Article 1 For the purposes of strengthening the protection of the Great Wall and regulating the utilization of the Great Wall, this regulation is formulated in accordance with the Cultural Relics Protection Law of the People's Republic of China.
| | 第一条 为了加强对长城的保护,规范长城的利用行为,根据《中华人民共和国文物保护法》(以下简称文物保护法),制定本条例。

Article 2 The term “Great Wall” as mentioned in this Regulation includes the walls, fortresses, passes, beacon towers and watch towers of the Great Wall. The sections of the Great Wall under the protection of this Regulation shall be subject to the certification of and be announced by the cultural relics administrative department of the State Council.
| | 第二条 本条例所称长城,包括长城的墙体、城堡、关隘、烽火台、敌楼等。 受本条例保护的长城段落,由国务院文物主管部门认定并公布。

Article 3 The policies on the work of cultural relics shall be carried through in the protection of Great Wall and the principle of scientific planning and protection of the original state shall be adhered to.

Article 4 The state shall protect the Great Wall as a whole and manage it on the basis of different sections. The cultural relics administrative department of the State Council shall be responsible for the overall protection of the Great Wall, coordinate and solve the serious problems arising during the protection of the Great Wall, and supervise and inspect the protection of the Great Wall carried out by all local places. The people's governments and their cultural administrative departments at the county level and above where the Great Wall is located shall, in accordance with the Law on the Protection of Cultural Relics, this Regulation and other relevant administrative regulations, be responsible for the protection of the Great Wall within their respective jurisdiction.
| | 第四条 国家对长城实行整体保护、分段管理。 国务院文物主管部门负责长城整体保护工作,协调、解决长城保护中的重大问题,监督、检查长城所在地各地方的长城保护工作。 长城所在地县级以上地方人民政府及其文物主管部门依照文物保护法、本条例和其他有关行政法规的规定,负责本行政区域内的长城保护工作。

Article 5 The people's governments at the county level and above where the Great Wall is located shall integrate the operating funds for the protection of the Great Wall into the fiscal budget of their respective level. The state encourages citizens, legal persons and other organizations to establish Great Wall protection foundations, which are exclusively used for the protection of the Great Wall. The raising, use and management of funds of the Great Wall protection foundations shall comply with the relevant laws and administrative regulations of the state.
| | 第五条 长城所在地县级以上地方人民政府应当将长城保护经费纳入本级财政预算。 国家鼓励公民、法人和其他组织通过捐赠等方式设立长城保护基金,专门用于长城保护。长城保护基金的募集、使用和管理,依照国家有关法律、行政法规的规定执行。

Article 6 The state shall adopt an expert consultation system for the protection of Great Wall. The opinions of experts shall be heard in the formulation of the overall plan on the protection of the Great Wall, examination and approval of the construction projects relating to the Great Wall, and making of decisions about other important matters relating to the protection of the Great Wall.
| | 第六条 国家对长城保护实行专家咨询制度。制定长城保护总体规划、审批与长城有关的建设工程、决定与长城保护有关的其他重大事项,应当听取专家意见。

Article 7 All citizens, legal persons and other organizations shall have the obligation to protect the Great Wall in accordance with the law. The state encourages citizens, legal persons and other organizations to participate in the protection of the Great Wall.
| | 第七条 公民、法人和其他组织都有依法保护长城的义务。 国家鼓励公民、法人和其他组织参与长城保护。

Article 8 The cultural relics administrative department of the State Council, the people's governments at the county level and above where the Great Wall is located and their cultural relics administrative departments shall give awards to the organizations or individuals who have made outstanding contributions to the protection of the Great Wall.
| | 第八条 国务院文物主管部门、长城所在地县级以上地方人民政府及其文物主管部门应当对在长城保护中作出突出贡献的组织或者个人给予奖励。

Article 9 The people's government of a province, autonomous region, or municipality directly under the Central Government shall survey the Great Wall within its administrative area, shall report the sections which it believes to be a part of the Great Wall to the cultural relics administrative department of the State Council for certification. Such sections of the Great Wall shall, within 1 year as of the date of certification, be approved and announced as a unit of provincial cultural relics protection. A section, which is certified as a section of the Great Wall but has not been approved or announced as a key unit of national cultural relics protection or provincial cultural relics protection, shall be approved and announced as a unit of national important cultural relics protection or provincial cultural relics protection within 1 year from the day when this Regulation becomes effective.
| | 第九条 长城所在地省、自治区、直辖市人民政府应当对本行政区域内的长城进行调查;对认为属于长城的段落,应当报国务院文物主管部门认定,并自认定之日起1年内依法核定公布为省级文物保护单位。 本条例施行前已经认定为长城但尚未核定公布为全国重点文物保护单位或者省级文物保护单位的段落,应当自本条例施行之日起1年内依法核定公布为全国重点文物保护单位或者省级文物保护单位。

Article 10 The state shall adopt the system of overall planning for the protection of the Great Wall. The cultural relics administrative department of the State Council shall, jointly with the relevant departments of the State Council, formulate an overall plan on the protection of the Great Wall according to the Law on the Protection of Cultural Relics as well as the actual needs of protection of the Great Wall. The said plan shall be executed after approval of the State Council. The overall plan on the protection of the Great Wall shall specify the protection standards and focuses, determine the protection measures on the basis of the different categories, and decide the protection sections of the Great Wall within which construction projects are prohibited. When a local people's government at the county level or above where the Great Wall is located makes a plan on the national economy and social development, an overall plan on the utilization of land, or an urban and rural plan, it shall cover the protection measures as prescribed in the overall plan on the protection of the Great Wall.
| | 第十条 国家实行长城保护总体规划制度。 国务院文物主管部门会同国务院有关部门,根据文物保护法的规定和长城保护的实际需要,制定长城保护总体规划,报国务院批准后组织实施。长城保护总体规划应当明确长城的保护标准和保护重点,分类确定保护措施,并确定禁止在保护范围内进行工程建设的长城段落。 长城所在地县级以上地方人民政府制定本行政区域的国民经济和社会发展计划、土地利用总体规划和城乡规划,应当落实长城保护总体规划规定的保护措施。

Article 11 The people's government of a province, autonomous region, or municipality directly under the central government where the Great Wall is located shall, according to the requirements as specified in the overall plan on the protection of the Great Wall, demarcate the protection range and construction control areas for the Great Wall within their respective jurisdiction, and make an announcement. The cultural relics administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government where the Great Wall is located shall report the announced protection range and control areas to the cultural relics administrative department of the State Council for archival purposes.
| | 第十一条 长城所在地省、自治区、直辖市人民政府应当按照长城保护总体规划的要求,划定本行政区域内长城的保护范围和建设控制地带,并予以公布。 省、自治区、直辖市人民政府文物主管部门应当将公布的保护范围和建设控制地带报国务院文物主管部门备案。

Article 12 No entity or individual may carry out any construction project within any protection range as specified in the overall plan on the protection of the Great Wall, where construction projects is prohibited.
