Strengthening the regulation of collection of enterprise-related fees, as an important measure for reducing the operating costs of enterprises and optimizing the business environment, is of great significance for stimulating market vitality and promoting high-quality economic and social development. For the purposes of implementing the decisions and deployments of the CPC Central Committee and the State Council, and establishing and improving the long-term regulatory mechanism for collection of enterprise-related fees, with the consent of the State Council, the following opinions are hereby put forward. | | 加强涉企收费监管是降低企业经营成本、优化营商环境的重要举措,对激发市场活力、促进经济社会高质量发展具有重要意义。为贯彻落实党中央、国务院决策部署,建立健全涉企收费长效监管机制,经国务院同意,现提出以下意见。 |
I. General requirements | | 一、总体要求 |
Under the guidance of the Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era, the spirit of the 20th CPC National Congress and the Second and Third Plenary Sessions of the 20th CPC Central Committee shall be implemented in an in-depth manner, problem orientation and addressing both symptoms and root causes shall be insisted on, and by focusing on enterprise-related fee collection entities such as government departments and their subordinate entities, administrative approval intermediary agencies service institutions, industry associations and chambers of commerce, and enterprises operating natural monopoly business, joint efforts shall be made to optimize the business environment, improve the regulatory system for collection of enterprise-related fees, intensify efforts to control illegal fees, strengthen whole-process regulation and coordinated regulation, and establish a coordinated and efficient long-term regulatory mechanism. | | 以习近平新时代中国特色社会主义思想为指导,深入贯彻党的二十大和二十届二中、三中全会精神,坚持问题导向、防治并举、标本兼治,聚焦政府部门及下属单位、行政审批中介服务机构、行业协会商会、经营自然垄断环节业务的企业等涉企收费主体,着力优化营商环境,健全涉企收费监管制度,加大违规收费治理力度,强化全过程监管和协同监管,构建协同高效的长效监管机制。 |
II. Key tasks | | 二、重点任务 |
1. Improving the system of catalogues and lists of enterprise-related fees. Administrative fees, government-managed funds, enterprise-related margin for the departments of the State Council, and government-priced operational service fees shall be subject to catalog and list management, and the National Development and Reform Commission, the Ministry of Industry and Information Technology and the Ministry of Finance shall develop the catalog and list of fees according to their duties and division of labor and disclose them to the public. A competent industry department shall develop a comprehensive catalog list of enterprise-related fees of its own department and its subordinate entities, covering administrative fees, government-managed funds, enterprise-related margin, operational service fees and other fee items, and specify the service contents, service standards, and fee rate, to achieve full coverage of a catalog list of enterprise-related fees of each department. All provincial people's governments shall improve the catalog list system for collection of enterprise-related fees in local areas. All localities and relevant departments shall update and publish the catalog list of fees in a timely manner, and no fees not included in the list shall be collected. | | (一)健全涉企收费目录清单制度。行政事业性收费、政府性基金、国务院部门涉企保证金、政府定价的经营服务性收费实行目录清单管理,由国家发展改革委、工业和信息化部、财政部按职责分工制定收费目录清单并向社会公开。行业主管部门要制定本部门及下属单位综合性涉企收费目录清单,涵盖行政事业性收费、政府性基金、涉企保证金、经营服务性收费等收费项目,明确服务内容、服务标准、收费水平,实现每个部门涉企收费一张目录清单全覆盖。各省级人民政府要健全本地区涉企收费目录清单制度。各地区、各有关部门要及时更新发布收费目录清单,清单之外一律不得收费。 |
2. Improving the working mechanism for the evaluation and review of policies for collecting enterprise-related fees. When carrying out the consistency assessment, legitimacy review, and fair competition examination of macro-policy orientation in accordance with the provisions, the development and reform, justice, market regulation and other departments shall strengthen the evaluation and review of the legitimacy, fairness and social expected impact of the newly issued policies for collecting enterprise-related fees. The competent industry departments and subordinate entities, administrative approval intermediary agencies service institutions, industry associations and chambers of commerce, among others, shall strengthen evaluation and demonstration of enterprise-related fee items, and strictly prohibit the establishment of new enterprise-related fee items in violation of regulations. The State Administration for Market Regulation shall, in conjunction with relevant departments, study and develop guidelines for the evaluation, review and demonstration of policies for collecting enterprise-related fees, and specify the responsibilities, basis, scope, standards and rules; and carry out special rectification of existing policies for collecting enterprise-related fees, clean up policies for illegal collection of fees in accordance with laws and regulations, and cancel fee items in accordance with laws and regulations. | | (二)完善涉企收费政策评估审核工作机制。发展改革、司法行政、市场监管等部门按规定开展宏观政策取向一致性评估、合法性审核、公平竞争审查等工作时,要加强对新出台涉企收费政策合法性、公平性以及社会预期影响等方面的评估审核。行业主管部门及下属单位、行政审批中介服务机构、行业协会商会等要加强涉企收费项目评估论证,严禁违规新设涉企收费项目。市场监管总局要会同有关部门研究制定涉企收费政策评估审核和论证工作指引,明确职责、依据、范围、标准、规则等;对存量涉企收费政策开展专项整治,依法依规清理违规收费政策,违法违规收费项目一律取消。 |
