Where, during the enforcement, the person subject to enforcement refuses to satisfy the judgment or ruling rendered by the people's court while he or she is able to do so, the people's court may issue to him or her a risk warning that he or she is on suspicion of refusing to satisfy the judgment or ruling, notify him or her of the criminal liability for refusal to satisfy the judgment or ruling, and urge the person subject to enforcement to voluntarily satisfy the judgment or ruling. 在执行过程中,被执行人对人民法院的判决、裁定有能力执行而拒不执行的,人民法院可以向其发出涉嫌拒不执行判决、裁定犯罪的风险预告,告知拒不执行判决、裁定可能承担的刑事责任,督促被执行人自动履行。

 天水某物业管理有限公司与明某租赁合同纠纷一案,甘肃省天水市麦积区人民法院于2020年11月5日作出(2020)甘0503民初2444号民事判决:明某腾空、返还天水某物业管理有限公司案涉房屋,并支付相应房屋占用费、物业费等。宣判后,明某不服,提起上诉。甘肃省天水市中级人民法院于2021年3月18日作出(2021)甘05民终58号民事判决:维持腾空、返还房屋的判项,同时对房屋占用费、物业费等数额作出调整。判决生效后,明某拒不履行。天水某物业管理有限公司于2021年5月20日向麦积区人民法院申请强制执行。
 执行过程中,麦积区人民法院于2021年5月27日向明某发出执行通知书、报告财产令,通知其限期腾退案涉房屋,并支付执行款。期限届满,明某拒不腾退。后麦积区人民法院又张贴腾房公告,责令明某在指定的日期前腾退房屋,明某仍拒不配合执行,并纠集家属亲友围堵执行现场,引起数十名群众围观,致使执行工作无法进行。
