Provisions of the People's Republic of China on the Customs Administration of Registration of Overseas Production Enterprises of Imported Food 

中华人民共和国海关进口食品境外生产企业注册管理规定

(Issued by Order No. 280 of the General Administration of Customs on October 14, 2025, with effect from June 1, 2026) (2025年10月14日海关总署令第280号公布 自2026年6月1日起施行)

Chapter I General Provisions 

第一章 总则

Article 1 These Provisions are formulated according to the Food Safety Law of the People's Republic of China and the regulation on the implementation thereof, the Law of the People's Republic of China on Imported and Exported Commodity Inspection and the regulation on the implementation thereof, the Law of the People's Republic of China on the Imported and Exported Animal and Plant Quarantine and the regulation on the implementation thereof, the Special Provisions of the State Council on Strengthening the Supervision and Administration of Safety of Food and Other Products, and other laws and administrative regulations for the purposes of strengthening the administration of registration of overseas production enterprises of imported food.   第一条 为了加强进口食品境外生产企业注册管理,根据《中华人民共和国食品安全法》及其实施条例、《中华人民共和国进出口商品检验法》及其实施条例、《中华人民共和国进出境动植物检疫法》及其实施条例、《国务院关于加强食品等产品安全监督管理的特别规定》等法律、行政法规的规定,制定本规定。
Article 2 These Provisions shall apply to the administration of registration of overseas production, processing, and storage enterprises exporting food to China (collectively, the "overseas production enterprises of imported food").   第二条 向中国境内出口食品的境外生产、加工、贮存企业(以下统称进口食品境外生产企业)的注册管理适用本规定。
For the purposes of the preceding paragraph, overseas production enterprises of imported food shall exclude the production, processing, and storage enterprises of food additives and food-related products. 前款规定的进口食品境外生产企业不包括食品添加剂、食品相关产品的生产、加工、贮存企业。
Article 3 The General Administration of Customs ("GACC") shall uniformly take charge of the administration of registration of overseas production enterprises of imported food.   第三条 海关总署统一负责进口食品境外生产企业的注册管理工作。
Article 4 An overseas production enterprise of imported food shall be registered with the GACC.   第四条 进口食品境外生产企业,应当经海关总署注册。
Article 5 The GACC shall, based on the principle of risk management, according to the assessment and review of the food safety management system and food safety status of the countries or regions where the overseas production enterprises are located, and in combination with the risk levels of the relevant food, implement classified administration of overseas production enterprises of imported food, and determine the corresponding registration methods, application materials, evaluation procedures, and other registration administration requirements.   第五条 海关总署按照风险管理原则,根据对进口食品境外生产企业所在国家(地区)食品安全管理体系和食品安全状况的评估审查情况,结合相关食品风险水平,对进口食品境外生产企业实施分类管理,确定相应的注册方式、申请材料、评审程序以及其他注册管理要求。
If a risk assessment or evidence shows any change in the risks associated with imported food, the GACC may adjust the corresponding registration administration requirements. 经风险评估或者有证据表明进口食品安全风险发生变化的,海关总署可以对相应注册管理要求进行调整。
Chapter II Registration Conditions and Procedures 

第二章 注册条件与程序

Article 6 The GACC shall determine and publish a catalogue of imported food requiring official recommendation for registration (“Catalogue”) based on the analysis of the sources of raw materials of food, production and processing technology, historical data on food safety, consumer groups, preparation, and other factors, in light of international practices.   第六条 海关总署根据对食品的原料来源、生产加工工艺、食品安全历史数据、消费人群、食用方式等因素的分析,结合国际惯例确定需官方推荐注册的进口食品目录(以下简称目录)并对外公布。
Article 7 Conditions for the registration of an overseas production enterprise of imported food are as follows:   第七条 进口食品境外生产企业注册条件:
(1) It is formed with the approval of the appropriate authority of the country or region and is under its effective supervision. (一)经所在国家(地区)主管当局批准设立并在其有效监管下;
(2) It establishes an effective food safety and health management and protection system, engages in lawful production and export in the country or region, and warrants that the food exported to China complies with the relevant laws, regulations, and national food safety standards of China. (二)建立有效的食品安全卫生管理和防护体系,在所在国家(地区)合法生产和出口,保证向中国境内出口的食品符合中国相关法律法规和食品安全国家标准;
(3) It complies with the relevant inspection and quarantine requirements agreed upon by the GACC and the appropriate authority of the country or region. (三)符合海关总署与所在国家(地区)主管当局商定的相关检验检疫要求。
An overseas production enterprise of food listed in the Catalogue shall also obtain a recommendation from the appropriate authority of the country or region where it is located. 列入目录食品的境外生产企业,还应当获得所在国家(地区)主管当局推荐。
Article 8 For an overseas production enterprise of food listed in the Catalogue, the appropriate authority of the country or region where it is located shall review and inspect the enterprise and issue a review and inspection report and a recommendation letter if it meets the registration requirements.   第八条 列入目录食品的境外生产企业,所在国家(地区)主管当局应当对企业进行审核检查,对符合注册要求的出具审核检查报告和推荐函。
Article 9 An overseas production enterprise of imported food shall submit the following application materials to the GACC on its own or through an agent:   第九条 进口食品境外生产企业应当自行或者委托代理人向海关总署提交以下申请材料:
(1) Enterprise registration application information. (一)企业注册申请信息;
(2) The identification documents of enterprises such as business licenses, or a certificate, issued by the appropriate authority of the country or region. (二)企业身份证明文件,如所在国家(地区)主管当局颁发的营业执照或者出具的证明等;
(3) A statement that the enterprise undertakes to comply with the requirements of these Provisions. (三)企业承诺符合本规定要求的声明。
An overseas production enterprise of food listed in the Catalogue shall also submit the review and inspection report and recommendation letter issued by the appropriate authority of the country or region where it is located. 列入目录食品的境外生产企业还应当提交所在国家(地区)主管当局出具的审核检查报告和推荐函。
When necessary, the GACC may require the enterprise to provide materials related to its food safety, sanitation and protection system, production type, and production capacity, among others. 必要时,海关总署可以要求企业提供食品安全卫生和防护体系、生产类型、生产能力等材料。
Article 10 The content of application information for enterprise registration shall include the name of the enterprise, the country or region, the address of its production venue, its legal representative, the point of contact, the contact information, the registration number approved by an appropriate authority of the country or region, and the kind of food involved in the registration application.   第十条 企业注册申请信息内容应当包括企业名称、所在国家(地区)、生产场所地址、法定代表人、联系人、联系方式、所在国家(地区)主管当局批准的注册编号、申请注册食品种类等信息。
