| Provisions on Several Issues Concerning the Jurisdiction of Military Courts in Civil Cases | | 关于军事法院管辖民事案件若干问题的规定 |

| According to the provisions of the Law of the People's Republic of China on the Organization of the People's Courts and the Civil Procedure Law of the People's Republic of China and other laws, these Provisions on several issues concerning the jurisdiction of military courts in civil cases are formulated in light of trials: | | 根据《中华人民共和国人民法院组织法》《中华人民共和国民事诉讼法》等法律规定，结合审判实践，就军事法院管辖民事案件有关问题，制定本规定。 |
| Article 1 The following civil cases shall be under the jurisdiction of military courts: | | 第一条 下列民事案件，由军事法院管辖： |
| (1) Cases in which the parties on both sides are service members or military entities. | | （一）双方当事人均为军人或者军队单位的案件； |
| (2) Cases where the material evidence establishing the basic facts of the case involves any military secrets. | | （二）认定案件基本事实的主要证据涉及军事秘密的案件； |
| (3) Cases arising from a tort dispute where the tort occurs at a camp and where the party on either side is a service member or military entity. | | （三）侵权行为发生在营区内的侵权责任纠纷，且当事人一方为军人或者军队单位的案件； |
| (4) Cases where a member of the civilian staff of the armed forces subject to the employment system files a lawsuit in accordance with the law against an arbitral award for a labor and personnel dispute with a military entity over the rescission or termination of an employment contract. | | （四）军队聘用制文职人员与军队单位发生解除或者终止聘用合同争议，不服劳动人事争议仲裁裁决，依法提起诉讼的案件； |
| (5) Cases of an application for a declaration of a service member being missing or deceased. | | （五）申请宣告军人失踪或者死亡的案件； |
| (6) Cases of an application for determining civil incompetency or limited civil competency of a service member and appointing a guardian. | | （六）申请认定军人无民事行为能力或者限制民事行为能力以及相应的指定监护人的案件； |
| (7) Cases over eligibility of voters for the electoral commission established by the military. | | （七）军队设立选举委员会的选民资格案件； |
| (8) Cases over the identification of unclaimed property within camps. | | （八）认定营区内无主财产案件。 |
