| Regulation on the Administration of Military Land | | 军用土地管理条例 |
| Article 1 This Regulation is developed in accordance with the National Defense Law of the People's Republic of China, the Land Administration Law of the People's Republic of China, and other laws for the purposes of strengthening the administration of military land, protecting and rationally utilizing military land, and meeting the needs of national defense and military development. | | 第一条 为了加强军用土地管理，保护和合理利用军用土地，保障国防和军队建设需要，根据《中华人民共和国国防法》、《中华人民共和国土地管理法》等法律，制定本条例。 |
| Article 2 For the purposes of this Regulation, “military land” means the land used and administered by military entities in accordance with the law, but excludes the land leased or borrowed by military entities. | | 第二条 本条例所称军用土地，是指依法由军队单位使用管理的土地，但不包括军队单位租用、借用的土地。 |
| Article 3 Military land is an important basic resource for national defense and military development. The state guarantees the needs for the land used for national defense and military development and provides strong support for consolidating national defense and strengthening and revitalizing the armed forces. | | 第三条 军用土地是国防和军队建设的重要基础资源。国家保障国防和军队建设用地需要，为巩固国防、强军兴军提供有力支撑。 |
| Article 4 The administration of military land shall uphold the leadership of the Communist Party of China, implement Xi Jinping Thought on Strengthening the Military and the military strategy for the new era, and adhere to the principles of being driven by military needs, coordinated military and civilian support, optimized resource allocation, and resource conservation and efficient utilization. | | 第四条 军用土地管理工作坚持中国共产党的领导，贯彻习近平强军思想，贯彻新时代军事战略方针，坚持军事需求牵引、军地统筹保障、优化资源配置、节约集约利用的原则。 |
| Article 5 The rights to use military land belong to the Central Military Commission, and shall be exercised by the Logistics Support Department of the Central Military Commission on behalf of the Central Military Commission. | | 第五条 军用土地的使用权属于中央军事委员会，由中央军事委员会后勤保障部代表中央军事委员会行使。 |
| Logistics support departments of military entities at or above the regimental level are responsible for the specific work concerning the administration of the entities' use of military land according to their prescribed functions and powers. | | 军队团级以上单位后勤保障部门按照规定职权，负责本单位军用土地使用管理的具体工作。 |
| The natural resources and other departments of the people's governments at or above the county level are responsible for land administration in accordance with laws and regulations and according to their prescribed duties. | | 县级以上人民政府自然资源等主管部门依照法律法规和规定的职责负责土地管理工作。 |
| Article 6 The Logistics Support Department of the Central Military Commission shall, in accordance with the territorial spatial planning and the requirements for the national defense and military development, strengthen the overall planning for military land use, guide the optimized allocation of military land resources, and improve the efficiency of resource utilization. | | 第六条 中央军事委员会后勤保障部应当根据国土空间规划，按照国防和军队建设发展要求，加强对军用土地使用的统筹规划，引导军用土地资源优化配置，提高资源利用效益。 |
| Article 7 Military land shall undergo the real estate registration formalities in accordance with the law. | | 第七条 军用土地应当依法办理不动产登记。 |
| An application for the real estate registration of military land shall be filed by the military entity at or above the regimental level with the real estate registration authority of the people's government at or above the county level at the place where the land is located. If it is otherwise provided by the state for real estate registration, such provisions shall prevail. | | 办理军用土地不动产登记，由军队团级以上单位向土地所在地县级以上地方人民政府不动产登记机构提出申请；国家对不动产登记另有规定的，从其规定。 |
| In the registration, the right holder of military land shall be the Logistics Support Department of the Central Military Commission, and the code of the military entity using and administering the land shall be indicated. If there is no military entity code, the name of the military entity shall be indicated. | | 军用土地的权利人登记为中央军事委员会后勤保障部，同时注明具体使用管理的军队单位代号，没有军队单位代号的注明军队单位名称。 |
| Article 8 A people's government at or above the county level shall confirm that the right to use the following land belongs to the military in accordance with relevant provisions, except that there is evidence to the contrary: | | 第八条 对于下列土地，县级以上人民政府应当按照有关规定确认其使用权属于军队，但是有相反证据证明的除外： |
| (1) The land reclaimed from the sea or lakes or developed or reclaimed by the military in accordance with laws and regulations. | | （一）军队依法依规填海、围湖和开垦复垦的土地； |
| (2) Farms, stud farms, forest farms, pastures, aquaculture farms, training grounds, shooting ranges, old airports, and other land received by the military, not transferred to local governments, and still used and administered by the military. | | （二）由军队接收、没有移交地方且仍由军队使用管理的农场、马场、林场、牧场、水产养殖场、训练场、靶场、旧机场等土地； |
| (3) The land that is occupied by military entities before the Land Administration Law of the People's Republic of China issued on January 1, 1987, takes effect and has been used and administered by them until now. | | （三）1987年1月1日《中华人民共和国土地管理法》施行前由军队单位占有并一直使用管理至今的土地。 |
| Article 9 Military entities shall organize the survey and statistics of military land in accordance with the natural resources survey and monitoring and cadastral survey requirements of the state and based on the needs of military construction and development. | | 第九条 军队单位按照国家自然资源调查监测、地籍调查要求和军队建设发展需要，组织军用土地调查、统计。 |
| Article 10 As for land use for military construction, priority shall be given to the use of existing military land; and where new construction land is indeed required, it shall comply with the territorial spatial planning, annual plans for land utilization, and land use control requirements, among others, unused land shall be used as much as possible, and relevant formalities for the land used for construction projects shall be undergone in accordance with the law. | | 第十条 军队建设使用土地，应当优先使用存量军用土地；确需新增建设用地的，应当符合国土空间规划、土地利用年度计划和用途管制等要求，尽可能使用未利用地，并依法办理建设项目用地相关手续。 |
