| | 2018年3月16日，杨某以4万元价格在成都某医美公司处购买“鼻综合和鼻部修复”医疗美容服务。成都某医美公司工作人员在接待杨某时介绍，使用国产膨体与进口膨体的价格差距不大，但进口膨体触感更为自然，故杨某选择采用进口膨体。杨某手机订单也显示，其购买产品名称为“进口膨体自体肋骨鼻综合加鼻部修复等”。 |
| | 2018年3月18日，成都某医美公司为杨某实施隆鼻修复术，使用材料为上海某医用材料有限公司生产的国产膨体。因杨某对于术后鼻尖形态不满意，2019年2月26日，成都某医美公司再次为杨某实施鼻尖成形术。同年3月初，杨某出现术后感染症状。同年10月9日，杨某要求进行术后改善，成都某医美公司再次为杨某实施隆鼻术。 |
| | 2020年1月，杨某以成都某医美公司提供医疗美容服务过程中违反合同约定，擅自使用国产膨体，存在消费欺诈为由，向成都市青羊区人民法院（以下简称一审法院）提起诉讼，请求判令成都某医美公司按医疗美容服务价格4万元的三倍承担惩罚性赔偿责任。一审法院认为，成都某医美公司与杨某在建立医疗美容服务合同时，就隆鼻修复术使用进口膨体材料达成合意，但成都某医美公司实际使用国产膨体材料，存在消费欺诈，根据《中华人民共和国消费者权益保护法》第五十五条规定，应承担杨某手术费用三倍的赔偿责任。据此，判决成都某医美公司赔偿杨某12万元。 |
| | 一审判决后，成都某医美公司不服，向成都市中级人民法院（以下简称二审法院）提起上诉。二审法院认为，成都某医美公司在植入膨体上确实存在未按约定提供进口膨体的欺诈行为，但其他的医疗美容服务已经实施，且杨某并未提交证据证明其他项目存在欺诈，三倍赔偿的范围应限于膨体部分。据此，判决成都某医美公司按照该膨体价格三倍赔偿杨某19500元。 |
