Measures of Shanghai Municipality for Payment of Wages by Enterprises
(Labor and Social Security Bureau of Shanghai Municipality)

The present Measures are formulated in accordance with the Labor Law of the People's Republic of China and the relevant laws and regulations and in combination with the actual conditions of this Municipality for the purpose of maintaining the rights of employees to obtain remunerations through labor and regulating the wage payment acts of enterprises.

现将《上海市企业工资支付办法》印发给你们,请贯彻执行。

上海市企业工资支付办法

为维护劳动者通过劳动获得劳动报酬的权利,规范企业的工资支付行为,根据《中华人民共和国劳动法》和有关法律、法规的规定,结合本市实际情况,制定本办法。
1. The present Measures shall be applicable to the various enterprises, individual economic organizations (hereinafter are called by a joint name as the working entities) within the administrative region of this Municipality and the employees who have labor relations with them.
   一、本办法适用于本市行政区域内的各类企业、个体经济组织(以下统称用人单位)和与之形成劳动关系的劳动者。
2. The wages as mentioned in the present Measures shall refer to the remunerations paid to the employees in currency by the working entities according to the provisions of the state and this Municipality, namely, the currency income listed in the total amount of wages.
   二、本办法所称工资是指用人单位根据国家和本市的规定,以货币形式支付给劳动者的报酬。即列入工资总额统计的货币收入。
3. The wages shall be paid in legal currency.
   三、工资应当以法定货币形式支付。
4. Where a working entity pays wages through banks, it shall remit the wages into the accounts of the employees themselves.
Where a working entity pays wages directly to an employee, it shall pay the wages to the employee himself and handle the formalities for signing in. In case an employee fails to draw wages due to some reasons, he may entrust his relatives or others to draw it.
   四、用人单位通过银行发放工资的,应当按时将工资划入劳动者本人帐户。
用人单位直接发放工资的,应当将工资支付给劳动者本人,并办理签收手续。劳动者本人因故不能领取工资时,可由其委托亲属或他人代领。
5. A working entity shall record in writing the amount and items of wages paid to the employees, and the time for the payment, as well as the name of the employees etc., and keep the records for future reference in accordance with the relevant provisions. No matter what kind of ways a working entity takes to pay wages, the entity shall provide a list of wages to the employee himself.
   五、用人单位应当书面记载支付劳动者工资的数额、项目、时间、本人姓名等,并按有关规定保存备查。单位不管以何种形式发放工资,都应当向劳动者提供一份本人的工资清单。
6. A working entity shall pay wages at least once a month. The specific date for the payment shall be agreed on by the working entity and the employees. In case of legal holidays or rest days, a working entity may not postpone the payment of wages if it pays wages through banks. If the wages are paid directly, the working entity shall pay the wages in advance.
Where an annual payment system is implemented or the wages are cashed on the basis of the examination period, the working entity shall pay the wages in advance according to the standards of minimum salary per month, and shall settle it in the end of the year or at the expiry of the examination cycle.
   六、用人单位应当每月至少支付一次工资。支付工资的具体日期,由用人单位与劳动者约定。如遇法定休假节日或休息日,通过银行发放工资的,不得推迟支付工资;直接发放工资的,应提前支付工资。
对实行年薪制或按考核周期兑现工资的劳动者,用人单位应当每月按不低于最低工资的标准预付工资,年终或考核周期期满时结算。
7. Where a working entity terminates or rescinds the labor contract with an employee, the working entity shall pay off the wages of the employee once for all after having handled formalities with the employee.
   七、用人单位与劳动者终止或依法解除劳动合同的,用人单位应当在与劳动者办妥手续时,一次性付清劳动者的工资。
8. Where an employee takes part in social activities according to law in legal working hours, the working entity shall deem that he has provided normal labor, and pay wages to him.
   八、劳动者在法定工作时间内依法参加社会活动的,用人单位应视同其提供了正常劳动而支付工资。
9. Where an employee enjoys such vacations as wedding leave, leave for arranging funeral, and leave for going home to visit their families, and etc., the working entity shall pay holiday wages to him according to the state provisions. The base for calculating holiday wages shall be determined in light of the following principles:
   九、劳动者在依法享受婚假、丧假、探亲假等假期期间,用人单位应当按国家规定支付假期工资。假期工资的计算基数按以下原则确定:
(1) Where there are stipulations in the labor contract, the wages shall be determined in light of the standard of wages corresponding to the post (job) of the employee himself, which shall not be lower than the standard as stipulated in the labor contract. Where the standards determined by the collective contract (collective agreement for wages) are higher than the standards as stipulated in the labor contract, it shall be determined according to the standards of labor contract (collective agreement for wages).
 (一)劳动合同有约定的,按不低于劳动合同约定的劳动者本人所在岗位(职位)相对应的工资标准确定。集体合同(工资集体协议)确定的标准高于劳动合同约定标准的,按集体合同(工资集体协议)标准确定。
(2) Where neither the labor contract nor the collective contract makes stipulations on the wages, it shall be determined through collective negotiation on wages by the working entity and the representatives of the employees. The collective agreement for wages shall be signed on the result of negotiation.

 (二)劳动合同、集体合同均未约定的,可由用人单位与职工代表通过工资集体协商确定,协商结果应签订工资集体协议。
