The Measures for the Administration of Licenses for the Import of Goods, which were adopted at the 17th executive meeting of the Ministry of Commerce on December 9th, 2004, are hereby promulgated, and shall come into force as of January 1st, 2005.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 The present Measures are formulated in accordance with the provisions of the Foreign Trade Law of the People's Republic of China and the Regulation of the People's Republic of China on the Administration of Import and Export of Goods, for the purpose of regulating the administration on the import license, maintaining the order of import of goods and promoting the healthy development of foreign trade.
| | 第一条 为了规范进口许可证管理，维护货物进口秩序，促进对外贸易健康发展，根据《中华人民共和国对外贸易法》和《中华人民共和国货物进出口管理条例》的规定，制定本办法。

Article 2 The State shall apply the uniform system of licenses for the import of goods. The State shall apply the import license administration to the goods under import restriction.
| | 第二条 国家实行统一的货物进口许可证制度。国家对限制进口的货物实行进口许可证管理。

Article 3 The Ministry of Commerce shall be the department of centralized administration of import license of the whole country, and shall be responsible for formulating the rules and regulations on the administration of import license, supervising and inspecting the enforcement of the measures for the administration of import license and punishing the rule-breaking acts.
The Ministry of Commerce shall, together with the General Administration of Customs, formulate, adjust, and promulgate the annual Catalogue for Goods Subject to the Administration of Import License. The Ministry of Commerce shall be responsible for formulating, adjusting and promulgating the annual Catalogue for Graded License Issuance of Goods Subject to the Administration of Import License.
The Catalogue for Goods Subject to the Administration of Import License and the Catalogue for Graded License Issuance of Goods Subject to the Administration of Import License shall be promulgated by the Ministry of Commerce by public notice.
| | 第三条 商务部是全国进口许可证的归口管理部门，负责制定进口许可证管理办法及规章制度，监督、检查进口许可证管理办法的执行情况，处罚违规行为。
商务部会同海关总署制定、调整和发布年度《进口许可证管理货物目录》。商务部负责制定、调整和发布年度《进口许可证管理货物分级发证目录》。
《进口许可证管理货物目录》和《进口许可证管理分级发证目录》由商务部以公告形式发布。

Article 4 The Ministry of Commerce shall authorize the Bureau of Quota License (hereinafter referred to as the License Bureau) to be in uniform charge and direct the work for the issuance of import license by the license issuing agencies of the whole country. The License Bureau shall be responsible to the Ministry of Commerce.
| | 第四条 商务部授权配额许可证事务局（以下简称许可证局）统一管理、指导全国各发证机构的进口许可证签发工作，许可证局对商务部负责。

Article 5 The License Bureau and the local accredited representatives' offices under the Ministry of Commerce and the commerce offices or bureaus and the commissions, offices or bureaus of foreign trade and economic cooperation of all the provinces, autonomous regions, municipalities directly under the Central Government, cities directly under state planning, and other provincial capital cities authorized by the Ministry of Commerce shall be the import license issuing agencies, which shall, under the uniform administration of the License Bureau, be responsible for the work of issuance of license within their respective authorized scope.
| | 第五条 许可证局及商务部驻各地特派员办事处（以下简称各特办）和各省、自治区、直辖市、计划单列市以及商务部授权的其他省会城市商务厅（局）、外经贸委（厅、局）（以下简称各地方发证机构）为进口许可证发证机构，在许可证局统一管理下，负责授权范围内的发证工作。

Article 6 The import license is the legal basis by which the state administers the import of goods. Unless specified differently by the State, a foreign trade operator (hereinafter referred to as the operator) shall apply for import license as required to the designated license issuing agency for those goods subject to the administration of import license before the import. And the customs shall accept the declaration and release the goods on the basis of the import license.
| | 第六条 进口许可证是国家管理货物进口的法律凭证。凡属于进口许可证管理的货物，除国家另有规定外，对外贸易经营者（以下简称经营者）应当在进口前按规定向指定的发证机构申领进口许可证，海关凭进口许可证接受申报和验放。

Article 7 The import license shall be applicable to the import of goods within the Catalogue for Goods Subject to the Administration of Import License.
| | 第七条 进口许可证适用于《进口许可证管理货物目录》内货物的进口。

Article 8 No import license may be sold, transferred, altered, forged or changed.
| | 第八条 进口许可证不得买卖、转让、涂改、伪造和变造。

Chapter II Documents To Be Submitted When Applying for Import License
| | 第二章 申请进口许可证应当提交的文件

Article 9 An operator shall carefully fill in the application form for import license according to the facts when applying for import license, and affix its seal to it.
| | 第九条 经营者申领进口许可证时，应当认真如实填写进口许可证申请表，并加盖印章。
|
Article 10 An operator shall submit the documents of approval for import and the relevant documents as prescribed in the “Basis for Issuance of Import License” of Chapter III of the present Measures to the license issuing agency on the basis of the conditions of import of goods.
| | 第十条 经营者应当根据进口货物情况，向发证机构提交本办法第三章进口许可证发证依据所规定的进口批准文件及相关材料。

Article 11 An operator shall submit the qualified Enterprise Legal Person Registration Business License after annual examination, and the Form of Archival Filing and Registration of Foreign Trade Operators with the special seal for the archival filing and registration of foreign trade operators, or the qualification certificate of import and export enterprises. In case the operator is a foreign-funded enterprise, it shall also submit the certificate of approval for a foreign-funded enterprise. If the goods to be imported fall within the scope of state-owned trade or there are other requirements of qualification administration on them by the State, the relevant documents of the Ministry of Commerce or of the relevant departments shall also be provided.
| | 第十一条 经营者应当提交经年检合格的《企业法人登记营业执照》及加盖对外贸易经营者备案登记专用章的《对外贸易经营者备案登记表》或者进出口企业资格证书。经营者为外商投资企业的，还应当提交外商投资企业批准证书。进口货物属国家实行国营贸易或者有其他资质管理要求的，应当提供商务部或者相关部门的有关文件。

Chapter III Basis for Issuance of Import License

Article 12 Each license issuing agency shall issue import licenses according to the following provisions and on the basis of the scope as prescribed in the Catalogue for Goods Subject to the Administration of Import License and the Catalogue for Graded License Issuance of Goods Subject to the Administration of Import License as formulated by the Ministry of Commerce:
| | 第十二条 各发证机构按照商务部制定的《进口许可证管理货物目录》和《进口许可证管理货物分级发证目录》范围，依下列规定签发进口许可证：

1. For the chemical products under supervision and control, a license issuing agency shall issue the import license on the basis of the Ratification Form for the Import of Controlled Chemicals as approved by the Office of the State Leading Group for Performance of the Convention on Chemical Weapons and the import contract (original and photocopy).
