For the purposes of thoroughly implementing the guiding principles set forth by the 20th National Congress of the Communist Party of China on improving a social governance system featuring co-construction, co-governance, and sharing and implementing the requirements of documents including the Opinions of the CPC Central Committee on Strengthening Adjudication Work in the New Era and the Opinions of the General Office of the CPC Central Committee and the General Office of the State Council on Improving the Mechanism for Diversified Resolution of Disputes, the Supreme People's Court and the Ministry of Transport have decided to advance the establishment of one-stop centers for the resolution of waterborne disputes and hereby issue the following opinions. 为深入贯彻党的二十大关于健全共建共治共享的社会治理制度,落实《中共中央关于加强新时代审判工作的意见》、《中共中央办公厅、国务院办公厅关于完善矛盾纠纷多元化解机制的意见》等文件要求,最高人民法院、交通运输部决定推进水上“一站式”解纷中心建设,现提出以下意见。
I. Guiding Principles   一、指导思想
Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, Xi Jinping Thought on the Rule of Law shall be thoroughly implemented, and General Secretary Xi Jinping's important instruction on placing non-litigation dispute resolution mechanisms at the forefront shall be fully carried out. The important decisions and arrangements made at the Third and Fourth Plenary Sessions of the 20th CPC Central Committee on upholding and developing the “Fengqiao Model” in the new era shall be comprehensively implemented, so as to comprehensively enhance the effectiveness of the prevention and resolution of maritime disputes. The objectives of resolving minor disputes onboard, resolving major disputes within ports, and preventing conflicts from being escalated or transferred upward shall be pursued to ensure that disputes are resolved at the primary level and at an early stage, thereby providing strong legal safeguards for accelerating the building of China into a transportation powerhouse and a maritime powerhouse. 以习近平新时代中国特色社会主义思想为指导,深入贯彻习近平法治思想,贯彻落实习近平总书记“坚持把非诉讼纠纷解决机制挺在前面”的重要指示精神,全面落实党的二十届三中、四中全会关于坚持和发展新时代“枫桥经验”的重要部署要求,全面提升海事纠纷预防化解效能,努力实现“小事不出船、大事不出港、矛盾不上交”,把矛盾纠纷化解在基层、化解在萌芽状态,为加快建设交通强国、海洋强国提供有力法治保障。
II. Work Objectives   二、工作目标
The waterborne “Fengqiao model” for the new era shall be upheld and developed; non-litigation dispute resolution mechanisms shall be placed at the forefront; the establishment of one-stop centers for the resolution of waterborne disputes shall be advanced; and a mechanism for the diversified resolution of maritime disputes that is organically coordinated, integrated, efficient, and convenient shall be established, to enhance the effectiveness of resolving disputes and ending controversies. The positive role of one-stop centers for the resolution of waterborne disputes shall be fully leveraged in resolving disputes involving waterborne transportation, seafarer labor relations, personal injury compensation, vessel pollution, and administrative disputes. Litigation-mediation linkage work shall be carried out, including conducting offline or online mediation, preparing mediation agreements, applying for judicial confirmation of mediation agreements, and issuing mediation statements, thereby comprehensively improving the quality and effectiveness of diversified maritime dispute resolution in the waterborne transportation sector. An online litigation-mediation linkage mechanism for maritime disputes between the Supreme People's Court and the Ministry of Transport shall be actively advanced under a “headquarters-to-headquarters” framework, with participation in the People's Courts mediation platform to carry out litigation-mediation linkage work. 坚持和发展新时代水上“枫桥经验”,切实把非诉讼纠纷解决机制挺在前面,推进水上“一站式”解纷中心建设,建立起有机衔接、联动集成、高效便捷的海事纠纷多元化解机制,提升定分止争效能。充分发挥水上“一站式”解纷中心在水上交通、船员劳务、人身损害赔偿、船舶污染、行政争议等方面矛盾纠纷化解中的积极作用,开展线下或在线调解、制作调解协议、申请司法确认调解协议、制作调解书等诉调对接工作,全面提升水上交通领域海事纠纷多元化解工作质效。积极推动建立最高人民法院与交通运输部海事纠纷“总对总”在线诉调对接机制,入驻人民法院调解平台,开展诉调对接工作。
III. Work Contents   三、工作内容
1. Strengthening prevention at source (一)强化源头预防
Maritime law enforcement and judicial authorities at all levels shall deepen the “Four Visits” program (visits to wharves, vessels, enterprises, and schools) and shall jointly carry out legal education and risk warnings. Theoretical and practical research shall be strengthened in such fields as prevention and control of waterborne safety risks, protection of the marine ecosystem, salvage of wrecks and sunken objects, maritime emergency search and rescue, and determination of liability for accidents, with a view to removing factors that constrain the effective resolution of disputes. In accordance with the law, assistance in enforcement shall be provided in matters including judicial arrest and auction of vessels, compulsory non-litigation enforcement of maritime administrative decisions, and investigation and evidence collection in maritime cases. 各级海事执法司法机构深化“四进”走访(进码头、船舶、企业、学校),联合开展普法宣传与风险预警。加强水上安全风险防控、海洋生态环境保护、沉船沉物打捞、水上应急搜寻救助、责任事故认定等领域的理论和实务研究,着力消除影响矛盾纠纷化解的制约因素。依法办理船舶司法扣押拍卖协助执行、海事行政决定非诉强制执行、海事案件调查取证等工作。
