| Article 1 This Law is enacted in accordance with the Constitution for the purposes of ensuring that the Standing Committee of the National People's Congress and the standing committees of local people's congresses at or above the county level exercise their supervisory powers in accordance with the law, effectively upholding, improving and implementing the system of people's congresses, developing socialist democracy and promoting law-based governance in a comprehensive manner. | | 第一条 为了保障全国人民代表大会常务委员会和县级以上地方各级人民代表大会常务委员会依法行使监督职权，坚持好、完善好、运行好人民代表大会制度，发展社会主义民主政治，推进全面依法治国，根据宪法，制定本法。 |
| Article 2 The standing committees of people's congresses at various levels shall exercise supervisory powers according to the Constitution and relevant laws. | | 第二条 各级人民代表大会常务委员会依据宪法和有关法律的规定，行使监督职权。 |
| The procedures for the standing committees of people's congresses at various levels to exercise supervisory powers shall be governed by this Law; and if there is no such provision in this Law, the provisions in the relevant laws shall be followed. | | 各级人民代表大会常务委员会行使监督职权的程序，适用本法；本法没有规定的，适用有关法律的规定。 |
| Article 3 When exercising supervisory powers, the standing committees of the people's congresses at various levels shall uphold the leadership of the Communist Party of China, insist on the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of “Three Represents,” the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, adhere to the path of socialism with Chinese characteristics, ensure that the Constitution, laws and regulations are comprehensively and effectively implemented, and guarantee that administrative, supervisory, judicial and procuratorial powers are appropriately exercised in accordance with the law. | | 第三条 各级人民代表大会常务委员会行使监督职权，应当坚持中国共产党的领导，坚持以马克思列宁主义、毛泽东思想、邓小平理论、“三个代表”重要思想、科学发展观、习近平新时代中国特色社会主义思想为指导，坚持中国特色社会主义道路，确保宪法和法律、法规得到全面有效实施，确保行政权、监察权、审判权、检察权依法正确行使。 |
| Article 4 When exercising supervisory powers, the standing committees of the people's congresses at various levels shall focus on the overall work situation of the Party and the state, take economic construction as the central task, insist on reform and opening up, implement new development concepts, promote high-quality development, and guarantee the all-round construction of a modern socialist country and comprehensive promotion of the great rejuvenation of the Chinese nation through Chinese-style modernization. | | 第四条 各级人民代表大会常务委员会行使监督职权，应当围绕党和国家工作大局，以经济建设为中心，坚持改革开放，贯彻新发展理念，推动高质量发展，保障全面建设社会主义现代化国家、以中国式现代化全面推进中华民族伟大复兴。 |
| Article 5 The Standing Committee of the National People's Congress shall supervise the implementation of the Constitution and laws, and the local people's congresses at various levels and their standing committees shall guarantee the observance and implementation of the Constitution, laws, administrative regulations and the resolutions of the people's congresses at higher levels and their standing committees within their respective administrative regions, and safeguard the unity, dignity and authority of rule of law of the country. | | 第五条 全国人民代表大会常务委员会监督宪法和法律的实施，地方各级人民代表大会及其常务委员会在本行政区域内保证宪法、法律、行政法规和上级人民代表大会及其常务委员会决议的遵守和执行，维护国家法治统一、尊严、权威。 |
| Article 6 The standing committees of the people's congresses at various levels shall supervise the work of the people's governments, supervisory commissions, people's courts and people's procuratorates at the corresponding levels, exercise correct, effective and lawful supervision, and promote law-based administration, law-based supervision and impartial administration of justice. | | 第六条 各级人民代表大会常务委员会对本级人民政府、监察委员会、人民法院和人民检察院的工作实施监督，实行正确监督、有效监督、依法监督，促进依法行政、依法监察、公正司法。 |
| The people's governments, supervisory commissions, people's courts and people's procuratorates at various levels shall exercise their functions and powers, perform their duties and carry out their work in strict accordance with the law, and consciously accept the supervision of the standing committees of the people's congresses at the corresponding levels. | | 各级人民政府、监察委员会、人民法院和人民检察院应当严格依法行使职权、履行职责、开展工作，自觉接受本级人民代表大会常务委员会的监督。 |
| Article 7 The standing committees of the people's congresses at various levels shall, when exercising supervisory powers, uphold and develop people's democracy in the whole process, respect and protect human rights, and safeguard and promote social equity and justice. | | 第七条 各级人民代表大会常务委员会行使监督职权，应当坚持和发展全过程人民民主，尊重和保障人权，维护和促进社会公平正义。 |
| The standing committees of the people's congresses at all levels shall expand the participation of deputies to the people's congresses in supervision work and maximize the role of deputies. | | 各级人民代表大会常务委员会应当扩大人民代表大会代表对监督工作的参与，充分发挥代表作用。 |
| Article 8 The standing committees of people's congresses at various levels shall, according to the principle of democratic centralism, exercise supervisory powers collectively. | | 第八条 各级人民代表大会常务委员会按照民主集中制的原则，集体行使监督职权。 |
| Article 9 The standing committees of people's congresses at various levels shall report their exercise of supervisory powers to the people's congresses at the corresponding levels, and be subject to their supervision. | | 第九条 各级人民代表大会常务委员会行使监督职权的情况，应当向本级人民代表大会报告，接受监督。 |
| Article 10 The standing committees of people's congresses at various levels shall announce their exercise of supervisory powers to the general public. | | 第十条 各级人民代表大会常务委员会行使监督职权的情况，向社会公开。 |
| Chapter II Listening to and Deliberating the Special Work Report | | 第二章 听取和审议专项工作报告 |
| Article 11 The standing committees of people's congresses at various levels shall choose several issues concerning the overall situation of reform, development and stability and the fundamental interests of the general public as well as those concerned by the general public every year, and make an arrangement to hear and deliberate special work reports of the people's government, the supervisory commission, the people's court and the people's procuratorate at the corresponding levels. | | 第十一条 各级人民代表大会常务委员会每年选择若干关系改革发展稳定大局和群众切身利益、社会普遍关注的重大问题，有计划地安排听取和审议本级人民政府、监察委员会、人民法院和人民检察院的专项工作报告。 |
| Article 12 The issues for special work reports of the people's government, the supervisory commission, the people's court and the people's procuratorate at the corresponding level which the standing committee hears and deliberates shall be determined on the basis of the provisions of relevant laws and the issues reflected by the following means: | | 第十二条 常务委员会听取和审议本级人民政府、监察委员会、人民法院和人民检察院的专项工作报告的议题，根据有关法律的规定和下列途径反映的问题确定： |
| (1)Outstanding issues found by the standing committee of the people's congress at the corresponding level in its law enforcement examination; | | （一）本级人民代表大会常务委员会在执法检查中发现的突出问题； |
| (2)Issues collectively reflected in the suggestions, criticism and opinions put forward by the deputies of the people's congress at the corresponding level to the people's government, the supervisory commission, the people's court and the people's procuratorate; | | （二）本级人民代表大会代表对人民政府、监察委员会、人民法院和人民检察院工作提出的建议、批评和意见集中反映的问题； |
| (3)Fairly focused issues put forward by the members of the standing committee of the people's congress at the corresponding level; | | （三）本级人民代表大会常务委员会组成人员提出的比较集中的问题； |
| (4)Outstanding issues found by the special committee of the people's congress at the corresponding level or the working body of the standing committee in its survey and research; | | （四）本级人民代表大会专门委员会、常务委员会工作机构在调查研究中发现的突出问题； |
| (5)Issues collectively reflected in the complaint letters and visits of the general public; and | | （五）人民来信来访集中反映的问题； |
| (6)Other issues concerned by the general public. | | （六）社会普遍关注的其他问题。 |
| The people's government, the supervisory commission, the people's court and the people's procuratorate can request to report its special work to the standing committee of the people's congress at the corresponding level. | | 人民政府、监察委员会、人民法院和人民检察院可以向本级人民代表大会常务委员会要求报告专项工作。 |
| The standing committees shall, in accordance with the provisions of the law, listen to and deliberate the reports of the people's governments at the corresponding levels on the status of the environment and the achievement of environmental protection objectives. | | 常务委员会根据法律规定，听取和审议本级人民政府关于环境状况和环境保护目标完成情况的报告。 |
| Article 13 Before the standing committee hears and deliberates special work reports, the chairmen's meeting or the directors' meeting can organize the members of the standing committee of the people's congress at the corresponding level and the deputies of the people's congress at the corresponding level to make a personal inspection or special survey and research about the relevant work. | | 第十三条 常务委员会听取和审议专项工作报告前，委员长会议或者主任会议可以组织本级人民代表大会常务委员会组成人员和本级人民代表大会代表，对有关工作进行视察或者专题调查研究。 |
| The standing committee can arrange the deputies who have participated in the personal inspection or special survey and research to attend the meeting of the standing committee as non-voting delegates, hear special work reports and put forward suggestions. | | 常务委员会可以安排参加视察或者专题调查研究的代表列席常务委员会会议，听取专项工作报告，提出意见。 |
| Before the standing committee listens to and deliberates a special work report, the relevant special committee of the people's congress at the corresponding level or the relevant working body of the standing committee may conduct special investigations and studies, prepare a report and issue it to the meeting of the standing committee. | | 常务委员会听取和审议专项工作报告前，本级人民代表大会有关专门委员会或者常务委员会有关工作机构可以进行专题调查研究，提出报告并印发常务委员会会议。 |
| Article 14 Before the standing committee hears and deliberates a special work report, the working body of the standing committee shall collect the opinions of all the parties about this work, and submit these opinions to the people's government, the supervisory commission, the people's court or the people's procuratorate at the corresponding level for study and response in the special work report. | | 第十四条 常务委员会听取和审议专项工作报告前，常务委员会办事机构应当将各方面对该项工作的意见汇总，交由本级人民政府、监察委员会、人民法院或者人民检察院研究并在专项工作报告中作出回应。 |
| Article 15 The people's government, the supervisory commission, the people's court or the people's procuratorate shall, within 20 days before the standing committee holds a meeting, let its working body submit a special work report to the relevant special committee of the people's congress at the corresponding level or the relevant working body of the standing committee for soliciting opinions. And after the people's government, the supervisory commission, the people's court or the people's procuratorate revises the special work report, it shall submit the report to the standing committee within 10 days before the standing committee holds the meeting. | | 第十五条 人民政府、监察委员会、人民法院或者人民检察院应当在常务委员会举行会议的二十日前，由其办事机构将专项工作报告送交本级人民代表大会有关专门委员会或者常务委员会有关工作机构征求意见；人民政府、监察委员会、人民法院或者人民检察院对报告修改后，在常务委员会举行会议的十日前送交常务委员会。 |
| The working body of the standing committee shall send out special work reports to the members of the standing committee within 7 days before the standing committee holds the meeting. | | 常务委员会办事机构应当在常务委员会举行会议的七日前，将专项工作报告发给常务委员会组成人员。 |
| Article 16 A special work report shall be reported by the person-in-charge of the people's government, the supervisory commission, the people's court or the people's procuratorate to the standing committee of the people's congress at the corresponding level, and the people's government may also entrust the person-in-charge of the relevant department to make a report to the standing committee of the people's congress at the corresponding level. | | 第十六条 专项工作报告由人民政府、监察委员会、人民法院或者人民检察院的负责人向本级人民代表大会常务委员会报告，人民政府也可以委托有关部门负责人向本级人民代表大会常务委员会报告。 |
| The Council of Chairmen or the Council of Directors may decide to submit the report to the relevant special committee for deliberation. | | 委员长会议或者主任会议可以决定将报告交有关专门委员会审议。 |
| Article 17 The deliberation opinions of the members of the standing committee about special work reports shall be submitted to the people's government, the supervisory commission, the people's court or the people's procuratorate at the corresponding level for study and disposal. The people's government, the supervisory commission, the people's court or the people's procuratorate shall, after its working body reports the conditions on study and disposal to the relevant special committee of the people's congress at the corresponding level or the working body of the standing committee for soliciting opinions, give a written report to the standing committee. The standing committee can, if it considers it necessary, make a resolution on the special work report; and the people's government, the supervisory commission, the people's court or the people's procuratorate at the corresponding level shall report the conditions on implementing the resolution to the standing committee within the time limit as prescribed in the resolution. | | 第十七条 常务委员会组成人员对专项工作报告的审议意见交由本级人民政府、监察委员会、人民法院或者人民检察院研究处理。人民政府、监察委员会、人民法院或者人民检察院应当将研究处理情况由其办事机构送交本级人民代表大会有关专门委员会或者常务委员会有关工作机构征求意见后，向常务委员会提出书面报告。常务委员会认为必要时，可以对专项工作报告作出决议；本级人民政府、监察委员会、人民法院或者人民检察院应当在决议规定的期限内，将执行决议的情况向常务委员会报告。 |
| The Council of Chairmen or the Council of Directors may decide to submit to the Standing Committee for deliberation a report on the study and handling of the deliberation opinions or on the implementation of the resolution. If necessary, the standing committee may carry out follow-up supervision. | | 委员长会议或者主任会议可以决定将审议意见研究处理情况或者执行决议情况的报告提请常务委员会审议。必要时，常务委员会可以组织开展跟踪监督。 |
| The special work reports and deliberation opinions heard by the standing committee, as well as the reports of the people's government, the supervisory commission, the people's court or the people's procuratorate regarding the study and disposal of deliberation opinions or the implementation of resolutions shall be circulated to the deputies of the people's congress at the corresponding level and be announced to the general public. | | 常务委员会听取的专项工作报告及审议意见，人民政府、监察委员会、人民法院或者人民检察院对审议意见研究处理情况或者执行决议情况的报告，向本级人民代表大会代表通报并向社会公布。 |
| Chapter III Supervision over the Financial and Economic Work | | 第三章 财政经济工作监督 |
| Article 18 For the purposes of this Law, ‘supervision over the financial and economic work' means that the standing committee supervises the following matters according to the law: | | 第十八条 本法所称财政经济工作监督，是指常务委员会依法对下列事项进行监督： |
| (1)The examination and approval of the final accounts at the corresponding level. | | （一）审查和批准本级决算； |
| (2)The implementation of the outline of the five-year plan for national economic and social development and the plan for national economic and social development. | | （二）国民经济和社会发展五年规划纲要实施情况，国民经济和社会发展计划执行情况； |
| (3)The implementation of the budget. | | （三）预算执行情况； |
| (4)The examination and approval of the adjustments to the outline of the five-year plan for national economic and social development and to the plan for national economic and social development. | | （四）审查和批准国民经济和社会发展五年规划纲要、计划的调整方案； |
| (5)The examination and approval of the budget adjustment plans. | | （五）审查和批准预算调整方案； |
| (6)The management of state-owned assets. | | （六）国有资产管理情况； |
| (7)The management of government debt. | | （七）政府债务管理情况； |
| (8)The financial work. | | （八）金融工作情况； |
| (9)The audit of budget implementation and other fiscal revenues and expenditures, and the rectification of problems identified through audit. | | （九）预算执行和其他财政收支的审计工作情况、审计查出问题整改情况； |
| (10)Other important matters in the financial and economic fields. | | （十）财政经济领域其他重要事项。 |
| Article 19 The State Council shall, in June each year, submit the draft final accounts of the Central Government for the previous year to the Standing Committee of the National People's Congress for examination and approval. | | 第十九条 国务院应当在每年六月，将上一年度的中央决算草案提请全国人民代表大会常务委员会审查和批准。 |
| ．．．．．． | | 县级以上地方各级人民政府应当在每年六月至九月期间，将上一年度的本级决算草案提请本级人民代表大会常务委员会审查和批准。 |
