| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 This Regulation is developed in accordance with the Civil Code of the People's Republic of China (“Civil Code”) for the purposes of regulating marriage registration, safeguarding the implementation of the marriage system featuring free choice of partners, monogamy, and equality between men and women, and protecting the lawful rights and interests of both parties to marriage. | | 第一条 为了规范婚姻登记工作，保障婚姻自由、一夫一妻、男女平等的婚姻制度的实施，保护婚姻当事人的合法权益，根据《中华人民共和国民法典》（以下简称民法典），制定本条例。 |
| Article 2 The authority responsible for undergoing marriage registration for Chinese mainland residents is the civil affairs department of the people's government at the county level or the township (town) people's government determined by the people's government of the province, autonomous region, or municipality directly under the Central Government under the principle of convenience for the people. | | 第二条 内地居民办理婚姻登记的机关是县级人民政府民政部门或者省、自治区、直辖市人民政府按照便民原则确定的乡（镇）人民政府。 |
| The authority in charge of marriage registration for the marriage between a Chinese citizen and a foreigner, or between a mainland resident and a resident of the Hong Kong Special Administrative Region (“a Hong Kong resident”), a resident of the Macao Special Administrative Region (“a Macao resident”), a resident of the Taiwan Region (“a Taiwan resident”), or an overseas Chinese shall be the civil affairs department of the people's government of the province, autonomous region, or municipality directly under the Central Government or the organ determined by the aforesaid department. | | 中国公民同外国人，内地居民同香港特别行政区居民（以下简称香港居民）、澳门特别行政区居民（以下简称澳门居民）、台湾地区居民（以下简称台湾居民）、华侨办理婚姻登记的机关是省、自治区、直辖市人民政府民政部门或者省、自治区、直辖市人民政府民政部门确定的机关。 |
| Article 3 Local people's governments at and above the county level shall take measures to improve marriage registration services, strengthen the standardization and accessibility of marriage registration venues, and provide guarantees for marriage registration. | | 第三条 县级以上地方人民政府应当采取措施提升婚姻登记服务水平，加强对婚姻登记场所的规范化、便利化建设，为办理婚姻登记提供保障。 |
| Article 4 The civil affairs department of the State Council shall coordinate, plan, and improve the national basic marriage information database, and in conjunction with foreign affairs, public security and other relevant departments, and the Supreme People's Court, establish and improve an information sharing mechanism to ensure that the marriage-related information is accurate, timely, complete, and safe. The civil affairs department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall be responsible for coordinating the development, management, maintenance, and information security of the marriage registration information system in its region. | | 第四条 国务院民政部门统筹规划、完善全国婚姻基础信息库，会同外交、公安等有关部门以及最高人民法院建立健全信息共享机制，保障婚姻信息准确、及时、完整、安全。省、自治区、直辖市人民政府民政部门负责统筹本地区婚姻登记信息系统的建设、管理、维护和信息安全工作。 |
| Article 5 Local people's governments at and above the county level shall strengthen the guidance of comprehensive marriage and family services and the construction of marriage and family counseling service systems, address the issue of high betrothal gifts, advocate civilized marriage customs, promote family harmony, and guide the establishment of correct views on love, marriage, childbearing, and family. | | 第五条 县级以上地方人民政府应当加强综合性婚姻家庭服务指导工作和婚姻家庭辅导服务体系建设，治理高额彩礼问题，倡导文明婚俗，促进家庭和谐，引导树立正确的婚恋观、生育观、家庭观。 |
| Marriage registration authorities shall provide marriage and family counseling services, maximize the role of marriage and family counselors and other professionals and other social forces in premarital education, counseling on marriage and family relationships, and other aspects. Women's federations and other organizations shall assist and cooperate with marriage registration authorities in providing marriage and family counseling services. | | 婚姻登记机关应当提供婚姻家庭辅导服务，充分发挥婚姻家庭辅导师等专业人员和其他社会力量在婚前教育、婚姻家庭关系辅导等方面的作用。妇女联合会等组织协助和配合婚姻登记机关开展婚姻家庭辅导服务。 |
| Civil affairs departments shall strengthen the team building of marriage and family counseling service professionals, organize vocational training for marriage and family counselors, and continuously improve the professional quality and business skills of professionals providing marriage and family counseling services. | | 民政部门应当加强婚姻家庭辅导服务专业人员队伍建设，组织开展婚姻家庭辅导师职业培训，持续提升婚姻家庭辅导服务专业人员的职业素质和业务技能水平。 |
| Article 6 The staff members engaged in marriage registration in marriage registration authorities shall receive training for marriage registration services and may engage in marriage registration only after passing the examination in accordance with relevant provisions. | | 第六条 婚姻登记机关从事婚姻登记的工作人员应当接受婚姻登记业务培训，依照有关规定经考核合格，方可从事婚姻登记工作。 |
| Marriage registration authorities shall not charge fees for undergoing marriage registration. | | 婚姻登记机关办理婚姻登记，不得收取费用。 |
| If the marriage registration authority or any of its staff members discovers any woman suspected of being abducted and trafficked, or kidnapped in the marriage registration work, it or he shall promptly report to the relevant authority in accordance with the law. If it or he finds that the party is suffering from domestic violence or faces the actual danger of domestic violence, it or he shall promptly dissuade the victim from such violence and inform the victim of the ways to request assistance. | | 婚姻登记机关及其工作人员在婚姻登记工作中发现疑似被拐卖、绑架的妇女的，应当依法及时向有关部门报告；发现当事人遭受家庭暴力或者面临家庭暴力的现实危险的，应当及时劝阻并告知受害人寻求救助的途径。 |
| Marriage registration authorities and their staff members shall keep confidential the personal privacy and personal information to which they have access in the marriage registration work and shall not divulge or illegally provide such information to others. | | 婚姻登记机关及其工作人员应当对在婚姻登记工作中知悉的个人隐私、个人信息予以保密，不得泄露或者向他人非法提供。 |
| Chapter II Marriage Registration | | 第二章 结婚登记 |
| Article 7 For a marriage between two mainland residents, both the man and the woman shall jointly apply for marriage registration in person at the marriage registration authority. | | 第七条 内地居民结婚，男女双方应当亲自到婚姻登记机关共同申请结婚登记。 |
