| Plan for the Reform of the Legal Disclosure System of Environmental Information | | 环境信息依法披露制度改革方案 |
| Legal disclosure of environmental information is an important enterprise environmental management system and the basic content of the ecological civilization system. Deepening the reform of the legal disclosure system of environmental information is an important measure to promote the modernization of ecological and environmental governance system and capabilities. This Plan is developed for the purposes of implementing the relevant requirements of the report to the 19th CPC National Congress and promoting according to the law the compulsory disclosure of environmental information by enterprises. | | 环境信息依法披露是重要的企业环境管理制度，是生态文明制度体系的基础性内容。深化环境信息依法披露制度改革是推进生态环境治理体系和治理能力现代化的重要举措。为贯彻落实党的十九大报告有关要求，依法推动企业强制性披露环境信息，制定本方案。 |
| I. Overall Requirements | | 一、总体要求 |
| 1. Guiding ideology. Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, the guiding principles of the 19th CPC National Congress and the second, third, fourth and fifth plenary sessions of the 19th CPC Central Committee shall be implemented comprehensively; Xi Jinping Thought on Ecological Civilization and the spirit of the national conference on ecological and environmental protection shall be thoroughly implemented; and, according to the decisions and arrangements made by the CPC Central Committee and the State Council, focus shall be put on the environmental conduct of enterprises which have significant impacts on ecology and environment, public health and citizens' interests and about which the market and the public are highly concerned, enterprises' statutory obligations of compulsory disclosure of environmental information shall be fulfilled, the management mechanisms featuring inter-departmental coordination and effective operation shall be established, administrative regulation and social supervision shall be enhanced, and the development of the rule of law shall be enhanced, so as to form the legal disclosure system of environmental information featuring enterprise self-regulation, effective administration, strict supervision, and strong support. | | （一）指导思想。以习近平新时代中国特色社会主义思想为指导，全面贯彻党的十九大和十九届二中、三中、四中、五中全会精神，深入落实习近平生态文明思想和全国生态环境保护大会精神，按照党中央、国务院决策部署，聚焦对生态环境、公众健康和公民利益有重大影响，市场和社会关注度高的企业环境行为，落实企业强制性披露环境信息的法定义务，建立部门联动、运作有效的管理机制，强化行政监管和社会监督，加强法治化建设，形成企业自律、管理有效、监督严格、支撑有力的环境信息依法披露制度。 |
| 2. Working principles. | | （二）工作原则。 |
| —Advancing relevant work according to the law and fulfilling responsibilities. The reform shall be advanced in a lawful, regulated and orderly manner, enterprises' fulfillment of their statutory obligations of compulsory disclosure of environmental information shall be boosted, the public's right to know shall be guaranteed, and the lawful rights and interests of enterprises shall be protected. | | --依法推进，落实责任。依法规范有序推进改革，推动企业落实环境信息强制性披露法定义务，保障社会公众知情权，保护企业合法权益。 |
| —Being problem-oriented and improving the system. The code of environmental conduct of enterprises shall be improved, a sound system that guides and regulates enterprises' disclosure of environmental information shall be established, and efforts shall be concentrated on solving prominent problems existing in the compulsory disclosure of environmental information. | | --问题导向，健全制度。完善企业环境行为准则，建立健全引导、规范企业披露环境信息的制度体系，着力解决环境信息强制性披露中存在的突出问题。 |
| —Highlighting priorities and strengthening supervision. Efforts shall be concentrated on strengthening the administration of enterprises subject to compulsory disclosure of environmental information, and government regulation and social supervision shall be enhanced so as to ensure that information is disclosed in a timely, true, accurate, and complete manner and guarantee the effective implementation of the system. | | --突出重点，强化监督。着重加强对环境信息强制性披露企业的管理，强化政府监管和社会监督，确保信息披露及时、真实、准确、完整，保障制度有效实施。 |
| 3. Main objectives. By 2025, the compulsory disclosure system of environmental information shall be basically formed. Under such system, enterprises shall faithfully disclose environmental information on time according to the law, the multi-party coordination and co-management mechanism shall function properly, supervision and punishment measures shall be implemented strictly, the development of the rule of law shall be continuously improved, there shall be a strong support from the system of technical specifications, and public participation shall be enhanced significantly. | | （三）主要目标。到2025年，环境信息强制性披露制度基本形成，企业依法按时、如实披露环境信息，多方协作共管机制有效运行，监督处罚措施严格执行，法治建设不断完善，技术规范体系支撑有力，社会公众参与度明显上升。 |
| II. Main Tasks | | 二、主要任务 |
| 1. Establishing and improving the requirements of the standards for the legal compulsory disclosure of environmental information. | | （一）建立健全环境信息依法强制性披露规范要求。 |
| (1) Clarifying the subjects subject to compulsory disclosure of environmental information. In accordance with relevant laws and regulations and other provisions, the following enterprises shall be subject to compulsory disclosure of environmental information: key pollutant discharging entities, enterprises subject to compulsory cleaner production examination, listed companies and bond-issuing enterprises that are held criminally liable or are subject to major administrative penalties for violations of ecological or environmental laws, and other enterprises and public institutions that shall be subject to compulsory disclosure of environmental information according to laws and regulations and other provisions. (The Ministry of Ecology and Environment shall be responsible for the implementation of relevant work. All of the following requirements shall be implemented by the local Party committees and governments at all levels, which will not be stated repeatedly.) | | 1.明确环境信息强制性披露主体。依据有关法律法规等规定，下列企业应当开展环境信息强制性披露：重点排污单位；实施强制性清洁生产审核的企业；因生态环境违法行为被追究刑事责任或者受到重大行政处罚的上市公司、发债企业；法律法规等规定应当开展环境信息强制性披露的其他企业事业单位。（生态环境部负责。以下均需地方各级党委和政府落实，不再列出） |
| (2) Determining the content of compulsory disclosure of environmental information. In accordance with relevant laws and regulations and other provisions, the content and scope of the compulsory disclosure of environmental information by enterprises shall be clarified to fully reflect the enterprises' compliance with ecological and environmental laws and regulations and environmental governance. A dynamic adjustment mechanism shall be established to improve the content of compulsory disclosure of environmental information in a timely manner according to reform practices and work needs. National security policies shall be implemented, and companies shall not disclose the information that involves state secrets or core and key technologies in important fields in accordance with laws and regulations. (The Ministry of Ecology and Environment shall be responsible for the implementation of relevant work.) | | 2.确定环境信息强制性披露内容。依据有关法律法规等规定，明确企业环境信息强制性披露内容和范围，全面反映企业遵守生态环境法律法规和环境治理情况。建立动态调整机制，根据改革实践和工作需要，及时完善环境信息强制性披露内容。落实国家安全政策，涉及国家秘密的，以及重要领域核心关键技术的，企业依法依规不予披露。（生态环境部负责） |
| (3) Disclosing important environmental information in a timely manner. The disclosure of important environmental information shall be intensified. Enterprises shall disclose relevant information to the public in a timely manner when their administrative licensing items related to ecology and environment change, they are subject to environmental administrative penalties or are held criminally liable for violations of ecological or environmental laws, or they encounter ecological and environmental emergencies, compensate for ecological and environmental damages, or commit other environmental conduct that have a significant impact on the public and investors or trigger market risks. (The Supreme People's Court and the Ministry of Ecology and Environment shall be responsible for the implementation of relevant work.) | | 3.及时披露重要环境信息。强化重要环境信息披露，企业发生生态环境相关行政许可事项变更、受到环境行政处罚或者因生态环境违法行为被追究刑事责任、突发生态环境事件、生态环境损害赔偿等对社会公众及投资者有重大影响或引发市场风险的环境行为时，应当及时向社会披露。（最高人民法院、生态环境部负责） |
