| | 天水某物业管理有限公司与明某租赁合同纠纷一案，甘肃省天水市麦积区人民法院于2020年11月5日作出（2020）甘0503民初2444号民事判决：明某腾空、返还天水某物业管理有限公司案涉房屋，并支付相应房屋占用费、物业费等。宣判后，明某不服，提起上诉。甘肃省天水市中级人民法院于2021年3月18日作出（2021）甘05民终58号民事判决：维持腾空、返还房屋的判项，同时对房屋占用费、物业费等数额作出调整。判决生效后，明某拒不履行。天水某物业管理有限公司于2021年5月20日向麦积区人民法院申请强制执行。 |
| | 执行过程中，麦积区人民法院于2021年5月27日向明某发出执行通知书、报告财产令，通知其限期腾退案涉房屋，并支付执行款。期限届满，明某拒不腾退。后麦积区人民法院又张贴腾房公告，责令明某在指定的日期前腾退房屋，明某仍拒不配合执行，并纠集家属亲友围堵执行现场，引起数十名群众围观，致使执行工作无法进行。 |
