| | 重庆某实业有限公司与重庆某建筑工程有限公司、潘某买卖合同纠纷一案，重庆自由贸易试验区人民法院于2021年1月7日作出（2021）渝0192民初442号民事判决：重庆某建筑工程有限公司（以下简称重庆某建筑公司）向重庆某实业有限公司（以下简称重庆某实业公司）支付货款人民币433.05万元（币种下同）及相应资金占用费126.69万元；潘某对重庆某建筑公司的上述债务承担连带保证责任。因被执行人重庆某建筑公司、潘某逾期未履行生效法律文书确定的义务，申请执行人重庆某实业公司于2022年3月18日向重庆自由贸易试验区人民法院申请强制执行。 |
| | 在执行过程中，重庆自由贸易试验区人民法院首次查封了被执行人潘某名下位于重庆市江北区某小区的车位，共计73个。案涉车位所在的小区建成于2004年，小区有5栋楼房，共计445套住房，住房与车位配比约为1:0.3。案涉73个车位均为建筑区划内规划用于停放汽车的车位，车位处于承租人租赁使用状态。案涉车位由被执行人潘某于2009年一次性购买取得。潘某目前并非小区业主。车位被查封后，被执行人仍未履行义务，重庆某实业公司向重庆自由贸易试验区人民法院申请进行处置。 |
