| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 This Regulation is developed in accordance with the Constitution of the People's Republic of China, the Organic Law of the State Council of the People's Republic of China, and the Organic Law of the Local People's Congresses at All Levels and the Local People's Governments at All Levels of the People's Republic of China for the purposes of strengthening and regulating the supervision over agency law enforcement, promoting strict, procedure-based, impartial, and non-abusive law enforcement, improving the level of law-based government administration, and intensifying efforts to build a government under the rule of law. | | 第一条 为了加强和规范行政执法监督工作，促进严格规范公正文明执法，提升依法行政水平，强化法治政府建设，根据《中华人民共和国宪法》、《中华人民共和国国务院组织法》、《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》，制定本条例。 |
| Article 2 This Regulation applies to the internal supervision within the administrative system conducted by the people's governments at or above the county level over the agency law enforcement work of the subordinate departments and local offices of the people's governments at the same level and the people's governments at lower levels and organizations with the function of managing public affairs as authorized by laws and regulations. | | 第二条 县级以上人民政府依法对本级人民政府所属部门、派出机关和下级人民政府以及法律法规授权的具有管理公共事务职能的组织的行政执法工作开展的行政系统内部监督，适用本条例。 |
| Article 3 The supervision over agency law enforcement is an important content of administrative supervision, a basic method of coordinating agency law enforcement work, and an important component of the Party and state's supervisory system. | | 第三条 行政执法监督是行政监督的重要内容，是统筹行政执法工作的基本方式，是党和国家监督体系的重要组成部分。 |
| Article 4 The supervision over agency law enforcement shall adhere to the leadership of the Communist Party of China, adopt a people-centered approach, and promote the realization of the effective unity of the political, legal, and social effects of agency law enforcement. | | 第四条 行政执法监督工作坚持中国共产党的领导，坚持以人民为中心，推动实现行政执法政治效果、法律效果和社会效果有机统一。 |
| The supervision over agency law enforcement shall adhere to overall coordination, be conducted in a more systematic, holistic, and coordinated manner, follow the principle of attaching equal importance to regulation and guidance, to prevention and correction, and to supervision and guarantee, supervise the rectification of agency law enforcement problems and improvement of the quality and efficiency of agency law enforcement, and ensure the correct implementation of laws and regulations. | | 行政执法监督工作坚持统筹协调，增强系统性、整体性、协同性，遵循规范与指导并重、预防与纠错并重、监督与保障并重原则，督促纠治行政执法问题、提升行政执法质效，保障法律法规正确实施。 |
| Article 5 The people's governments at or above the county level shall strengthen the organization and leadership of the supervision over agency law enforcement, study and deploy the supervision over agency law enforcement, and support and guarantee the effective performance of duties by agency law enforcement supervision authorities. | | 第五条 县级以上人民政府应当加强对行政执法监督工作的组织领导，研究部署行政执法监督工作，支持和保障行政执法监督机构切实履行职责。 |
| Article 6 The justice administrative departments of the people's governments at or above the county level are the agency law enforcement supervision authorities of the people's governments at the same level, and shall undertake specific affairs related to the supervision over agency law enforcement on behalf of the people's governments at the same level, be responsible for the implementation of the supervision over agency law enforcement, and submit regular reports on the supervision over agency law enforcement to the people's governments at the same level. | | 第六条 县级以上人民政府司法行政部门是本级人民政府的行政执法监督机构，代表本级人民政府承担行政执法监督具体事务，负责实施行政执法监督工作，定期向本级人民政府报告行政执法监督工作情况。 |
| The justice offices located in townships or towns (sub-districts) shall assist the agency law enforcement supervision authorities of the people's governments at the county level in conducting the supervision over agency law enforcement in accordance with the law. | | 设在乡镇（街道）的司法所协助县级人民政府行政执法监督机构依法开展行政执法监督工作。 |
| Article 7 Agency law enforcement supervision authorities shall assume the following duties: | | 第七条 行政执法监督机构承担下列职责： |
| (1) Guiding and supervising agency law enforcement work, and organizing the implementation of the agency law enforcement responsibility system and the accountability system. | | （一）指导监督行政执法工作，组织落实行政执法责任制和责任追究制度； |
| (2) Coordinating rule-of-law matters related to the reform of the agency law enforcement system, and coordinating agency law enforcement disputes. | | （二）协调行政执法体制改革有关法治事项，协调行政执法争议； |
| (3) Organizing and promoting more standardized, normalized, professional and digitalized agency law enforcement. | | （三）组织推动行政执法规范化、正规化、专业化、数字化建设； |
| (4) Implementing in an overall manner the management systems of agency law enforcement bodies, agency law enforcement personnel, agency enforcement actions, and agency law enforcement guarantee, among others. | | （四）统筹实施行政执法主体、行政执法人员、行政执法行为、行政执法保障等方面的管理制度； |
| (5) Other duties as prescribed by laws and regulations. | | （五）法律、法规规定的其他职责。 |
| Article 8 Agency law enforcement supervision authorities shall strictly perform their supervisory duties in strict accordance with the law, and shall neither substitute supervision for agency law enforcement nor abuse their powers to interfere with agency law enforcement to avoid increasing the burden on agency law enforcement authorities. | | 第八条 行政执法监督机构应当严格依法履行监督职责，不得以监督代替行政执法，不得滥用职权干预行政执法，避免增加行政执法机关负担。 |
| Chapter II Scope of Supervision | | 第二章 监督范围 |
| Article 9 Agency law enforcement supervision authorities shall supervise agency law enforcement authorities in implementing the major decisions and arrangements of the CPC Central Committee and the State Council for agency law enforcement work, implementing various agency law enforcement systems, and conducting agency law enforcement in accordance with the law, among others. | | 第九条 行政执法监督机构对行政执法机关贯彻落实党中央、国务院关于行政执法工作的重大决策部署，落实行政执法各项制度，依法开展行政执法等进行监督。 |
| Article 10 Agency law enforcement supervision authorities shall strengthen the administration of the qualifications of agency law enforcement bodies, reinforce the supervision over agency law enforcement personnel, improve the systems of qualification and certificate administration of agency law enforcement personnel, and supervise agency law enforcement authorities in effectively conducting the work concerning the admission and withdrawal of agency law enforcement personnel. | | 第十条 行政执法监督机构应当加强对行政执法主体资格的管理，加强对行政执法人员的监督，健全行政执法人员资格、证件管理制度，监督行政执法机关做好行政执法人员准入和退出工作。 |
| Article 11 Agency law enforcement supervision authorities shall strengthen the supervision over agency enforcement actions, supervise agency law enforcement authorities in improving the quality and efficiency of agency law enforcement, and conduct the work such as administrative licensing, administrative sanctioning, administrative compulsion, administrative inspections, administrative expropriation and requisition, and administrative payment, among other, in accordance with the law. | | 第十一条 行政执法监督机构应当加强对行政执法行为的监督，督促行政执法机关提升行政执法质效，依法开展行政许可、行政处罚、行政强制、行政检查、行政征收征用、行政给付等工作。 |
| Agency law enforcement supervision authorities shall supervise the following circumstances of agency law enforcement: | | 行政执法监督机构对行政执法下列情形进行监督： |
| (1) Whether agency law enforcement bodies and personnel have legal qualifications. | | （一）行政执法的主体、人员是否具有合法资格； |
| (2) Whether agency law enforcement procedures are legal. | | （二）行政执法程序是否合法； |
| (3) Whether agency law enforcement decisions violate laws or are obviously inappropriate. | | （三）行政执法决定是否违法或者明显不当； |
| (4) Whether nonfeasance or malfeasance in law enforcement, such as failure to opening cases that should have been opened, buck-passing, replacement of management with the imposition of fines, cross-jurisdictional law enforcement in violation of regulations, profit-driven law enforcement, or any arbitrary charge, fine, inspection, or seizure, exits in the process of agency law enforcement. | | （四）行政执法过程中是否存在有案不立、推诿扯皮、以罚代管、违规异地执法、趋利性执法以及乱收费、乱罚款、乱检查、乱查封等执法不作为、乱作为行为； |
| (5) Whether any uncivilized behavior such as conducting work in a simplistic or unmannerly way exits in the process of agency law enforcement. | | （五）行政执法过程中是否存在简单粗暴等不文明行为； |
| (6) Whether agency law enforcement personnel use their certificates, signs and marks, and equipment in a standardized manner, and whether they wear uniforms as required. | | （六）行政执法人员是否规范使用证件、标志标识及执法装备，是否按规定着制式服装； |
| (7) Other circumstances that affect the lawfulness and appropriateness of agency law enforcement. | | （七）其他影响行政执法合法性、适当性的情形。 |
| Article 12 Agency law enforcement supervision authorities shall supervise the implementation of the following agency law enforcement systems by agency law enforcement authorities in accordance with relevant provisions issued by the state: | | 第十二条 行政执法监督机构对行政执法机关按照国家有关规定落实下列行政执法制度情况进行监督： |
| (1) The management system of the qualifications and certificates of agency law enforcement personnel. | | （一）行政执法人员资格、证件管理制度； |
| (2) The agency law enforcement procedure systems of publication of agency law enforcement, recording of the entire law enforcement process, and legal review of major law enforcement decisions, among others. | | （二）行政执法公示、执法全过程记录、重大执法决定法制审核等行政执法程序制度； |
| (3) The system of agency law enforcement standards such as administrative discretion benchmark. | | （三）行政裁量权基准等行政执法标准制度； |
| (4) The relevant systems of list-based administration of agency law enforcement items, determination of agency law enforcement responsibilities, review of the status of agency law enforcement, and the accountability for agency law enforcement. | | （四）行政执法事项清单管理、行政执法责任确定、行政执法状况评议、行政执法责任追究等相关制度； |
| (5) The system of the coordination between agency law enforcement and criminal justice. | | （五）行政执法与刑事司法衔接制度； |
