| In the handling of a criminal case of infringing on a trade secret with strong professionalism and technicality, the procuratorial organ may, by relying on mechanisms of technical investigation officers and procuratorial technology-assisted case-handling, ascertain complex technical facts and accurately determine the criminal acts of infringing on a trade secret. For a case involving "an overlapping criminal and civil issue," the procuratorial organ shall simultaneously examine the facts of criminal offense and civil tort, identify omitted criminal facts from the associated prior civil judgment upon examination, and additionally ascertain relevant criminal facts by taking into full account all evidence in the case. The amount involved in the crime shall be determined according to the value of the patent contained in the infringing equipment involved, the proportions of values of each secret point, and other factors, so as to vigorously safeguard the legitimate rights and interests of the innovation actor. | | 检察机关在办理专业性、技术性强的侵犯商业秘密犯罪案件中，可以依托技术调查官、检察技术辅助办案等机制全面查明复杂技术事实，准确认定侵犯商业秘密犯罪行为。对涉及“刑民交叉”的案件，同步审查刑事犯罪与民事侵权事实，从关联的在先民事判决中审查发现遗漏犯罪事实，综合全案证据追加认定有关犯罪事实。结合涉案侵权设备包含的专利价值、各秘密点的价值比例等因素认定犯罪数额，有力保障创新主体合法权益。 |

| | 孙某明系同某技术股份有限公司（以下简称同某公司）国际业务本部原总经理，负责公司海外市场工作，与公司签订了保密协议。2011年5月，孙某明从同某公司离职后创立北京君某科技有限公司（以下简称君某公司），担任该公司法定代表人、董事长兼总经理。孙某明违反保密义务，利用其在同某公司工作期间掌握的经营信息，促成君某公司向马来西亚某公司销售两套“通过式车辆快速安全检查系统”业务，上述两套设备于2012年2月以FOB方式出口至马来西亚。经鉴定，同某公司与马来西亚某公司项目涉及的相关经营信息具有非公知性。 |
| | 胡某伟、李某祺、王某锋均系同某公司原技术人员，从事快速安全检查设备相关领域技术工作，并均与公司签订了保密协议。后三人陆续入职君某公司，胡某伟担任技术总工程师，负责整体技术的决策、研发、管理。李某祺、王某锋分别担任图像处理工程师和探测器工程师，负责公司快速安全检查产品的整体技术、图像处理算法和束流强度校正装置设计等工作。其中，胡某伟、李某祺参与了马来西亚海外项目快速安全检查设备的技术应用、维护工作。经鉴定，同某公司主张的“集装箱/车辆快速检查系统扫描控制方案”、“一致性校正图像处理系统”等四项技术秘密点具有非公知性，且与该项目两台设备上所应用的四个技术信息具有同一性。后胡某伟、李某祺、王某锋共同参与了另一型号快速安全检查设备技术研发应用工作，该设备于2018年4月由君某公司销售给新疆某有限公司。经鉴定，同某公司主张的“束流强度校正装置”、“亮度校正图像处理系统”等四项技术秘密点具有非公知性，且与该台设备上所应用的四个技术信息具有同一性。 |
