The Interpretation by the Supreme People's Court and the Supreme People's Procuratorate of Several Issues Concerning the Application of Law in Handling Criminal Cases of Damaging Black Soil Resources, adopted at the 1946th meeting of the Adjudication Committee of the Supreme People's Court on March 25, 2025 and at the 51st meeting of the 14th Procuratorial Committee of the Supreme People's Procuratorate on April 11, 2025, is hereby issued and shall come into force on May 6, 2025. 《最高人民法院、最高人民检察院关于办理破坏黑土地资源刑事案件适用法律若干问题的解释》已于2025年3月25日由最高人民法院审判委员会第1946次会议、2025年4月11日由最高人民检察院第十四届检察委员会第五十一次会议通过,现予公布,自2025年5月6日起施行。

Interpretation by the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases of Damaging Black Soil Resources 最高人民法院 最高人民检察院关于办理破坏黑土地资源刑事案件适用法律若干问题的解释
(Adopted at the 1946th meeting of the Adjudication Committee of the Supreme People's Court on March 25, 2025 and at the 51st meeting of the 14th Procuratorial Committee of the Supreme People's Procuratorate on April 11, 2025 and coming into force on May 6, 2025, SPC Interpretation No. 7 [2025]) (2025年3月25日最高人民法院审判委员会第1946次会议、2025年4月11日最高人民检察院第十四届检察委员会第五十一次会议通过,自2025年5月6日起施行 法释〔2025〕7号)
For the purposes of protecting black soil in accordance with the law and punishing crimes of damaging black soil resources, the following interpretation of several issues concerning the application of law in handling the criminal cases is hereby given in accordance with the relevant provisions of the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, and the Black Soil Protection Law of the People's Republic of China: 为依法保护黑土地,惩治破坏黑土地资源犯罪,根据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》《中华人民共和国黑土地保护法》等法律的有关规定,现就办理此类刑事案件适用法律的若干问题解释如下:
Article 1 Any violation of the regulations on land administration that falls under any of the following circumstances shall be determined as unlawful occupation of cultivated land and change of the use of the occupied land, damaging cultivated land, as provided for in Article 342 of the Criminal Law:   第一条 违反土地管理法规,具有下列情形之一的,应当认定为刑法三百四十二条规定的非法占用耕地,改变被占用耕地用途,造成耕地毁坏:
(1) Unlawfully occupying black soil to construct a building, kiln, tomb, lake for landscaping, or otherwise engage in engineering construction. (一)非法占用黑土地实施建房、建窑、建坟、挖湖造景等工程建设的;
(2) Unlawfully occupying black soil for activities such as sand mining, quarrying, mineral mining, and soil mining. (二)非法占用黑土地实施挖砂、采石、采矿、取土等活动的;
(3) Unlawfully occupying black soil to discharge pollutants or stack waste, among others, causing serious pollution of the black soil. (三)非法占用黑土地排放污染物、堆放废弃物等造成黑土地被严重污染的;
(4) Otherwise unlawfully occupying black soil, changing the use of the occupied black soil, and causing damage to the black soil. (四)其他非法占用黑土地,改变被占用黑土地用途,造成黑土地毁坏的情形。
An act specified in the preceding paragraph under any of the following circumstances shall be determined as a circumstance that "the area involved is relatively large and a large area of such land is damaged" specified in Article 342 of the Criminal Law: 实施前款规定的行为,具有下列情形之一的,应当认定为刑法三百四十二条规定的“数量较大,造成耕地、林地等农用地大量毁坏”:
(1) Unlawfully occupying and damaging not less than three mu of black soil that is permanent basic farmland, or not less than six mu of black soil other than permanent basic farmland. (一)非法占用并毁坏属于永久基本农田的黑土地三亩以上,或者非法占用并毁坏永久基本农田以外的黑土地六亩以上的;
(2) Unlawfully mining not less than 500 cubic meters of black soil from black soil that is permanent basic farmland, or not less than 1,000 cubic meters of black soil from black soil other than permanent basic farmland. (二)非法在属于永久基本农田的黑土地上取黑土五百立方米以上,或者非法在永久基本农田以外的黑土地上取黑土一千立方米以上的;
(3) Unlawfully occupying and damaging black soil, or unlawfully mining black soil from black soil , of which the amount, though falling short of the standards specified in sub-paragraphs (1) or (2), reaches the threshold in aggregate when converted in proportion based on corresponding standards. (三)非法占用并毁坏黑土地,或者非法在黑土地上取黑土,数量虽未分别达到第一项、第二项规定标准,但按相应标准的比例折算合计达到标准的;
