooperation with any other qualified entity in the aspect of secrets protection without the written approval of the entrusting party to the secret-related business. (2) It undertakes the state secret carrier printing and production business beyond the licensed business scope or beyond the administrative region without approval. (3) It fails to report in a timely manner the change of any matter that shall be reported. (4) It fails to submit the annual self-examination and self-assessment report as required. (5) It fails to satisfy the secrecy standards and has the hidden risk of leakage of secrets.”   十九、将《管理办法》第三十二条改为第三十七条,修改为:“资质单位具有下列情形之一的,保密行政管理部门应当责令其在二十日内完成整改,逾期不改或者整改后仍不符合要求的,给予六个月以上十二个月以下暂停资质的处罚:(一)未经涉密业务委托方书面同意,擅自将涉密业务与其他涉密资质单位合作开展的;(二)超出许可的业务范围,或者未经批准超出行政区域承接国家秘密载体印制业务的;(三)发生需要报告的事项变更,未及时报告的;(四)未按规定提交年度自查自评报告的;(五)不符合保密标准,存在泄密隐患的。”
XX. One article is added as Article 38 of the Administration Measures: “If a qualified entity fails under any of the following circumstances, the secrecy administrative department shall revoke its qualification: (1) It alters, sells, rents or lends the Qualification Certificate or forges or illegally transfers its Qualification Certificate by other means; (2) It subcontracts the printing and production of state secret carriers to an entity without corresponding qualification; (3) It fails to report in a timely manner when finding that a state secret has been or may be divulged; (4) It no longer meets the application requirements; (5) It refuses to accept secrecy inspection; (6) It undertakes any new business relating to state secret carrier printing and production during the period when its qualification is suspended;. (7) It still fails to meet the requirements of secrecy standards after the suspension period expires; (8) A secret leakage case occurs; or (9) It otherwise violates secrecy laws or regulations.”   二十、增加一条,作为《管理办法》第三十八条:“资质单位具有下列情形之一的,保密行政管理部门应当吊销其资质:(一)涂改、出卖、出租、出借《资质证书》,或者以其他方式伪造、非法转让《资质证书》的;(二)将国家秘密载体印制业务分包或者转包给无相应涉密资质单位的;(三)发现国家秘密已经泄露或者可能泄露,未及时报告的;(四)不再符合申请条件的;(五)拒绝接受保密检查的;(六)资质暂停期间,承接新的国家秘密载体印制业务的;(七)资质暂停期满,仍不符合保密标准要求的;(八)发生泄密案件的;(九)其他违反保密法律法规的行为。”
XXI. Article 33 of the Administration Measures is renumbered as Article 39 and amended to read: “Where a qualified entity falls under any of the following circumstances, the secrecy administrative department shall cancel its qualification: (1) The validity period of the Qualification Certificate fails to be extended upon expiration; (2) The legal person status is terminated according to the law; (3) It voluntarily applies for qualification cancellation; or (4) Any other circumstance that the qualification shall be cancelled according to laws and regulations.   二十一、将《管理办法》第三十三条改为第三十九条,修改为:“资质单位具有以下情形之一的,保密行政管理部门应当注销其资质:(一)《资质证书》有效期届满未延续的;(二)法人资格依法终止的;(三)主动申请注销资质的;(四)法律、法规规定应当注销资质的其他情形。”
XXII. One article is added as Article 40 of the Administration Measures: “Where any qualified entity obtains any qualification by fraud, bribery, or any other illegal means, the secrecy administrative department shall withdraw its qualification. It may not apply for the qualification again within three years from the date when its qualification is withdrawn.”   二十二、增加一条,作为《管理办法》第四十条:“资质单位采取欺骗、贿赂等不正当手段取得资质的,保密行政管理部门应当撤销其资质。自撤销之日起,三年内不得再次申请。”
XXIII. Article 34 of the Administration Measures is renumbered as Article 41 and amended to read: “An entity that has its qualification revoked, cancelled or withdrawn shall not conclude a new contract on the printing and production of state secret carriers from the date when the decision is made. If a valid contract has been concluded before the date when the decision of revocation, cancellation or withdrawal is made, the printing and production of state secret carriers may continue to be completed on the premise of ensuring security and secrecy.”   二十三、将《管理办法》第三十四条改为第四十一条,修改为:“被吊销、注销或者撤销资质的单位,自作出决定之日起,不得签订新的国家秘密载体印制业务合同。在作出吊销、注销或者撤销的决定之日前已签订有效合同的,在确保安全保密的情况下可以继续完成国家秘密载体印制业务。”
XXIV. Article 35 of the Administration Measures is renumbered as Article 42 and amended to read: “Where a qualified entity violates these Measures, it shall be dealt with in accordance with the relevant provisions of these Measures; and where it divulges any state secrets, which constitutes a crime, it shall be held criminally liable according to law.”   二十四、将《管理办法》第三十五条改为第四十二条,修改为:“资质单位违反本办法的,依照本办法有关规定处理;泄露国家秘密构成犯罪的,依法追究刑事责任。”
XXV. One article is added as Article 43: “Where an applicant entity conceals relevant information or provides false materials, the secrecy administrative department shall make a decision not to accept or not to approve its application, and it may not file any application within one year from the date when the secrecy administrative department decides not to accept or not to approve its application.”   二十五、增加一条,作为第四十三条:“申请单位隐瞒有关情况或者提供虚假材料的,保密行政管理部门应当作出不予受理或者不予许可的决定,自不予受理或者不予许可之日起,一年内不得再次申请。”
XXVI. Article 38 of the Administration Measures is renumbered as Article 46 and amended to read: “If an applicant entity or qualified entity refuses to accept the decision made by a secrecy administrative department, it may apply for administrative reconsideration or file an administrative lawsuit according to law.”   二十六、将《管理办法》第三十八条改为第四十六条,修改为:“申请单位或者资质单位对保密行政管理部门作出的决定不服的,可以依法申请行政复议或者提起行政诉讼。”
XXVII. One article as Article 49 of the Administration Measures: “The time limit for implementing administrative licensing as prescribed in these Measures shall be calculated by working days, excluding statutory holidays.”   二十七、增加一条,作为《管理办法》第四十九条:“本办法规定的实施行政许可的期限以工作日计算,不含法定节假日。”
Measures for the Administration of Qualifications for the Printing and Production of State Secret Carriers 国家秘密载体印制资质管理办法
Chapter I General Provisions 

第一章 总 则

Article 1 For the purposes of strengthening the administration of qualifications for the printing and production of state secret carriers and ensuring the security of state secrets, these Measures are developed in accordance with the Law of the People's Republic of China on Guarding State Secrets, the Administrative License Law of the People's Republic of China, the Law of the People's Republic Of China on Administrative Penalty, the Regulation on the Implementation of the Law of the People's Republic of China on Guarding State Secrets and other relevant laws and regulations.   第一条 为加强国家秘密载体印制资质管理,确保国家秘密安全,根据《中华人民共和国保守国家秘密法》、《中华人民共和国行政许可法》、《中华人民共和国行政处罚法》、《中华人民共和国保守国家秘密法实施条例》等有关法律法规,制定本办法。
Article 2 For the purpose of these Measures, “state secret carriers” means the paper media, optical media, electromagnetic media and other various articles that record state secret information in the forms of words, data, symbols, graphics, images, and sound, among others.   第二条 本办法所称国家秘密载体,是指以文字、数据、符号、图形、图像、声音等方式记载国家秘密信息的纸介质、光介质、电磁介质等各类物品。
“Printing and production of state secret carriers” means the production of state secret carriers by means of printing and reproducing, among others. 国家秘密载体印制,是指以印刷、复制等方式制作国家秘密载体的行为。
Article 3 The production and operation enterprises engaging in the printing and production of state secret carriers shall obtain qualifications for the printing and production of state secret carriers in accordance with these Measures.   第三条 从事国家秘密载体印制业务的生产经营性企业事业单位应当依照本办法,取得国家秘密载体印制资质。
State organs and entities involving state secrets (hereinafter referred to as “organs and entities”) that entrust the printing and production of state secret carriers shall select the entities that have the qualifications for the printing and production of state secret carriers (hereinafter referred to as “qualified entities”). 国家机关和涉及国家秘密的单位(以下简称机关、单位)委托印制国家秘密载体,应当选择具有国家秘密载体印制资质的单位(以下简称资质单位)。
Article 4 Qualifications for the printing and production of state secret carriers shall be subject to categorized and graded administration. Qualified entities of different categories and grades shall engage in the printing and production of state secret carriers within the specified scopes.   第四条 国家秘密载体印制资质实行分类分级管理。不同类别、等级的资质单位应当在规定的范围内从事国家秘密载体印制业务。
Article 5 Qualifications for the printing and production of state secret carriers shall include the digital processing of confidential documents, national unified examination papers, classified security paper certificates, secret-related optical and electromagnetic media and confidential archives, and other business licensed by the secrecy administrative department of the state.   第五条 国家秘密载体印制资质包括涉密文件资料、国家统一考试试卷、涉密防伪票据证书、涉密光电磁介质、涉密档案数字化加工,以及国家保密行政管理部门许可的其他业务。
Article 6 Qualifications for the printing and production of state secret carriers shall be divided into Grade A and Grade B.   第六条 国家秘密载体印制资质分为甲级和乙级两个等级。
Qualified entities of Grade A may undertake the printing and production of top secret, secret, confidential state secret carriers nationwide; and qualified entities of Grade B may undertake the printing and production of secret and confidential state secret carriers within the administrative regions of provinces, autonomous regions, and municipalities directly under the Central Government at the places of industrial and commercial registration. Where a qualified entity of Grade B undertakes the printing and production of state secret carriers across provinces, autonomous regions, or municipalities directly under the Central Government, it shall be approved by the secrecy administrative department of the province, autonomous region, or municipality directly under the Central Government at the place where the organ or entity entrusting the printing and production business is located. 甲级资质单位可以在全国范围内承担绝密级、机密级、秘密级国家秘密载体印制业务;乙级资质单位可以在工商注册地省、自治区、直辖市行政区域内承担机密级、秘密级国家秘密载体印制业务。乙级资质单位跨省、自治区、直辖市承接国家秘密载体印制业务的,应当经委托印制业务的机关、单位所在地省、自治区、直辖市保密行政管理部门批准。
Article 7 The administration of qualifications for the printing and production of state secret carriers shall follow the principles of legal administration, security and secrecy, scientific development, and fairness and impartiality.   第七条 国家秘密载体印制资质管理应当遵循依法管理、安全保密、科学发展、公平公正的原则。
Article 8 The secrecy administrative department of the state shall take charge of the administration of qualifications for the printing and production of state secret carriers nationwide.   第八条 国家保密行政管理部门主管全国国家秘密载体印制资质管理工作。
The secrecy administrative departments of all provinces, autonomous regions, and municipalities directly under the Central Government shall take charge of the administration of qualifications for the printing and production of state secret carriers within their respective administrative regions. 省、自治区、直辖市保密行政管理部门负责本行政区域内国家秘密载体印制资质管理工作。
Chapter II Application Conditions and Standards 

第二章 申请条件和标准

Article 9 An entity applying for the qualifications to print and produce state secret carriers (hereinafter referred to as an “applicant entity”) shall meet the following basic requirements:   第九条 国家秘密载体印制资质申请单位(以下简称申请单位)应当具备以下基本条件:
(1) It is an enterprise legal person or public institution legal person registered inside the People's Republic of China. (一)在中华人民共和国境内注册的企业法人或者事业单位法人;
(2) The personnel participating in the printing and production of state secret carriers are citizens within the territory of the People's Republic of China unless it is otherwise provided for by the state. (二)参与国家秘密载体印制业务的人员为中华人民共和国境内公民,国家另有规定的除外;
(3) It has fixed production and business premises and office space commensurate with the category and the grade of qualification applied for. (三)具有与所申请资质类别、等级相适应的固定生产经营场所和办公场所;
(4) It has engaged in the corresponding printing and production business for more than three years and has not been punished for violating secrecy laws or regulations within one year. (四)从事相应印制业务三年以上,一年内未因违反保密法律法规受到处罚;
(5) It has the printing and production equipment and technical force on a certain scale and other production and operation conditions. (五)具备相应规模的印制设备和技术力量等生产经营条件;
(6) It has sound production, operation, supervision and administration rules. (六)生产经营和监督管理制度健全。
Article 10 An applicant entity shall meet the following secrecy requirements:   第十条 申请单位应当具备以下保密条件:
(1) It has sound secrecy rules. (一)保密制度完善;
(2) It has a sound secrecy organization as well as a special offices or personnel responsible for the secrecy work. (二)保密组织健全,有专门的机构或者人员负责保密工作;
(3) It has complete formalities for the examination, assessment and registration of secret-related personnel who possess the required knowledge and skills related to secrecy. (三)对涉密人员的审查、考核、登记手续完备,且涉密人员具备必要的保密知识和技能;
(4) It has independent secrecy rooms and printing workshops, warehousing spaces for finished products, waste repositories and other functional places required for the printing and production business involving state secrets. (四)具备独立的保密室和涉密印制业务所必需的印制车间、成品库、废品库等功能场所;
(5) The premises, facilities and equipment used for printing and production business involving state secrets conform to the secrecy provisions and standards issued by the state. (五)用于涉密印制业务的场所、设施、设备符合国家保密规定和标准;
(6) The protection and management of secret-related computer information systems and secret-related office automation equipment conform to the secrecy standards and management specifications issued by the state. (六)涉密计算机信息系统、涉密办公自动化设备防护和管理符合国家保密标准和管理规范;
(7) The environment around the plants and production workshops is safe and confidential. (七)厂房、生产车间周边环境安全保密。
Article 11 An applicant for Grade-A qualification shall meet the following requirements in addition to those as prescribed in Articles 9 and 10 of these Measures:   第十一条 甲级资质申请单位,除具备本办法第九条、第十条规定的条件外,还应当具备以下条件:
(1) It already possesses Grade-B qualification and has more than three years of experience in the printing and production of state secret carriers. (一)具备乙级资质,有三年以上国家秘密载体印制业务经验;
(2) The areas where state secret carriers are printed and produced are subject to closed management. (二)国家秘密载体印制区域实行封闭式管理;
(3) It has set up the post of full-time secrecy director and has full-time staff of secrecy. (三)设置专职保密总监,配备专门保密工作人员。
Article 12 Where any overseas (or Hong Kong, Macao or Taiwan) organization, institution or individual invests or participates in the operation and management of an applicant entity, the applicant entity shall not be granted the qualifications for the printing and production of confidential documents and secret-related optical and electromagnetic media.   第十二条 有境外(含香港、澳门、台湾)组织、机构、人员投资或者参与经营管理的,不得授予涉密文件资料、涉密光电磁介质印制资质。
Where any overseas (or Hong Kong, Macao or Taiwan) organization, institution or individual has a predominant share in or participates in the operation and management of, an applying entity, the applicant entity shall not be granted the qualifications for the printing and production of national unified examination papers and classified security paper certificates. 有境外(含香港、澳门、台湾)组织、机构、人员控股或者参与经营管理的,不得授予国家统一考试试卷、涉密防伪票据证书印制资质。
Article 13 The specific conditions and secrecy standards for the qualifications for the printing and production of state secret carriers shall be prescribed separately by the secrecy administrative department of the state.   第十三条 国家秘密载体印制资质具体条件和保密标准,由国家保密行政管理部门另行规定。
Chapter III Application, Acceptance, Review and Permission 

第三章 申请、受理和审查、许可

Article 14 An applicant entity shall fill out an Application Form for the Qualifications for the Printing and Production of State Secret Carriers, and provide the following materials:   第十四条 申请单位应当填写《国家秘密载体印制资质申请书》,并提供以下材料:
(1) The business license in the case of an enterprise or the legal person certificate in the case of a public institution. (一)企业营业执照或者事业单位法人证书;
(2) Organization code certificate. (二)组织机构代码证书;
(3) The permit to engage in printing, reproduction and other business activities. (三)从事印刷、复制等经营活动的许可证明;
(4) Bylaws of an enterprise or public institution. (四)企业事业单位章程;
(5) Property certificates or contracts on the lease of production, operation and office premises. (五)生产经营和办公场所的产权证书或者租赁合同;
(6) Floor plans of the places for printing, producing and storing state secret carriers. (六)国家秘密载体印制、保管场所平面图;
(7) Identification documents of the legal representative and the personnel engaging in secret-related printing, production and management. (七)法定代表人及从事涉密业务印制、管理人员的身份证明材料;
(8) Capital verification report and the financial auditing report of the previous year. (八)验资报告及上一年度财务审计报告;
(9) A list of printing and production equipment. (九)印制设备清单;
(10) Secrecy administration rules and regulations and a list of secrecy facilities and equipment. (十)保密管理规章制度及保密设施、设备清单。
The applicant entity shall be responsible for the authenticity of the application materials. 申请单位应当对申请材料的真实性负责。
Article 15 The secrecy administrative department of the state shall be responsible for the grant of Grade A qualifications; and secrecy administrative departments of the provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for the grant of Grade B qualifications.   第十五条 国家保密行政管理部门负责甲级资质许可;省、自治区、直辖市保密行政管理部门负责乙级资质许可。
Article 16 Whoever applies for Grade A qualification shall apply to the secrecy administrative department of the province, autonomous region, or municipality directly under the Central Government at its place of industrial and commercial registration; and whoever applies for Grade B qualification shall apply to the secrecy administrative department of a districted city or autonomous prefecture at its place of industrial and commercial registration.   第十六条 申请甲级资质的,应当向工商注册地省、自治区、直辖市保密行政管理部门提出申请;申请乙级资质的,应当向工商注册地设区的市、自治州保密行政管理部门提出申请。
The secrecy administrative department of a province, autonomous region, or municipality directly under the Central Government or the secrecy administrative department of a districted city or autonomous prefecture shall, after receiving an application, complete the preliminary examination thereof within five days, and submit them to the relevant secrecy administrative department according to its functions if the application materials are complete or are in the required forms; and, if the application materials are incomplete or are not in the required forms, it shall return the application materials and notify the applicant entity of all required supplements and corrections at one time. 省、自治区、直辖市保密行政管理部门和设区的市、自治州保密行政管理部门收到申请材料后,应当在五日内完成材料初审,申请材料齐全且符合法定形式的,按照权限报送有关保密行政管理部门;申请材料不齐全或者不符合法定形式的,退回申请材料,一次告知申请单位补正。
Article 17 A secrecy administrative department shall, after receiving an application, accept it and issue a notice of acceptance if the applicant entity meets the requirements; and if the application fails to meet the requirements, the secrecy administrative department shall make a decision not to accept the application, and notify the applicant entity in writing and give the reasons therefor.   第十七条 保密行政管理部门收到申请材料后,申请单位符合条件的,应当受理并发出受理通知书;不符合条件的,保密行政管理部门应当作出不予受理的决定,书面告知申请单位并说明理由。
Article 18 Where the application of an applicant entity is accepted, the secrecy administrative department shall assign two or more staff members and one or more review experts to inspect secrecy rules, secrecy office, secrecy supervision and administration, secrecy technology protection, and professional competency in the business involving state secrets, among others, and issue an on-site examination opinion.   第十八条 对受理的申请单位,保密行政管理部门应当指派两名以上工作人员和一名以上审查专家对其保密制度、保密工作机构、保密监督管理、保密技术防护以及从事涉密业务的专业能力等情况进行检查,出具现场审查意见。
The full score of on-site examination is 100 points. If the score is 80 points or more, it shall be deemed that the applying entity has passed the on-site examination; and if the score is less than 80 points, it shall be deemed to have failed the on-site examination. If the applicant entity has passed the on-site examination, it shall make rectifications according to the on-site examination opinion; otherwise, the secrecy administrative department shall make a decision not to approve the application. 现场审查满分为100分,达到80分(含)以上为现场审查通过,80分(不含)以下为现场审查不通过。通过现场审查的,申请单位应当按照现场审查意见整改;未通过现场审查的,保密行政管理部门应当作出不予许可的决定。
Article 19 An on-site examination shall be conducted under the following procedures:   第十九条 现场审查按照以下程序进行:
(1) Notifying the applicant entity of the time when the on-site examination is to be conducted five days in advance. (一)提前五日通知申请单位现场审查时间;
(2) Listening to the report of the situation and explanations of relevant maters from the entity subject to examination. (二)听取被审查单位情况汇报和对有关事项的说明;
(3) Organizing secrecy knowledge tests for secret-related personnel. (三)组织涉密人员进行保密知识测试;
(4) Conducting field inspections and making inspection records. (四)进行实地检查,并作出检查记录;
(5) Conducting an appraisal of the on-site examination information to form examination opinions. (五)对现场审查情况进行评议,形成审查意见;
(6) Notifying the entity subject to examination of the examination information. (六)向被审查单位通报审查情况;
(7) Signing to confirm the on-site examination result. (七)签字确认现场审查结果。
Article 20 Where any clue to a case in which the applicant entity is suspected of divulging any state secret is discovered during the on-site examination, the personnel qualified for law enforcement shall register and preserve relevant facilities, equipment and carriers, among others, according to the jurisdiction and as required by work.   第二十条 现场审查中发现申请单位存在涉嫌泄露国家秘密的案件线索,应当按照管辖权限,根据工作需要,由具备执法资格的人员对有关设施、设备、载体等采取登记保存措施。
