| For the purposes of thoroughly studying and implementing the Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, comprehensively fulfilling the spirit of the important speeches made by General Secretary Xi Jinping at the ceremony of the 40th anniversary of the establishment of the Shenzhen Special Economic Zone, conscientiously implementing the Plan by the CPC Central Committee and the State Council for Comprehensive Deepening the Reform and Opening Up of the Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone, maximizing the functional roles of judicial services and guarantees, and further encouraging the Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone (hereinafter referred to as the “Qianhai Cooperation Zone”) to comprehensively deepen reform and opening up and to build a socialist rule of law demonstration zone with Chinese characteristics, the following opinions are developed in light of the actual work circumstances of people's courts. | | 为深入学习贯彻习近平新时代中国特色社会主义思想，全面贯彻落实习近平总书记在深圳经济特区建立40周年庆祝大会上的重要讲话精神，认真贯彻落实中共中央、国务院印发的《全面深化前海深港现代服务业合作区改革开放方案》，充分发挥司法服务保障职能，进一步推动前海深港现代服务业合作区（以下简称前海合作区）全面深化改革开放，建设中国特色社会主义法治示范区，结合人民法院工作实际，制定如下意见。 |
| I. General requirements | | 一、总体要求 |
| 1. Guiding ideology. Under the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, the spirit of the 19th National Congress of the Communist Party of China and all previous plenary sessions of the 19th CPC Central Committee shall be fully implemented, and the Xi Jinping Thought on the Rule of Law shall be further implemented. The principle of relying on Hong Kong, serving the mainland, and arming at the world shall be adhered to. In accordance with the decisions and plans of the CPC Central Committee and the State Council, efforts shall be made to keep to the strategic positioning of the Qianhai Cooperation Zone and to promote reform and rule of law so as to deepen closer cooperation between Shenzhen and Hong Kong. The important opportunity of building the Guangdong-Hong Kong-Macao Greater Bay Area shall be seized to support the Qianhai Cooperation Zone in pioneering and actively exploring the building of a socialist rule of law demonstration zone with Chinese characteristics. Hong Kong and Macao shall be supported in integrating their own development into overall national development and working with the Qianhai Cooperation Zone to jointly build a world-class bay area and city cluster. Efforts shall be made to build a pilot platform for comprehensively deepening the reform and innovation of the Guangdong-Hong Kong-Macao Greater Bay Area and a gateway hub for high-level opening-up. | | 1.指导思想。以习近平新时代中国特色社会主义思想为指导，全面贯彻党的十九大和十九届历次全会精神，深入贯彻落实习近平法治思想，坚持依托香港、服务内地、面向世界，按照党中央、国务院决策部署，围绕前海合作区战略定位，推动改革与法治双轮驱动，服务深化深港更紧密合作。抓住粤港澳大湾区建设重要机遇，支持前海合作区在打造中国特色社会主义法治建设示范区方面先行先试、积极探索。支持港澳融入国家发展大局，与前海合作区携手共建国际一流湾区和世界级城市群，努力打造粤港澳大湾区全面深化改革创新试验平台和高水平对外开放门户枢纽。 |
| 2. Main objectives. Compatibility with the laws, rules, and mechanisms of Hong Kong and Macao shall be achieved. The successful experience and resources of Hong Kong and Macao in the development of the rule of law shall be fully utilized to upgrade the level of legal exchanges and cooperation between Shenzhen and Hong Kong. Support shall be provided to the building of the Shenzhen-Hong Kong International Legal Service Zone with high standards in the Qianhai Cooperation Zone and to the efforts to take the lead in launching the pilot program and creating innovative samples, thereby making it a pilot and demonstration zone with a highly law-based business environment and enhancing its pivotal position in the building of the “Two Zones”. Institutional reform and innovation shall be solidly promoted to facilitate the innovative development of the modern service industry. The level of opening-up to the outside world in legal affairs shall be improved to enhance the exemplary function of judicial work in the development of the Guangdong-Hong Kong-Macao Greater Bay Area. A solid legal foundation shall be laid for the Qianhai Cooperation Zone to preliminarily form a globally competitive business environment by 2025 and create a world-class business environment by 2035. | | 2.主要目标。推进与港澳法律规则衔接、机制对接，充分利用港澳在法治建设方面的成功经验和资源，提升深港法治交流合作水平。支持在前海合作区高标准建设深港国际法务区，率先开展试点、打造创新样本，助推其成为具有高度法治化营商环境的试点和示范，提升其在“双区”建设中的枢纽地位。扎实推进制度改革创新，推动现代服务业创新发展，提升法律事务对外开放水平，增强审判工作在粤港澳大湾区建设中的法治示范功能。为前海合作区2025年初步形成具有全球竞争力的营商环境，2035年达到世界一流营商环境打下坚实的法治基础。 |

| 3. The organization system for international commercial trials in the Qianhai Cooperation Zone shall be improved. The Qianhai Cooperation Zone shall be supported in further improving the organization system of international commercial trials and building a fair, efficient, convenient, and low-cost system and mechanism for handling international commercial disputes, in an attempt to create a preferred place for commercial trials in Guangdong, Hong Kong, and Macao. | | 3.完善前海合作区国际商事审判组织体系。支持在前海合作区进一步健全完善国际商事审判组织体系，构建公正、高效、便捷、低成本处理国际商事纠纷体制机制，打造粤港澳商事审判优选地。 |
| 4. The scope of accepting foreign-related civil and commercial cases shall be expanded according to the law. In light of the development space expansion of the Qianhai Cooperation Zone, the jurisdiction rules of relevant people's courts for foreign-related civil and commercial disputes shall be adjusted scientifically. The People's Court of the Qianhai Cooperation Zone (hereinafter referred to as the “Qianhai Court”) shall be supported in expanding its jurisdiction over foreign-related civil and commercial cases in an orderly manner according to law, and launching the pilot program of accepting foreign-related civil and commercial cases with no nexus but upon the agreement of the parties. | | 4.依法扩大涉外民商事案件受案范围。结合前海合作区发展空间扩展情况，科学调整相关人民法院涉外民商事纠纷管辖规则，支持前海合作区人民法院（以下简称前海法院）依法有序扩大涉外民商事案件管辖范围，支持依法试点受理没有连接点但当事人约定管辖的涉外民商事案件。 |
| 5. The litigation procedures for cases involving Hong Kong and Macao shall be simplified. In accordance with the principle of mutual respect, seeking common ground while reserving differences, and facilitating legality, the Qianhai Court shall be supported in simplifying the procedures for judicial confirmation of the qualifications of Hong Kong and Macao litigants, authorized witnessing, and service as well as the examination and determination of litigation evidence. Summary procedures and sole-judge trials shall be applied according to the law to improve the efficiency of litigation over civil and commercial disputes involving Hong Kong and Macao. The building of an interregional judicial assistance system with Chinese characteristics shall be strengthened, and the establishment of an electronic platform for civil and commercial judicial assistance in the Guangdong-Hong Kong-Macau Greater Bay Area shall be explored. In civil and commercial cases involving Hong Kong and Macao, with the consent of the parties, the parties, lawyers, and notary agencies shall assist in the transfer of documents to improve the efficiency of service. | | 5.简化涉港澳案件诉讼程序。按照相互尊重、求同存异、便利合法原则，支持前海法院简化港澳诉讼主体资格司法确认、授权委托见证、送达程序及诉讼证据审查认定。依法适用简易程序和独任制审理，提高涉港澳民商事纠纷诉讼效率。加强中国特色区际司法协助体系建设，探索建设粤港澳大湾区民商事司法协助电子平台，在涉港澳民商事案件中探索在当事人认可的前提下，由当事人、律师、公证机构等协助转送文书，提高送达效率。 |
