| Hainan Yanyangxia Agricultural Development Co., Ltd. (“Yanyangxia Company”) obtained the registered trademarks of “(volcano litchis)”, “(volcano litchis)” and “(king volcano litchis)”, which were approved by the State Intellectual Property Office. In May 2022, Yanyangxia Company had its shopping activities at Qixiang package shop and the relevant data in its WeChat moment preserved and notarized, and then sued Hainan Qixiang Industrial Co., Ltd. (“Qixiang Company”) and Haikou Qiqiang Trading Co., Ltd. (“Qiqiang Company”) for infringing trademarks. During the hearing, the court unpacked the notarized and sealed articles submitted on the spot by Yanyangxia Company, including packing cartons of various sizes printed with “火山荔枝” or “火山荔枝王” and seven rolls of adhesive tapes printed with “精品火山荔枝(boutique volcano litchis)”, and found that Qixiang Company was the producer and seller of the cartons and tapes in question and Qiqiang Company was the seller of the cartons and tapes in question. Qixiang Company was set up in March 2015, and its business scope covers the sales of packing materials and products, the production of paper products, etc. Qiqiang Company was founded in September 2018, and its business scope covers the sales of packing materials and products, production and sales of paper products, etc. In March 2019, Haikou Agricultural Technology Promotion Center obtained the geographical indication trademark of “海口火山荔枝HAIKOU VOLCANO LITCHI” with the logo of “图片”. | | 海南艳阳下农业发展有限公司（以下简称艳阳下公司）经国家知识产权局核准，注册取得“图片”“图片”“图片”商标。2022年5月，艳阳下公司对其在琦祥包装店铺购物过程及其有关手机微信软件上好友朋友圈的相关信息进行保全证据公证，之后以海南琦祥实业有限公司（以下简称琦祥公司）、海口琦强贸易有限公司（以下简称琦强公司）商标侵权为由提起诉讼。庭审中，法院对艳阳下公司当庭提交的公证封存的实物进行拆封，封存实物为不同型号的纸装箱和七卷胶带，纸装箱上分别印有“火山荔枝”“火山荔枝王”字样，胶带上印有“精品火山荔枝”。另查明，琦祥公司是涉案纸装箱和胶带的生产方和销售方，琦强公司是涉案纸装箱和胶带的销售方。琦祥公司2015年3月成立，经营范围为包装材料及制品销售、纸制品制造等。琦强公司2018年9月成立，经营范围为包装材料及制品销售、纸制品制造、销售等。2019年3月，海口市农业技术推广中心取得名称为“海口火山荔枝HAIKOU VOLCANO LITCH”、图案为“图片”的地理标志证明商标。 |
