| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 These Measures are formulated in accordance with the Fisheries Law of the People's Republic of China, the Hainan Free Trade Port Law of the People's Republic of China, the Anti-smuggling Regulation of the Hainan Free Trade Port (for Trial Implementation), and other relevant laws, regulations, and provisions, and in light of the actual circumstances of the Hainan Free Trade Port, for the purposes of maintaining the order of navigation, berthing, and operation of fishing vessels and regulating the administration of the entry into and exit from the Hainan Free Trade Port of fishing vessels, fishermen, and catches. | | 第一条 为维护渔船航行、停泊、作业秩序，规范渔船、渔民、渔获进出海南自由贸易港的管理，根据《中华人民共和国渔业法》《中华人民共和国海南自由贸易港法》《海南自由贸易港反走私条例（试行）》等有关法律法规和相关规定，结合海南自由贸易港实际，制定本办法。 |
| Article 2 These Measures apply to the administration of the entry into and exit from the Hainan Free Trade Port of fishing vessels, fishermen, and catches. | | 第二条 本办法适用于渔船、渔民、渔获进出海南自由贸易港的管理。 |
| Article 3 For the purposes of these Measures, “fishing vessel” means a vessel engaged in fishery-related operations, including any marine fishing vessel, marine fishing auxiliary vessel, marine recreational fishing vessel, or vessel for self-use by village or community residents that is under transitional management. | | 第三条 本办法所称渔船，是指从事渔业有关活动的船舶，包括海洋捕捞渔船、海洋捕捞辅助船、海洋休闲渔船和实行过渡期管理的村（居）民家庭自用船舶。 |
| For the purposes of these Measures, “fisherman” means any crew member who enters or exits together with a fishing vessel. | | 本办法所称渔民，是指随渔船进出的所有船上工作人员。 |
| For the purposes of these Measures, “catch” means any aquatic organism of economic value obtained through fishery production activities. | | 本办法所称渔获，是指从事渔业生产活动取得的具有经济价值的水生生物。 |
| Passengers participating in recreational fishery activities onboard recreational fishing vessels, together with the articles they carry, the cargo loaded on such vessels, and the articles carried by fishermen, shall be subject to administration in accordance with the relevant provisions issued by the Hainan Free Trade Port. | | 搭乘休闲渔船参与休闲渔业活动的游客及其携带物品、渔船所载货物、渔民携带物品按照海南自由贸易港的有关规定进行管理。 |
| Article 4 The agricultural and rural affairs departments at or above the county level shall strengthen fishery informatization and establish a sound mechanism for administering the entry into and exit from the Hainan Free Trade Port of fishing vessels, fishermen, and catches to achieve intelligent perception, visualized situational monitoring, and controllable event early warning in relation to such entry and exit. | | 第四条 县级以上农业农村主管部门加强渔业信息化建设，建立科学的渔船、渔民、渔获进出海南自由贸易港管理机制，实现对渔船、渔民、渔获进出的智能化感知、可视化态势监测、可控化事件预警。 |
| All relevant departments shall strengthen information interconnectivity and coordinated law enforcement and establish a mechanism for coordination and collaboration to further promote port-based management of vessels and fisheries. | | 各部门间加强信息互联互通、联动执法，形成协调联动机制，深化依港管船、依港管渔。 |
| Article 5 The agricultural and rural affairs departments at or above the county level shall be responsible for supervising and administering the entry into and exit from areas without customs offices of fishing vessels, fishermen, and catches. | | 第五条 县级以上农业农村主管部门负责非设关地进出的渔船、渔民、渔获进出的监督管理。 |
| The coastal administration departments of the public security authorities, the Customs, the Coast Guard, the maritime safety administration, and other relevant departments shall, within their respective functions and duties, supervise and administer the entry into and exit from the Hainan Free Trade Port of fishing vessels, fishermen, and catches. | | 公安机关海岸管理部门、海关、海警、海事等相关部门在各自职责范围内对渔船、渔民、渔获进出进行监督管理。 |
| The Hainan Marine and Fishery Supervision Corps and the comprehensive agency law enforcement department shall, within their respective authority, investigate and handle administrative violations involving the entry into and exit from areas without customs offices of fishing vessels and fishermen. | | 海南省海洋和渔业监察总队、综合行政执法部门依职权查处非设关地进出渔船及渔民的行政违法行为。 |
| Article 6 The people's governments of coastal cities, counties, and autonomous counties shall reasonably delineate zones for the berthing of all categories of fishing vessels, the loading and unloading of cargo, and the embarking and disembarking of personnel, and shall be responsible for the supporting construction and maintenance thereof. The delineated zones shall take into account the convenience of production and daily life, meet regulatory requirements, and shall be placed under the supervision of coordinated anti-smuggling law enforcement outposts. | | 第六条 沿海市、县、自治县人民政府应当合理划定各类渔船停泊、上下货物物品和上下人员区域并负责配套建设和维护，划定区域应当考虑生产生活便利性，所划定区域应具备监管条件并纳入反走私综合执法点监管。 |
| Designated berthing zones for fishing vessels include fishing port docks and fishing vessel berthing areas (points). Fishing vessels shall berth, load and unload catches, and embark and disembark personnel only within designated berthing zones. | | 渔船指定停泊区域包括渔港码头及渔船停泊区（点）。渔船应当在指定的渔船停泊区域停泊、装卸渔获和上下人员。 |
| Vessels for self-use by village or community residents under transitional management shall berth and navigate only within the zones delineated by the people's governments of cities, counties, or autonomous counties. | | 实行过渡期管理的村（居）民家庭自用船舶应当在市、县、自治县人民政府划定的区域内停泊和航行。 |
| Article 7 Organizational management shall be implemented province-wide for fishing vessels, and all fishing vessels shall be encouraged to establish or join fishing vessel management and service organizations. Such organizations shall exercise industry self-regulation over their members, enhance their fishery service capacity according to the delegated authority, and assist and cooperate with competent departments in administering the entry and exit of fishing vessels, fishermen, and catches. | | 第七条 全省渔船推行组织化管理，鼓励所有渔船建立或者加入渔船管理服务组织。渔船管理服务组织对所属成员进行行业自我管理，根据赋权增强渔业服务能力，协助、配合管理部门对渔船、渔民、渔获进出的管理。 |
| Fishing vessel management and service organizations include fishery enterprises, fishery cooperatives, fishery associations (societies), village collective economic organizations, village (community) committees, and other legal persons or unincorporated organizations. | | 渔船管理服务组织类型包括渔业企业、渔业合作组织、渔业社团（协会）、村集体经济组织、村（居）民委员会等法人或非法人组织。 |
| Specific measures for the organizational development of fishing vessels shall be formulated separately by the provincial department of agriculture and rural affairs. | | 渔船组织化建设的具体办法由省农业农村主管部门另行制定。 |
| Article 8 The provincial department of agriculture and rural affairs shall be responsible for the credit administration concerning the entry and exit of fishing vessels, fishermen, and catches. Such administration shall be incorporated into the social credit system, and systems of credit commitment and credit record for entry and exit shall be established. | | 第八条 省级农业农村主管部门负责渔船、渔民、渔获进出的信用管理工作，纳入社会信用体系，建立进出信用承诺制度和信用档案制度。 |
