| Ma [REDACTED]qiang and Guo were employees of Shandong Tian[REDACTED] Energy Co., Ltd. (hereinafter referred to as "Tian[REDACTED] Company"). In October 2017, after leaving Tian[REDACTED] Company, Ma [REDACTED]qiang established Shandong Fu[REDACTED]da Environmental Protection Engineering Co., Ltd. (hereinafter referred to as "Fu[REDACTED]da Company"). Ma [REDACTED]qiang actually controlled and operated the Company and hired Guo to serve as the Chief Technology Officer. During the period from October 2017 to August 2018, in violation of the confidentiality agreement and confidentiality provisions, Guo instructed Fu[REDACTED]da Company to manufacture and operate fluidized bed dryers of the same kind as those manufactured and operated by Tian[REDACTED] Company by using the technical information of Tian[REDACTED] Company, and the illicit income was remitted to the bank account of Fu[REDACTED]da Company. It was identified that the technical information on integrated pipe laying of fluidized bed processors owned by Tian[REDACTED] Company and the fluidized bed technical information used by Fu[REDACTED]da Company was identical with the aforesaid technical information of Tian[REDACTED] Company. It was audited that Fu[REDACTED]da Company's acts of infringing on a trade secret caused loss of over 4.80 million yuan to Tian[REDACTED] Company. | | 马某强、郭某曾系山东天某能源股份有限公司（以下简称天某公司）员工。2017年10月，马某强从天某公司离职后借用他人身份成立山东福某达环保工程有限公司（以下简称福某达公司）。马某强实际控制、经营该公司，并聘用郭某任技术总监。2017年10月至2018年8月间，郭某违反保密协议和保密规定，在福某达公司使用天某公司的技术信息生产经营与天某公司同类的流化床干燥装置，所得违法收入均进入福某达公司账户。经鉴定，天某公司拥有的一体化埋管流化床处理装置技术信息是商业秘密，福某达公司使用的流化床技术信息与天某公司的上述技术信息相同。经审计，福某达公司侵犯商业秘密行为造成天某公司损失人民币480余万元。 |

| ．．．．．． | | 2019年4月16日，山东省济南市公安局高新技术产业开发区分局以犯罪嫌疑人马某强、郭某涉嫌侵犯商业秘密罪，移送济南市高新技术产业开发区人民检察院（以下简称高新区检察院）审查起诉。高新区检察院依法向被侵权方天某公司告知诉讼权利义务，听取其意见。天某公司提出希望提起刑事附带民事诉讼，降低维权成本，挽回经济损失。高新区检察院通过走访权利人了解涉案技术，听取有专门知识的人意见，综合审查全案证据，夯实相关证据基础，追加认定福某达公司涉嫌单位犯罪。 |
