| In March 2023, Huizhou [REDACTED] Industrial Co., Ltd. (hereinafter referred to as the "Huizhou [REDACTED] Industrial Company") filed a lawsuit, claiming that Huizhou [REDACTED] Water Purification Co., Ltd. (hereinafter referred to as the "Huizhou [REDACTED] Purification Company") and its legal representative Qiu [REDACTED]yan should make the payment for goods in arrears in an amount of 10.41 million yuan (the same currency, here and below) and the relevant interest thereon. After the mediation organized by the Primary People's Court of Huicheng District of Huizhou City of Guangdong Province (hereinafter referred to as the "Huicheng Primary People's Court"), both parties reached a mediation agreement on payment by installments, which has been confirmed in a civil mediation paper. Since Huizhou [REDACTED] Purification Company and Qiu [REDACTED]yan failed to perform the payment obligation, Huizhou [REDACTED] Industrial Company filed an application with the Huicheng Primary People's Court for enforcement of the mediation agreement. | | 2023年3月，惠州市某实业有限公司（以下简称惠州某实业公司）提起诉讼，请求惠州市某水质净化有限公司（以下简称惠州某净化公司）及其法定代表人丘某炎支付拖欠的货款人民币1041万余元（币种下同）及相应利息。经广东省惠州市惠城区人民法院组织调解，双方达成分期付款调解协议并经民事调解书确认。因惠州某净化公司、丘某炎未履行付款义务，惠州某实业公司向惠城区人民法院申请强制执行。 |

| | 执行过程中，经调查核实，被执行人丘某炎名下登记的四处不动产均设立了抵押权，且不动产的价值明显不足以覆盖抵押权人的债权，对其拍卖属无益处置；被执行人惠州某净化公司承接政府污水处理工程，负责惠阳区淡水城区60%的污水处理，享有应收工程款的债权。该工程款由惠阳区住房和城乡建设局（以下简称惠阳区住建局）按月分期支付到被执行人惠州某净化公司已被冻结的银行账户，但案外人惠州某商业银行惠阳支行（以下简称某银行惠阳支行）对上述应收工程款享有质押权。被执行人用接收的工程款维持企业经营、推进污水处理工程，并按月偿还质押权人某银行惠阳支行的债权。在惠阳区人民法院依法冻结惠州某净化公司接收工程款的账户后，申请执行人惠州某实业公司多次申请强制执行该工程款。惠阳区住建局认为，若强制执行该工程款，将直接影响企业污水处理工程进度，进而影响淡水城区近20万居民的正常生活，亦会对当地生态环境造成负面影响。 |
